FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

To construct and maintain a road crossing of a tributary to Tinker Creek (HQ-CWF) consisting of twin 25-foot long, 6`-4" by 4`-9" aluminized steel corrugated metal pipe arch culverts depressed 6-inches below streambed elevation; to construct and maintain two intake structures in Tinker creek, the first consisting of a 15-inch diameter SLCPP culvert and concrete headwall, and the second consisting of an 18-inch diameter SLCPP culvert and concrete headwall; and to construct and maintain two outfall structures in Tinker Creek, the first consisting of a 24-inch diameter SLCPP culvert, a flared end section and R-4 rip rap outlet protection, and the second consisting of a 24-inch diameter SLCPP, flared end section and a R-5 rip rap outlet protection. The project will permanently impact a de minimus area of wetlands (EV) equal to 0.05 acre and will temporarily impact an additional 0.05 acre of wetlands. To construct and maintain various water obstructions and encroachments associated with the Pike County portion of the Tennessee Gas Pipeline Northeast Upgrade Project, Loops 321 and 323, including fifty-eight (58) wetland crossings and thirty-one (31) stream crossings associated with the pipeline and access roads, temporarily impacting 10.53 acres of wetlands and approximately 1077 feet of stream channel. The water obstructions and encroachments are shown in the attached tables.
The project begins approximately 1.25 miles northeast of the intersection of Tinkwig Drive and Rimrock Circle (Narrowsburg, NY-PA Quadrangle Lat: 41° 30` 46.45"; Long: -75° 03` 48.4") in Lackawaxen Township and ends on the southeast side of State Route 0209 approximately 1.00 mile from its intersection with Cummins Hill Road (Port Jervis South, NY-NJ-PA Quadrangle Lat: 41° 20` 45.7"; Long: -74° 44` 39.68") in Milford Township, Westfall Township and Lackawaxen Township, Pike County. To construct and maintain various water obstructions and encroachments associated with the Wayne County portion of the Tennessee Gas Pipeline Northeast Upgrade Project, Loop 321, including twenty-seven (27) wetland crossings and sixteen (16) stream crossings associated with the pipeline and access roads, temporarily impacting 9.77 acres of wetlands and approximately 363 feet of stream channel. The water obstructions and encroachments are shown in the attached tables.
The project begins at the intersection of Adams Pond Road and State Route 2011 (White Mills, PA Quadrangle Lat: 41°33`43.63"; Long: -75°11`13.86") in Berlin Township and ends on the east side of Mushpaw Road approximately 3.5 miles from the intersection of Crickett Hill Road (White Mills, PA Quadrangle Lat: 41°30`46.458"; Long: -75°03`48.4") in Palmyra Township, Wayne County. (Subbasin: 1B)
