PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

Plan Description: The Plan contains a description of the historic hydraulic overload conditions that occurred at the Township's Hillside Road Pumping Station (HRPS) between its construction in 1985 through and including 2004. Additionally, the Plan contained the steps taken by the Township, the now defunct General Municipal Authority of Jackson Township (GMAJT) and the neighboring Dallas Area Municipal Authority (DAMA) to correct the hydraulic overload at the HRPS that was identified by DAMA and the Department in 2004. This included the institution of a sewer connection prohibition for all connections upstream of the HRPS.

 The information and analysis found in the Plan also concluded that the Hillside Road Pumping Station, as originally constructed, was not constructed according to the approved design drawings and specifications. An analysis of the available capacity for the station's wet-well and discharge force main concluded that both lacked the capacity needed to adequately convey wet-weather wastewater flows that were significantly higher than the station's dry-weather wastewater flows. As a result, overflows of untreated wastewater occurred numerous times through calendar year 2004 during wet-weather periods.

 In 2005 the existing HRPS was replaced with a new pumping station at the same location and an enlarged force main. Subsequent flow monitoring of the new station has revealed that it appears to have sufficient capacity to adequately convey the wet-weather wastewater flows that it receives from its tributary collection system without becoming hydraulically overloaded. Based on this conclusion and the flow monitoring information and analysis found in the Plan, the Department concurs with the Plan's recommendation that the sewer connection prohibition for the HRPS service area can now be lifted.

Plan Description: The approved plan provides for sewers to serve 250 homes in Woodward and Gulich Townships. The new gravity sewer system and one new pump station will collect and transport the sewage from 73 homes to the existing Houtzdale sewage treatment plant and 177 homes to the Woodward Township sewage treatment plant for treatment. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

Plan Description: The planning module for the Weise Estate Subdivision, DEP Code Nos. A3-06929-064-1 (District) and A3-06952-103-1 (Pike), APS Id 766678, consisting of a three lot residential subdivision of a 37.46 acre tract using individual on lot sewage disposal systems is disapproved. The proposed development is located on the north and south sides of Merkle Road, east of Goat Hill Road in District and Pike Townships. This plan is disapproved because the stream impact analysis did not use the correct locations of the proposed on lot sewage disposal systems and the topographic features on the plot plan are inconsistent with the Department's field verified conditions and the USGS Quadrangle map. For these reasons, the stream impact analysis incorrectly determined the point of compliance and incorrectly plotted the plumes from the proposed systems. The Department's analysis indicates that there will be an impact on the Exceptional Value waters of Oysterville Creek.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Former McCrory Store, 609 Main Street, Honesdale Borough, Wayne County. Martin Gilgallon, Pennsylvania Tectonics, Inc. has submitted a Final Report (on behalf of his client, R & K Real Estate Holdings, LLC, 469 Ridge Avenue, Hawley, PA 18428), concerning the remediation of soil and groundwater found to have been impacted by No. 2 fuel oil as a result of a release from an unregulated underground storage tank. The report was submitted to document attainment of the Residential Statewide Health Standard for soil and groundwater. A public notice regarding the submission of the Final Report was published in the Wayne Independent on December 13, 2011.

Vottero Residence, 214 South 23rd Street, Allentown City, Lehigh County. Christopher Jacangelo, J. Rockwood & Associates, Inc., P. O. Box 1006, Easton, PA 18044 has submitted a Final Report (on behalf of his client, Diane Vottero, 214 South 23rd Street, Allentown, PA 18104), concerning the remediation of soil found to have been impacted by No. 2 fuel oil as a result of a release from a pitted and corrosive steel underground storage tank, which was observed during the tank's removal process. The report was submitted to document attainment of the Residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in The Express Times on December 14, 2011.

