COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law (35 P. S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, state or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

 To perform the following water obstruction and encroachment activities associated Bridgeton Hill Road project over the Delaware Canal (WWF):

 1. To remove the existing bridge and to construct and maintain, in its place, a 34-foot long, 51-foot span prestressed concrete adjacent box beam bridge. The proposed bridge will have an approximate underclearance of 5`-6".

 2. To install and maintain a temporary cofferdam.

 3. To install and maintain a 47-foot long temporary pedestrian crossing of coarse aggregate in the dry canal.

 The site is located approximately 570 feet southwest of the intersection of Bridgeton Hill Road and River Road (S.R. 0032) in Bridgeton Township, Bucks County (Frenchtown, NJ-PA USGS Quadrangle N: 11.99; W:14.40).

 E15-252. 1515 Arch Street, City of Philadelphia, Philadelphia County. ACOE Philadelphia District.

 To perform the following water obstruction and encroachment activities associated with the construction of approximately 2.5 miles of the Baxter walking trail, a segment of Delaware River Heritage Trail, approximately 10 to 14 feet wide, extending from the proposed bridge over the Pennypack Creek to the Pleasant Hill Park:

 1. To construct and maintain 13-foot 8-inches long, 180-foot span single span truss bridge across the Pennypack Creek (WWF). The bridge will have an underclearance of approximately 2.97 feet.

 2. To construct and maintain approximately 1,658 linear feet of asphalt trail in the floodplain of the Pennypack Creek.

 3. To construct and maintain approximately 1,843 linear feet of asphalt trail in the floodplain of the Delaware River.

 The project permanently impacts approximately 32 linear feet of stream. The jurisdictional area of the project commences within the floodway near the Pennypack Avenue and runs in the southwesterly direction parallel to the shoreline of the Delaware River for approximately 2,273 feet and terminates at the proposed bridge in the City and County of Philadelphia (Frankford, PA USGS Quadrangle N: 5.92; W:0.96).

 To construct and maintain a temporary utility bridge across Tobys Creek consisting of a single steel beam spanning bank to bank and to construct and maintain a temporary water line crossing of Tobys Creek attached to the utility bridge consisting of a 4-inch diameter PVC conduit housing 1-inch diameter polypropylene tubing and a 3/8-inch diameter air line. The project is located on the north side of S.R. 0415 (Memorial Highway) approximately 300 feet west of its intersection with Machell Avenue (Kingston, PA Quadrangle, Latitude: 41°20`11.3"; Longitude: -75°57`54.2").

 E35-438. City of Scranton, 101 West Poplar Street, Scranton, PA 18508, in City of Scranton, Lackawanna County, U.S. Army Corps of Engineers, Baltimore District.

 To remove the existing structure and to construct and maintain a concrete arch bridge having a 36-foot span and an approximate underclearance of 13.7 feet approximately 100 feet across Leggetts Creek and to construct and maintain two 18-inch reinforced concrete stormwater outfalls in the floodway of Leggetts Creek (TSF). This project was previously authorized by Permit No. E35-371 which expired prior to commencement of construction. The projected is on Rockwell Avenue approximately 0.1 mile northeast of West Market Street (Scranton, PA Quadrangle, Latitude: 41°26`33.6"; Longitude: -75°39` 32.8").

 1) 100.0 linear feet of chain-link fence in the floodway of an unnamed tributary to South Fork Big Beaver Creek (TSF, MF); 2) 820.0 linear feet of chain-link fence; 3) 345.0 square feet of concrete sidewalk; 4) 7,400.0 square feet of asphalt paving; 5) two new sequencing batch reactor tanks; 6) a 300.0-square foot blower pad; 7) a 200.0-square foot chemical/electrical building; 8) 450.0 linear feet of yard piping/electrical line; 9) 90.0 feet of an 8.0-inch PVC sanitary sewer line; 10) a temporary riprap rock construction entrance; and 11) a temporary soil stockpile, all in the floodplains of South Fork Big Beaver Creek (TSF, MF) and an unnamed tributary to South Fork Big Beaver Creek (TSF, MF), all for the purpose of complying with the annual nutrient cap loads of the Authority's NPDES discharge permit. No wetlands will be impacted by this project.

 E36-898: Edward J. Arnold, Borough of Millers- ville, Creek Drive Pump Station, 100 Municipal Drive, Millersville, PA 17551, in Millersville Borough, Lancas- ter County, ACOE Baltimore District

 To remove the existing wet well and construct and maintain: 1) a 9.0-foot by 13.0-foot, 15.5-foot deep wet well; 2) a valve vault; 3) a 10.0-foot by 12.0-foot addition to the existing generator building; and 4) paving a 8.0-foot wide walking path and the relocation of existing utility pole in the floodway and floodplain of Conestoga River (WWF, MF) and in the floodway and floodplain of an unnamed tributary to Conestoga River (WWF, MF). The project is located at the existing Creek Drive Pump Station (Conestoga, PA Quadrangle; N: 22.04 inches, W: 13.38 inches; Latitude: 39°59`47", Longitude: -76°20`44") in the Borough of Millersville, Lancaster County. The purpose of the project is to ''flood-proof'' the existing pump station and resolve capacity and deteriorating condition issues.

The projects eastern terminus is located within State Game Lands No. 14 along the southwestern right-of-way of Forest Road approximately 1.84-miles west of Hicks Run Road and Forest Road intersection.

 E14-546. Stone Ridge Mountain Group, LLC, 698 Moose Run Road, Bellefonte, PA 16823. Steele Hollow, in Houston Township, Centre County, ACOE Baltimore District (Port Matilda, PA Quadrangle 40°51`19.32" N, 78°01`2.28" W).

 To construct and maintain: 1) a 10-foot wide by 30-foot long temporary ford 10 feet downstream of, 2) a new 16-foot wide by 45-foot long steel and wood bridge with a minimum underclearance of 30 inches and a minimum clear span of 30 feet over Steele Hollow Creek to access a hunting property located 1.7 miles north on Steele Hollow Road from SR 220. This project proposes to temporarily impact 15 linear feet of stream and permanently impact 20 linear feet of Steel Hollow Run, which is classified as a Cold Water Fishery.

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
