NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. The wastewater will be conveyed by individual grinder pumps and small diameter pressure sewer. The remaining areas of the township will continue to be served by on-lot systems with those malfunctions identified in the Plan being corrected by repair or replacement at the expense of the property owner. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

New Wilmington PA 16142Mercer Plan Description: The approved plan provides for existing and future sewage needs in New Wilmington Borough as well as portions of Wilmington Townships (Mercer County and Lawrence County). The existing Sewage Treatment Plant (STP) is experiencing mechanical and operational issues with peak month hydraulic and organic loading nearing design capacity. The STP upgrades proposed in this project include the following: adding an influent pump station combined with screening and grit removal, a sludge storage building, a lab/control building, a new gravity interceptor sewer to the proposed influent pump station wet well, adding an additional clarigester, a dual tower trickling filter system, trickling filter pumping system, dual circular clarifiers, UV disinfection, sludge dewatering system, new sludge press, and a sludge drying bed. Replacing the existing trickling filter/rotating biological contactor STP with an upgraded trickling filter system, combined with an increase in hydraulic loading from 0.564 MGD to 0.780 MGD, the proposed changes will serve the municipalities for the next 20 years. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of New Wilmington Borough.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A public notice regarding the submission of the Final Report was to have been published in The Abington Times on July 11, 2012.

The report was submitted to document attainment of the residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in The Express Times on March 26, 2012.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The report documented attainment of the Residential Statewide Health Standard for soil and was approved on July 12, 2012.
Schatzel Property, 543 R. Main Street, Weatherly Borough, Carbon County. Jeremy Bolyn, Environmental Maintenance Co., Inc., 1420 East Mermaid Lane, Glenside, PA 19038 submitted a Final Report on behalf of his client, Jessica Schatzel, 102-08 164 Drive, Hamilton Beach, NY 11414, concerning the remediation of soil found to have been impacted by No. 2 fuel oil as a result of a release from a leaking, corroded feed-line from an aboveground storage tank. The report documented attainment of the Residential Statewide Health Standard for soil and was approved on July 10, 2012.
Eastern Industries-Old Getty Pipeline Site, Martins Creek-Belvidere Road, Lower Mount Bethel Township, Northampton County. Robert P. Weaver, SAIC Energy, Environment, & Infrastructure, LLC, 6310 Allentown Boulevard, Harrisburg, PA 17112 submitted a Final Report on behalf of his client, Stabler Development Company, 4401 Camp Meeting Road, Suite 200, Center Valley, PA 18034, concerning the remediation of soil found to be impacted by an alleged historic release of petroleum (kerosene or diesel) from a former pipeline located on the north side of Martins Creek-Belvidere Road. The report documented attainment of the Residential Statewide Health Standard for soil and was approved on July 17, 2012.
A & M Hibbard 1H/3H Well Site, State Route 29, Dimock Township, Susquehanna County. James Pinta and David Testa, URS Corporation, 501 Holiday Drive, Foster Plaza 4, Suite 300, Pittsburgh, PA 15220 submitted a Final Report on behalf of their client, Cabot Oil & Gas Corporation, 5 Penn Center West, Suite 401, Pittsburgh, PA 15276, concerning the remediation of soil found to have been impacted by VOCs, SVOCs, metals, and ethylene glycol due to a release from the reserve pit and a release from the mud shelf. The report documented attainment of the Residential Statewide Health Standard and the Background Standard for soil and was approved on July 17, 2012.
Slifer Residence, 238 Main Street, Walnutport Borough, Northampton County. Richard Trimpi and Janine Jacobs submitted a Final Report on behalf of their client, Dustin Slifer, 248 Main Street, Walnutport, PA 18088, concerning the remediation of soil found to have been impacted by No. 2 fuel oil as a result of a vehicular collision which caused a crack in the fuel oil supply line at the base of the above ground storage tank. The report documented attainment of the residential Statewide Health Standard for soil and was approved on July 23, 2012.

Groundwater Sciences Corporation, 2601 Market Place Street, Suite 310, Harrisburg, PA 17110-9307, on behalf of Harley Davidson Motor Company, 1425 Eden Road, York, PA 17402, submitted a Risk Assessment Report concerning remediation of site soils contaminated with VOCs, PAHs, Chlorinated Solvents and Inorganics. The report is intended to document remediation of the site to meet a combination of Statewide Health (Residential and Non-Residential) and Site-Specific standards. The Report was approved by the Department on July 10, 2012. Groundwater will be addressed in a separate report.

