NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The asphalt plant is controlled by a primary and secondary baghouse. Water spray is used to minimize fugitive emissions from the mineral processing. The potential emissions based on the restriction of 460,000 tons of asphalt and 500 hours of operation per year for the mineral processing is as follows: 29.5 TPY NOx; 20.76 TPY SOx; 73.2 TPY PM10; and, 92.5 TPY CO. The renewal permit contains emission restrictions, record- keeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

The facility has taken an elective restriction of 5,850 tons of coal on a consecutive 12-month basis and a sulfur limit of 1.0% on a consecutive 12-month basis. The quantity of #2 fuel oil is limited to 210,000 gallons per year based on a consecutive 12-month basis. The natural gas usage is limited to 650 mmcf/yr based on a consecutive 12-month period. The facility is required to keep records of the fuel usages and sulfur content. With the given restrictions, the status of the facility operating permit is a Synthetic Minor. The boilers are subject to 40 CFR 63, Subpart JJJJJJ pertaining to NESHAPs for ICI boilers at area sources. The potential emissions from the facility with the given restrictions are as follows: 20.8 TPY PM10; 63.8 TPY NOx; 89.4 TPYSO2; 61.2 TPY CO; and 5.7 TPY VOC.

Public Comment Period and Public Hearing Concerning Draft NPDES Permit for Exelon Generation Company, LLC, Limerick Generating Station Summary: The Pennsylvania Department of Environmental Protection (PADEP) is accepting comments on the National Pollutant Discharge Elimination System Permit (NPDES) Permit renewal application filed with the Department by Exelon Generation Company, LLC (Exelon Generation) for its Limerick Generating Station (LGS) located in Limerick, Pennsylvania. The draft permit was published in the 12/10/2011 Pennsylvania Bulletin. PADEP is accepting public comments regarding draft NPDES Permit No. PA0051926 for the LGS facility until 5:00 p.m. on October 27, 2012. The draft NPDES Permit regulates the discharge of noncontact cooling water, boiler blow down, treated process wastewater and storm water to the Schuylkill River and Possum Hollow Run through various outfalls.
The Department will hold a joint public hearing with the Delaware River Basin Commission (DRBC) regarding proposed agency actions for this proposal on August 28, 2012.
Prior to the hearing, the NPDES permit renewal application and related documents, and draft Permit No. PA0051926 can be reviewed by making an appointment with PADEP's Records Management Section at 484.250.5910. The above documents are also available at the following locations in Montgomery and Chester counties: Limerick Township, 646 West Ridge Pike, Limerick, PA 19468; and East Coventry Township, 855 Ellis Woods Road, Pottstown, PA 19465.
Hearing Information: The public hearing will take place on Tuesday, August 28, 2012 at the Sunny Brook Ballroom, 50 Sunny Brook Road, Pottstown, PA 19464 from 6:00 p.m. until 9:00 p.m. Prior to the hearing, an information session will be held at the same location from 4:30 p.m. until 5:30 p.m. Written comments will also be accepted prior to the hearing, at the hearing and until 5:00 p.m. on October 27, 2012.
The sole purpose of the hearing is to provide members of the public with an opportunity to present oral testimony on the proposed Exelon Generation Company, LLC, Limerick Generating Station Draft NPDES permit. In order to give everyone who wishes to testify the opportunity to do so at the public hearing, the following procedures will be in effect:
Everyone must register to testify. Registrations to present oral testimony will begin at approximately 4:30 p.m. on the day of the hearing and will continue until the hearing is closed. There will be no advance registration. Speakers will be called in roughly, but not exactly, the order in which they registered.
Testimony will be limited to 3 minutes. To allow everyone who wishes to speak an opportunity to do so, oral testimony will be limited to three minutes. Speakers will not be permitted to cede their time to others; however, after everyone who wishes to speak has had a chance to do so, the hearing officer may accept requests to supplement earlier remarks. A court stenographer will capture all verbal comments for the public record. Individuals who have prepared written testimony are asked to summarize their comments during the three-minute period for oral testimony and to submit their complete written comments either at the hearing or via email, fax, US mail, delivery service, or hand delivery before 5:00 p.m. on October 27, 2012.
