STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

PUBLIC WATER SUPPLY (PWS) PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

 Persons wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

 Following the comment period, the Department will make a final determination regarding the proposed permit. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. OPERATE WASTE PROCESSING OR DISPOSAL AREA OR SITE


Application Received Under the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101—4000.1904) and Regulations to Operate Solid Waste Processing or Disposal Area or Site.

Southeast Region: Regional Solid Waste Manager, 2 East Main Street, Norristown, PA 19401

Permit Application No. 101494. Waste Management of Pennsylvania Inc., 1000 New Ford Mill Road, Morrisville PA 19067. This application for minor permit modification seeks approval to revise the landfill bench and interceptor channel lining design at the Tullytown Resource Recovery Facility Landfill located in the Borough of Tullytown and Falls Township, Bucks County. The application was received by the Southeast Regional Office on April 13, 2012.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

(431 Yerkes Road, King of Prussia, PA 19406-3523) for installation of three (3) heat-set web offset presses and a control device at an existing facility in Upper Merion Township, Montgomery County. This facility is a synthetic minor facility for VOC emissions. The facility wide VOC emissions will stay below 25 tons per year. The VOC emissions from the three (3) presses will be directed to a regenerative thermal oxidizer. The regenerative thermal oxidizer will be required to maintain 98% destruction and removal efficiency. The Plan Approval will contain testing, monitoring and recordkeeping requirements and operating restrictions designed to keep the sources and facility operating within all applicable air quality requirements.

18-00026D: First Quality Products, Inc. (Clinton County Industrial Park, 121 North Road, McElhatten, PA 17748-0270) for construction of two (2) Curt G. Joa underpad machines (Line 35 and 36) in Wayne Township, Clinton County.

 The total combined emissions from both Curt G. Joa underpad machines will not exceed 0.02 ton of PM, including PM10 and 2.15 tons of VOCs per year. The Department's review of the information contained in the application submitted by First Quality Products, Inc. indicates that the sources and the air-cleaning devices will comply with all applicable air quality requirements pertaining to air contamination sources and the emission of air contaminants, including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the PM emission limitation of 25 Pa. Code § 123.13, the visible emission limitation of 25 Pa. Code § 123.41.

 Based on this finding, the Department proposes to issue a plan approval for the proposed construction. In addition to the emission limitations, the following includes the types of conditions the Department intends to place in the plan approval to ensure compliance with all applicable regulatory requirements including the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12.

 Emission and material usage restrictions to limit the emission of PM10 and VOCs.

 Control of PM, including PM10 emissions from each underpad machine by installation of its own separate four-stage filter system.

 Work practice requirements to install and operate the source and control device with good air pollution control practices.

 Recordkeeping and reporting requirements to verify compliance with the emission limitations and all permitting requirements.

 A copy of the plan approval application is available for public review between 8 a.m. and 4 p.m. at the Department's Northcentral Regional Office.  In accordance with 25 Pa. Code §§ 127.44—127.46 the Department of Environmental Protection (DEP) intends to issue Air Quality Plan Approval: PA-11-00423A to allow the replacement of the existing uncontrolled manual cleaning house with a new manual cleaning house that includes a wet scrubber, rated at 60,000 ACFM at the Steel Wire Processing Plant in Johnstown Township, Cambria County.

 Potential emissions from the facility are estimated to be 17.99 tons of NOx, 15.1 tons of CO, 1.0 tons of VOC, 1.4 tons of PM10, 1.4 tons of PM2.5, and 2.0 tons of HAPs per year. Plan Approval has been conditioned to ensure compliance with all applicable regulatory requirements. Applicable state requirements include 25 Pa. Code § 127.1 requirements for new sources shall control the emissions of air pollutants to the maximum extent, consistent with Best Available Technology as determined by the Department as of the issuance of the plan approval for the new source as well as appropriate monitoring, maintenance, and record keeping. This is a Title V facility. The public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. This plan approval will, in accordance with 25 Pa. Code § 127.450 or § 127.505, be incorporated into the Title V operating permit at a later date.

 This modification will not result in any emission increase. This Plan Approval will contain recordkeeping, work practice standard, and additional requirement conditions, which will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate BAT for the source including, but are not limited to, the following:

 • All conditions from the Title V operating permit 24-00123 issued on December 13, 2010, remain in effect unless modified in this plan approval.

