FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 To perform the following water obstruction and encroachment activities in and along an unnamed tributary to the Wissahickon Creek associated with Whitemarsh Valley Country Club rehabilitation project:

 1. To remove five existing undersized culverts.

 2. To remove the existing concrete and asphalt stream bank protection materials.

 3. To grade, and stabilize approximately 880 linear feet of the stream banks.

 4. To construct and maintain two new 8-foot wide and one 12-foot wide golf cart bridges.

 5. To dredge five existing man-made ponds.

 The site is located along Germantown Pike, between the intersections of Thomas Road and Northwestern Avenue (Germantown, PA USGS Quadrangle N: 17 inches; W: 15.25 inches).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341 (a)].

 To construct and maintain a sewer line crossing through approximately 13 feet of PFO wetlands (EV) within the Dry Saw Mill Run Watershed for the purpose of constructing an on-lot septic system for a residential dwelling. The crossing consists of three 3-inch diameter PVC pipe sleeves encased in concrete. The project is located on Lot 7134 Country Court in Emerald Lakes Development (Pocono Pines, PA Quadrangle Latitude: 41°04`25.0"; Longitude: -75°24`56.2"). Subbasin: 1E.

E45-564. The Nature Conservancy, P. O. Box 55, Long Pond Road, Long Pond, PA 18334. Tobyhanna Township, Monroe County, Army Corps of Engineers Philadelphia District.

 To construct and maintain an approximately 18-inch wide nature trail consisting of a half-log boardwalk elevated approximately 12-inches across approximately 5,470 feet of wetlands within the Twomile Run Watershed (HQ-CWF, MF) and to construct and maintain an 8-foot by 12-foot building (bird blind) supported by piers, elevated approximately 2.75 feet above wetlands. The project is located on the east side of Burger Road (TR 551) approximately 1.0 mile north of SR 0115 (Blakeslee and Thornhurst, PA Quadrangles Latitude: 41° 06` 54"; Longitude: -75° 35` 36") in Tobyhanna Township, Monroe County. Subbasin: 2A.

 To fill 0.06 acre of isolated PFO wetlands within the Tunkhannock Creek Watershed (HQ-CWF, MF) for the purpose of constructing a single family dwelling. The permittee is required to provide for 0.06 acre of replacement wetlands by participating in the Pennsylvania Wetland Replacement Project. The project is located along Tanglewood Drive on Lot 22, Unit 4, Section 6 of the Lake Naomi Subdivision (Pocono Pines, PA Quadrangle Latitude: 41°06`55.7"; Longitude: -75°26`13.9") in Tobyhanna Township, Monroe County. Subbasin: 2B.

 To fill 0.11 acres of isolated PEM wetlands located within the Lackawaxen River Watershed (HQ-TSF, MF) for the purpose of constructing a 395-foot long by 40-foot wide stone parking lot expansion. The permittee is required to provide for 0.11 acre of replacement wetlands by participating in the Pennsylvania Wetland Replacement Project. The project is located at 695 Texas Palmyra High (U.S. Route 6) (White Mills, PA Quadrangle Latitude: 41°31`36"; Longitude: -75°12`23") in Texas Township, Wayne County. Subbasin: 1B.

E35-430. County of Lackawanna, 200 Adams Avenue, Scranton, PA 18503. Archbald Borough, Lacka- wanna County, Army Corps of Engineers Baltimore District.

 To place fill in deminimus area of PEM wetlands equal to 0.04 acre and to relocate approximately 485 feet of a tributary to Aylesworth Creek Reservoir with the construction and maintenance of 535 feet of new channel meandering through an existing wetland, for the purpose of constructing Aylesworth Creek Reservoir Park. The project is located in the emergency spillway of Aylesworth Creek Reservoir approximately 1200 feet upstream of US 6 (Lackawanna Valley Industrial Highway/Casey Highway) in Archbald Borough, Lackawanna County. (Carbondale, PA Quadrangle Latitude: 41° 31` 14"; Longitude: -75° 31` 43"). Subbasin: 5A.

