THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Existing Activity: The application is for a renewal of an NPDES permit for a discharge of treated process wastewater from cleaning slab surface scaling at the steel hot rolling mill, and contact and non-contact cooling water at the heat treatment production facilities through Outfall 001. Site stormwater discharges through Outfalls 002, 003, 004, and 005.
The receiving stream, Schuylkill River, is located in State Water Plan watershed 3-F and is classified for Warm Water Fishes and Migratory Fishes, aquatic life, water supply and recreation. The discharge is not expected to affect public water supplies.
Review and approval of chemical additives was based on the following provisional human health criteria, using the most recent scientific data available, and are proposed as site specific criteria:
Chlorite = 200 mg/l
Acrylamide= 0.00007 mg/l
Methylene bis(thiocyanate) = 0.035 mg/l
Acrylamide = 0.00007 mg/l
The proposed effluent limits for Outfall 001 are based on a design flow of 1.2 MGD.

Total Maximum Daily Loads of Nutrients and Dissolved Oxygen under Low-Flow Conditions in the Christina River Basin
Pennsylvania, Delaware and Maryland The Environmental Protection Agency Region III (EPA) established these Total Maximum Daily Loads (TMDLs) for nutrients and other oxygen demanding pollutants in order to attain and maintain the applicable water Quality Stardarts (WQS) for Dissolve Oxygen (DO) in the Christina River Basin under Low-Flow conditions. The TMDLs were last amended on August 23, 2006. The previous TMDL, and the amendments were developed on assumed total nitrogen levels in the in the point sources. Since then actual total Nitrogen levels are available. Based on available data the Waste Load Allocations (WLAs) for Total Nitrogen are revised, however, the total WLAs for pollutant ''Total Nitrogen'' for Christina River Basin in unchanged.

The condition includes the requirement to report the application of these credits in Supplemental Discharge Monitoring Reports (DMRs) submitted to the Department.
* The compliance date for Net Total Nitrogen and Net Total Phosphorus will begin on the Permit Effective Date. Since these reporting requirements are annual loads, the reporting on compliance with the annual limitations will be required to be reported on the Supplemental DMR—Annual Nutrient Summary by November 28, 2012.
In addition, the permit contains the following major special conditions:
• In the event that the final treated reclaimed water does not meet the effluent limitations required by this permit (i.e., off-specification water), the off-specification water may be recycled back to the Spring Creek Pollution Control Facility (SCPCF) prior to the effluent sampling and flow monitoring point and not be considered a discharge to the High Purity Water Wetland and/or Slab Cabin Run. When off-specification water is recycled back to the SCPCF and not discharged to the High Purity Water Wetland and/or Slab Cabin Run, the total volume of water, date and time of the recycling shall be recorded and included with the standard monthly reporting submissions required by this permit.
• The permittee shall not use reclaimed water for any Class A+ uses as identified in the Reuse of Treated Wastewater Guidance Manual (362-0300-009, DRAFT January 10, 2009). The use of reclaimed water for Class A+ uses must first be approved by a permit amendment to include Class A+ parameters, treatment standards and monitoring frequencies.
• This permit approves offsets for TN and TP for use in permits PA0234028 and PA0026239. One permitted facility may provide an offset to the other permitted facility based on treatment performance. The monthly offset shall be reported as pounds offset for that month on the DMR Supplemental form for Nitrogen and Phosphorous. For the permitted facility giving an offset to the other permitted facility, the offset will be reported as a negative value. For the permitted facility receiving the offset, the offset will be reported as a positive value. The offsets described in this paragraph are not to be considered permanent and may vary month to month. These offsets shall not be used to adjust the nutrient cap loads in future permits.
