Stream Redesignation Evaluations; Water Quality Standards Review

 Under 25 Pa. Code § 93.4d (relating to processing of petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) gives notice that an evaluation will be conducted on all or portions of the following streams to determine the proper Aquatic Life Use or Special Protection designations in this Commonwealth's Water Quality Standards.

 Persons who have technical data concerning the water quality, instream habitat or biological condition of these stream sections are encouraged to make it available to the Department for consideration in the assessment. These assessments may lead to recommendations to the Environmental Quality Board for redesignation.

 Data should be submitted to Tony Shaw, Division of Water Quality Standards, Bureau of Water Standards and Facility Regulation, P. O. Box 8467, Harrisburg, PA 17105-8467, tshaw@state.pa.us. Data should be submitted no later than 30 days following publication of this notice. Questions concerning this evaluation can be directed to Tony Shaw at (717) 787-9637.

 Sinnemahoning Creek basin from the source to the confluence with West Branch Susquehanna River includes approximately 1,033 square miles and over 2,000 stream miles. Originally Driftwood Branch Sinnemahoing Creek and East Fork Sinnemahoning Creek were noticed for the intent to assess. (See 40 Pa.B. 6338) (October 30, 2010). After a preliminary review of available data the Department has decided to expand the study area to the entire Sinnemahoning Creek basin. Persons who have already responded to the earlier Driftwood Branch or East Fork Sinnemahoning notice do not need to reply or resubmit information again in response to this notice. The designated uses for the basin are too numerous to list in this notice and can be found under 25 Pa. Code § 93.9l (relating to Drainage List L). The study area will include the entire Sinnemahoning Creek basin.

 Pine Creek basin from the source to the confluence with West Branch Susquehanna River includes approximately 979 square miles and over 1,500 stream miles. Originally Pine Creek mainstem, Little Pine Creek basin, and Elk Run were noticed for the intent to assess. (See 40 Pa.B. 1266 (March 6, 2010).) After a preliminary review of available data the Department has decided to expand the study area to the entire Pine Creek basin. Persons who have already responded to the earlier Pine Creek mainstem, Little Pine Creek or Elk Run notice do not need to reply or resubmit information again in response to this notice. The designated uses for the basin are too numerous to list in this notice and can be found under 25 Pa. Code § 93.9l. The study area will include the entire Pine Creek basin.

 Laurel Run (Union County), Marsh Creek (Centre County), Pine Creek (Schuylkill County) and Mahannon Creek (Schuylkill County) basins are currently designated Cold Water Fishes, Migratory Fishes (CWF, MF). The study area will include each basin in its entirety.

 East Branch Wyalusing Creek basin is currently designated CWF, MF with the exception of Pettis Run and South Branch basins which are currently designated Warm Water Fishes, Migratory Fishes (WWF, MF). Middle and North Branches of Wyalusing Creek basin are currently designated CWF, MF. The remainder of the Wyalusing Creek basin, including the basin from the Middle Branch/East Branch confluence to North Branch and from North Branch to mouth is currently designated WWF, MF. The study area will include the entire Wyalusing Creek basin.

 Starrucca Creek basin is currently designated CWF, MF with the exception of Unnamed Tributary 32264 which is currently designated Exceptional Value, Migratory Fishes (EV, MF). The study area will include the entire Starrucca Creek basin.

 Otter Creek basin from the source to the upstream boundary of State Game Lands No. 83, with the exception of Mill Branch and South Fork Otter Creek basins is currently designated CWF, MF. Mill Branch and South Fork Otter Creek are currently designated WWF, MF. Otter Creek basin from the upstream boundary of State Game Lands No. 83 to mouth is currently designated High Quality—Cold Water Fishes, Migratory Fishes (HQ-CWF, MF). The study area will include the entire Otter Creek basin.

 Clarion River basin from the source to and including Little Toby Creek includes approximately 484 square miles and over 900 stream miles. Originally East Branch Clarion River basin was noticed for the intent to assess. (See 40 Pa.B. 6338). After a preliminary review of available data the Department has decided to expand the study area to the Clarion River basin from the source to, and including, Little Toby Creek. Persons who have already responded to the earlier East Branch Clarion River notice do not need to reply or resubmit information again in response to this notice. The designated uses for the basin are too numerous to list in this notice and can be found under 25 Pa. Code § 93.9r (relating to Drainage List R). The study area will include the entire Clarion River basin from the source to and including Little Toby Creek.

 The designated use of the Tidioute Creek basin from the source to mouth is delineated incorrectly in 25 Pa. Code § 93.9q (relating to Drainage List Q). To clarify the correction, the study area will include the entire Tidioute Creek basin.