To rehabilitate and maintain approximately 1,400 linear feet of Mudlick Run (HQ-CWF), including approximately 162` of channel relocation, 608` of bank grading, a cattle crossing, 10 j-hook log/rock vanes, 4 rock vanes and riparian plantings. E56-356. Pennsylvania Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797. To remove an existing foot bridge to place and maintain 70` of rip-rap along the banks of Kimberly Run (CWF) and to construct and maintain a single span bridge of steel I beam construction, with a span of 48` and a treated wood deck with a width of 14` and an underclearance of 10` and supported by poured concrete abutments, over Kimberly Run (CWF), for the purpose of replacing an existing ford crossing and providing access to portions of State Game Lands 50. DRAFT HAZARDOUS PERMIT

 Public Hearing and Notice of Intent to Renew a Hazardous Waste Storage Permit

Permit ID NO. PAD003001070. Air Products and Chemicals, Inc., 7201 Hamilton Boulevard, Allentown, PA 18195-1501, Upper Macungie Township, Lehigh County.

 The Commonwealth of Pennsylvania, Department of Environmental Protection (DEP) will hold a public hearing regarding Air Products and Chemicals, Inc. proposed renewal of their Hazardous Waste Storage permit, PAD003001070, in accordance with an application for a Class 2 Hazardous Waste Permit Renewal. The Hazardous Waste Storage Facility, located in Allentown, Pennsylvania, consists of administrative offices, Research and Development and Lehigh District Gas Sales Facility. Research facilities are primarily chemical and physical laboratories and experiments are mostly conducted on a small scale. Separate drum storage buildings are available near R&D 3 and R&D 4. None of the hazardous waste is disposed of on-site. All hazardous waste generated at the facility is stored in drums or lab packed and shipped off site to a permitted hazardous waste treatment and disposal facility. The types and quantities of hazardous waste generated at the site are dependent upon the current research activity. The amount of hazardous waste generated at the site is estimated at 10,000 pounds per month. Air Products does not intend to change the quantities or types of waste which are currently approved for storage.

 A public hearing is scheduled for November 3, 2011 at 10:00 AM. The hearing will be held at the Upper Macungie Township Building, 8330 Schantz Road, Breinigsville, Lehigh County, PA. The public hearing will be held on the Department of Environmental Protection's draft permit renewal for the Hazardous Waste Storage Permit.

 The Department, in completing its review and prior to taking final action on the permit application for Air Products and Chemicals, Inc. will consider all written comments received during the comment period, and oral or written statements received during the public hearing, the requirement of 25 PA Code Chapter 260a—270a and 260—270 7 273 as incorporated by reference, and the DEP's permitting process.

 The public comment period will begin on October 1, 2011, and will end on November 14, 2011. Any person interested in commenting on the application or draft permit must do so within this comment period.

 Person intending to testify at the hearing should submit written notice to Mr. Bill Tomayko, Program Manager, Department of Environmental Protection, 2 Public Square, Wilkes-Barre, PA 18701-1915. This written notice should include the person's name, address, telephone, and a brief description as to the nature of the testimony. Comments should be kept brief and, depending on the number of speakers, may be limited to 10 minutes per speaker. The Department requests that individuals present written copies of their testimony in addition to their oral presentation.

 Person may present oral or written statements or data concerning the draft permit directly to the Department before, during, or after the public hearing, as long as the Department receives the statement and data before November 14, 2011. Comments should include name, address, and telephone number of the writer and a concise statement to inform the Department regarding the exact basis of any comment and relevant fact on which it is based.

 Following the public comment period, the Department will make a final determination regarding the draft hazardous waste permit. Notice of this determination will be published in the Pennsylvania Bulletin, at which time the determination may be appealed to the Environmental Hearing Board. The Department will provide a written justification for changes to the draft hazardous waste permit to persons providing comment to the Department.