 • A completed plan approval application shall be submitted no later than December 31, 2013, which correlates to when the facility should achieve greater than 80% of the permitted flare capacity of 16,500 cfm (>13,200 cfm). However, if the calculated LFG generation rate is less than 80% of the permitted flare capacity, then the submittal date maybe extended by one year. [This condition replaces Plan approval # 24-123F, Condition # 001(b)]

 • The facility shall have in place approved additional control device(s) prior to the landfill exceeding its currently permitted flare capacity of 16,500 cfm. Currently this projected compliance date is December 31, 2016. However, this may be revised upon submittal of calculated LFG generation rates based on actual waste acceptance which indicate a different compliance date. [This condition replaces Plan approval # 24-123F, Condition # 001(c)]

 • In accordance with 40 CFR Part 60.753(c), alternative compliance requirements are allowed for specific categories of gas extraction wells as noted below:

  • Alternative 1: Wells in uncapped areas and leachate collection piping used for gas extraction may be operated at an oxygen level as high as 15 percent (volumetric basis), since the majority of the air intrusion occurs directly from the ground surface and not through the waste mass. Documentation of extraction point readings shall be performed as required to insure that the higher operating value does not cause an adverse reaction or combustion within the waste mass, and that degradation of the anaerobic decomposition process is not occurring. In the event that monitoring data for an Alternative 1 well indicates temperatures above 55°C (131°F), the well will be shut down. If the temperature does not subside to an acceptable level within 5 days, carbon monoxide monitoring (to ensure a carbon monoxide level below 100 ppmv) will be conducted to verify that combustion within the waste mass is not occurring.

  • Alternative 2: A well may be placed on an inactive list if it exhibits a methane quality that is consistently below 40 percent by volume and an oxygen level that is consistently above 5 percent while the throttle is either closed or slightly open with a negative pressure applied to the well of less than one-inch of water column. During the period of inactivity and while on the inactive list, the well will be exempt from oxygen concentration and negative pressure requirements. If at any time the landfill observes conditions that warrant the operation of a well on the inactive list, the well shall be reactivated and normal default operational standards shall apply.

  • Alternative 3: A well in an area of active waste placement that is inaccessible due to its casing height (generally having a casing height of five feet or greater) may be temporarily placed on the inactive list, whereby the well would be exempt from wellhead monitoring requirements until landfilling around the well allows for safe access.

  • Alternative 4: A well may be operated at temperatures higher than 55°C (131°F), provided the following steps are taken:

   o Upon observation of a well temperature greater than 55°C (131°F), the initial course of action shall be to adjust the valve to either reduce or eliminate the vacuum applied to the well. This corrective action shall be taken within 5 days of the observation of an elevated reading.

   o If the reduction of vacuum favorably lowers the temperature but appears to be detrimental to gas collection, the operator shall adjust the well to the benefit of gas collection. If, as a result, the temperature climbs above 55°C (131°F), or if the temperature remained elevated throughout the well adjustments, carbon monoxide monitoring (to ensure carbon monoxide levels below 100 ppmv) will be conducted to verify that combustion within the waste mass is not occurring. In addition to measuring the temperature and carbon monoxide levels, the operator shall visually inspect the area around the well for signs of settlement or distressed vegetation, and shall inspect the wellhead for soot or other indications of combustion.

   o If the elevated temperatures persist at a well, and there are no signs of combustion or detrimental effects on anaerobic activity, the operator shall consider the well to be an Alternative 4 well and shall place the well under a period of observation. The observation period shall be characterized by the inclusion of carbon monoxide monitoring with the regular monthly monitoring events. This monitoring is in addition to the regular measurement of gauge pressure, temperature, and oxygen or nitrogen levels. Visual inspection of the wellhead and the area immediately surrounding the well will also be conducted.

   o At such time when the landfill has acquired sufficient background data, a new maximum operating temperature shall be selected for the well. The new temperature and supporting data shall be provided to PADEP and USEPA through a notification letter. If no objections are received from the regulatory agencies within 15 days of the letter submittal date, the landfill may conclude that the alternative temperature is acceptable. At that time, routine carbon monoxide monitoring of the well will be discontinued. However, visual inspection of the wellhead and the area immediately surrounding the well shall be included with the regular monthly monitoring events throughout the entire period of time that a well is operated under Alternative 4.

 In accordance with 25 Pa. Code § 127.44(f)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP office (Air Quality). Appointments for scheduling a review must be made by calling the DEP at (814) 332-6340.

 In accordance with 25 Pa. Code § 127.44(f)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments.  Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapter 77 are as follows:

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