Former Wilkes-Barre Water Street MGP Site, City of Wilkes-Barre, Luzerne County. John Roberts, Stantec Consulting Services, Inc., 400 Dais Drive, Suite 400, Plymouth Meeting, PA 19462 has submitted a Final Report (on behalf of his client, UGI Penn Natural Gas, Inc., P. O. Box 12677, Reading, PA 19612-2677), concerning the remediation of site soils and groundwater found to have been impacted by manufactured gas plant constituents due to historical operations from a former manufactured gas plant. The report was submitted to document attainment of the Site-Specific Standard for soil and groundwater and the Statewide Health Standard for soil and groundwater. A public notice regarding the submission of the Final Report was published in The Times Leader on December 15, 2011.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

This plan approval modifies Plan Approval No. 23-0108B. The cocoa processing facility is in Eddystone Borough, Delaware County. This facility is a non-Title V facility. The regenerative thermal oxidizer reduces VOC emissions by 98 percent or to a maximum concentration of 7 ppm, as propane. The facility will continue to utilize various cyclones and a mist eliminator to control emissions of PM from the facility. The Plan Approval will contain monitoring, recordkeeping, and operating conditions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

09-0007F: Waste Management Disposal Services of Pennsylvania, Inc.—WMDSPI (1000 New Ford Mill Road, Morrisville, PA 19067) on December 29, 2011, to install two (2) propane fired crystallizers of 3 MMBtu/hr and 5 MMBtu/hr rated capacity at the Geological Reclamation Operations and Waste Systems (GROWS) in Falls Township, Bucks County. The crystallizers will be used within a new and upgraded leachate treatment system at the facility. The GROWS landfill is a Title V facility. The crystallizer installation is subject to the emissions offset requirements of 25 Pa. Code Chapter 127, Subchapter E (relating to nonattainment new source review). Emissions that are required to be offset are: 34.0 tons of NOx and 25.9 tons of VOC. WMDSPI will use VOC ERCs to offset net increases of NOx and VOC, at the offset ratio of 1:1.3, in accordance with 25 Pa. Code § 127.210. An additional ratio of 1:1.3, as approved by the Environmental Protection Agency (EPA), is applied for substitution of NOx ERCs by VOC ERCs. A total of 91.2 tons of VOC ERCs are authorized for use for this project. The owner shall meet the use and transfer requirements of 25 Pa. Code § 127.208 for the VOC ERCs.

46-0124A: Montgomery Chemicals, LLC (901 Conshohocken Road, Conshohocken, PA 19428) on December 29, 2011, for addition of a scrubber system and the permitting of an existing facility to produce sodium borohydride in Upper Hanover Township, Montgomery County. This facility is subject to 40 C.F.R. Part 63, Subparts EEEE and FFFF for the parts of the facility that synthesize methanol for use as an intermediate. The facility is also subject to 40 C.F.R. Part 60, Subparts VV and NNN for the methanol producing areas of the facility, but the requirements of 40 C.F.R. supersede these requirements. The methanol emissions from the facility after control with the new scrubber system and the addition of an equipment leak detection and repair program were estimated to be 32.2 tons per year with production limits for the facility that are included in the language of the plan approval.

46-0037AB: Cabot Supermetals (County Line Road, P. O. Box 1608, Boyertown, PA 19512-1608) on December 30, 2011, to install a RotoClone wet dust collector to replace a dry dust collector to replace an existing dry dust collector at their Boyertown facility in Douglass and Colebrookdale Townships, Montgomery and Berks Counties. The replacement of dust collector is to eliminate fire hazard. This facility is a Title V facility. The installation will result in particulate matter emission increase by 0.15 tons per year. The Plan Approval and Operating Permit will contain recordkeeping requirements and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 The proposed action/activity is located in Marysville Borough, Perry County.

 Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Marysville Borough proposes to separate 17,000 feet of combined sewers and eliminate two combined sewer overflow discharges to the Susquehanna River. The Department's review of the project concluded that the project is eligible to be categorically excluded from the environmental review process, and a subsequent public review confirmed that there are no exceptional circumstances that warrant an Environmental Assessment.