 On July 27, 2011, the Department of Environmental Protection issued an Order and Assessment of Civil Penalty to Christopher Ford decertifying him from radon testing under individual certification #2176, ordering Ford to not apply for any certification under the Radon Certification Act, (63 P. S. §§ 2001—2014), prior to December 14, 2016, and assessing a civil penalty of $58,875.00 against Ford. These actions were taken for Christopher Ford's failure to comply with various radon-related regulations, including 25 Pa. Code § 240.111 by having an uncertified employee conduct radon mitigation, 25 Pa. Code § 240.203(a)(1) by failing to conduct his radon-related activities as described in his application, 25 Pa. Code § 240.303(a) by not reporting his radon-related activities to the Department, 25 Pa. Code § 240.304 by not following his Quality Assurance program, 25 Pa. Code § 240.305 by not having records of his exposure to radon, and 25 Pa. Code § 240.308 by not conducting his radon-related activities in accordance with EPA or DEP approved protocols.

Description: The Authority has constructed a 3 million gallon Flow Equalization Basin (FEB) with ancilliary facilities at its wastewater pretreatment facility, located at PA Route 100 and Industrial Boulevard. The facility receives highly variable hydraulic and organic loadings. The ancilliary facilities consist of an influent pump station, jet mixing system for the FEB, odor control equipment, and other systems. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund was the project's funding source. The Department's review of the project and the information received has not identified any significant adverse environmental impact resulting from the proposal. The Department hereby categorically excludes the project from the State Environmental Review Process.

Project Applicant: Minersville Sewer Authority, 2 East Sunbury Street, Minersville, PA 17954

Location: Minersville Borough, Branch & Cass Townships, Schuylkill County

Description: The proposed project includes the following reliability, efficiency, and performance upgrades at the existing wastewater treatment plant: replace mechanical screen in headworks structure; replace aerated grit removal system with stainless steel unit; new chain and bucket elevator system with automatic controls; install 12 in. line between aeration tank and clarifier splitter box; purchase pumps, parts and other various equipment. The project also includes replacement of 1500 ft. of 18 in. interceptor sewer with 24 in. interceptor to reduce frequency and volume of CSO events. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is the funding source for this project. The Department's review of the project and the information received has not identified any significant adverse environmental impact resulting from this project. The Department hereby categorically excludes this project from the State Environmental Review Process.

Project Applicant: South Wayne County Water & Sewer Authority, PO Box 6, Lake Ariel, PA 18436

Location: Lake and Salem Townships, Wayne County

Description: The Authority's project was proposed to upgrade and replace antiquated sanitary collector sewers and force mains, and to replace two existing Pump Stations (PS-4 & PS-C) with no increase in pump capacities, within a portion of the existing development. Project includes replacement of approximately 2,500 LF of gravity sewer main, 1,000 LF of force main and associated piping at the pump stations, along with a portable generator to service the pumping stations to provide operation during power outages. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is the funding source for this project. The Department's review of the project and the information received has not identified any significant adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.

Project Applicant: Lackawanna River Basin Sewer Authority, PO Box 9068, Dickson City, PA 18519

Location: Carbondale City/ Fell Township, Blakely Borough, Lackawanna County

Description: The Authority's proposed project is to construct improvements to its wastewater conveyance system in two separate areas as follows. Carbondale/ Fell Township: Replacement of approximately 1,300 L.F. of existing interceptor sewer and 390 L.F. of existing combined sewers, along with rehabilitation of CSO Manhole 21-A, including storm sewer separation work. Blakely Borough: Replacement of approximately 2,850 L.F. of existing interceptor sewers. Purpose of the projects is to eliminate hydraulic bottlenecks, eliminate stormwater inflow, record CSO flow events, and increase conveyance capacity to limit frequency, volume, and duration of CSO events to the Lackawanna River. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is the funding source for this project. The Department's review of the project and the information received has not identified any significant adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.
