FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

The Cobbs Creek Watershed Improvement Project is located at the confluence of the East and West branches of Indian Creek (WWF, MF). Flow of the West Branch will be diverted from an existing culvert to a created natural stream channel. Bank stabilization, restoration of a riparian buffer and debris removal will be conducted. A combined sewer outfall (CSO) will be directed to a temporary storage created from the existing culvert. Specific water obstruction and encroachment activities consist of:
1) To create and maintain approximately 1,300 linear feet of stream channel with an approximate width of 40 feet to convey the West Branch. This work includes creation of forested riparian buffers, habitat improvement measures and temporary access roads in and along the new channel.
2) To remove approximately 700 linear feet of the existing brick culvert.
3) To reconstruct and maintain the existing CSO outfall structure within the footprint of the existing brick culvert to serve as temporary storage for CSO discharges.
4) To stabilize and maintain the channel and banks of the existing branches. All disturbed areas will be stabilized and replanted with native plants.
The site is located approximately 1,000 feet northeast of the intersection of Haverford Avenue and Lansdowne Avenue (Lansdowne, PA USGS Quadrangle N: 18.01 inches; W: 1.52 inches).

To construct and maintain: 1) a rock armored screened water intake, 2) 175 feet of 12-inch buried pipe and 3) a 54-inch diameter overshot metal water wheel and associated riprap apron next to a wetland overflow area, 4) to run an air compressor with tank in the left 100-year floodplain of Fishing Creek. The water wheel will generate compressed air to power the well pump and water supply to an Amish chicken house. Electricity will not be generated with this system. All water will be returned to Fishing Creek after flowing through the water wheel system. This project proposes to impact 10 linear of Fishing Creek, which is classified as High Quality, and no direct impacts to riparian wetlands.

Applicant is proposing to place and maintain fill in 0.10 acre of wetlands, and temporarily impact 0.072 acre of wetlands in the Two Lick Creek watershed (CWF) for the purpose of constructing a rail line associated with a new Flue Gas Desulfurization system. The project is located in Center Township, Indiana County, PA (Indiana, PA quadrangle, N 1.75", W 10.75"; latitude 40° 30` 53.4", longitude -79° 11` 58.9"). For mitigation, the applicant proposes to construct an off-site PEM wetland mitigation area along an unnamed tributary to Cherry Run (CWF) to include 0.52 acre of PEM wetlands (Indiana, PA Quadrangle, N 5.87", W 11.25"; latitude 40° 31` 54.9", longitude -79° 12` 13"). The previous permit, issued on February 1, 2012, and amended on May 7, 2012, authorized the placement of fill in 0.169 acre of wetlands in the Blacklick Creek, Muddy Creek, and Two Lick Creek Basins (CWF) for the purpose of expanding a waste disposal area, and constructing a storm water management pond for a new Flue Gas Desulfurization system. In addition, the construction of a concrete lined diversion channel (DC-37) and the placement of fill from leachate pond L-1 within the floodway of an unnamed tributary to Blacklick Creek (CWF) (D.A.<100 acres) was authorized. The project is located in Blacklick and Center Townships, Indiana County (Indiana, Pa Quadrangle North 4.7", West 12.0"; Latitude 40 31` 12" Longitude 79 12` 39"). To mitigate for these impacts, a 0.169 acre wetland replacement site was constructed off-site along an unnamed tributary to Cherry Run (CWF).