Since the TVOP was last renewed in 2005, no physical changes have occurred at the facility (though storage tank #5 has been inactive for approximately 20 years and will not be listed as a source in the renewed TVOP). However, since this time, all of the gasoline storage tanks at the facility have become subject to the requirements of 40 C.F.R. Part 63, Subpart BBBBBB. All applicable requirements of this regulation will be included in the renewed TVOP.
The facility is not subject to the Compliance Assurance Monitoring (''CAM'') requirements of 40 CFR Part 64.
The TVOP will continue to include all other monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

• The addition of a screen to the facility's reclaimed asphalt pavement (''RAP'') plant, as well as the modification of how the RAP is delivered from the RAP plant to the batch HMA plant, as approved under Request for Determination No. 2752.
• The owner of the facility has changed from Miller & Son Paving, Inc., to Naceville Materials, Inc.
The facility's air emissions sources consist of a stone crushing plant and the aforementioned RAP and batch HMA plants. The potential to emit nitrogen oxides (''NOx'') and volatile organic compounds (''VOCs'') from the batch HMA plant/facility each exceed 25 tons per year; however, Miller Materials has elected to restrict the HMA production for the batch HMA plant such that the NOx and VOC emissions from the facility will each not exceed 24.9 tons per year.
The SOOP will continue to include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

Emissions from the induction furnaces and the machine shop are controlled by baghouses. Potential emissions from this facility are 34 tpy PM10; 0.1 tpy VOC; 1 tpy SOx; 3 tpy NOx; 2 tpy CO; and 0.03 tpy total HAPs. The facility operates an air separation plant including an oxygen vaporizer with two natural gas burners, each rated at 26 mmbtu/hr, a mole sieve regenerator with a natural gas burner rated at 2.25 mmbtu/hr, three Ajax boilers (each rated at 9.5 mmbtu/hr) for heating the liquid nitrogen, and a parts washer. The Jeffers pipeline project consists of constructing, operating, and maintaining a 0.5 mile section of 8" and 1.3 miles of 10" steel gas gathering lines in Lenox Township, Susquehanna County. The pipeline will be constructed from the Jeffers well pad within a 50` permanent right-of-way (75` temporary ROW) and convey natural gas to the Zick pipeline. The project will impact 359 lineal feet of temporary stream impacts, temporarily impacting 0.29 acre of wetlands, and permanently impacting 0.27 acre of wetlands. All for the purpose of conveyance of natural gas from the Marcellus Shale formation to market.

Presque Isle Bay Area of Concern Delisting; 30-Day Public Comment Period and Public Availability Sessions The Department of Environmental Protection (Department) provides notice of the availability of the Stage 3 Remedial Action Plan documenting the proposed removal of Presque Isle Bay from the list of Areas of Concern under the Great Lakes Water Quality Agreement.
The Great Lakes Water Quality Agreement (Agreement) signed by Canada and the United States in 1972 expresses the commitment of both countries to restore and maintain the chemical, physical, and biological integrity of the Great Lakes water resources. A 1987 amendment to the Agreement describes a process for identifying and restoring geographical Areas of Concern (AOC) based on evaluation of 14 beneficial use impairments (BUIs) ranging from loss of wildlife habitat and fish tumors to beach closings and drinking water problems. In 1991, due in part to concerns from local anglers of brown bullhead catfish (Ameiurus nebulosus) with external sores and tumors and at the urging of local citizens, the United States Department of State designated Presque Isle Bay the 43rd AOC under the Agreement. Two of the 14 BUIs were identified as issues for the bay: restrictions on dredging activities and fish tumors or other deformities.
Since the 1980s, the Department and its partners conducted studies of the bay's brown bullheads and collected information on sediment quality conditions within the bay. In the early 1990s, tumor rates were as high as 86% for grossly observable external tumors and 22% for liver tumors. Over the next ten years, tumor rates steadily declined to 19% for grossly observable external tumors and a reported zero percent for liver tumors. The sediments were found to contain low level contamination, primarily metals and polycyclic aromatic hydrocarbons (PAHs), spread throughout the bay. The investigations also indicated that sediment quality conditions were improving in the bay. The improvements in sediment quality, the decade-long downward trend in fish tumors, and the decision not to pursue active remedial measures within the AOC led to the redesignation of Presque Isle Bay to the Recovery Stage in 2002. The new status was a direct result of changes in the watershed the most significant of which was the $100 million in upgrades to the City of Erie's wastewater collection, treatment, and conveyance system.
In 2005, a comprehensive sediment study began to assess the restrictions on dredging activities BUI. The assessment included both practical and ecological perspectives. The practical restriction is based on Pennsylvania's laws and regulations, which preclude the disposal of the dredged material in the open lake regardless of contaminant presence or absence. Disposal to the Confined Disposal Facility (CDF) or an upland site are the only allowable options. Because the restrictions on disposal of dredged material are not related to sediment contamination, but rather laws preventing the disposal of solid waste in waters of the Commonwealth, from the practical perspective the beneficial use is not considered impaired.
From an ecological perspective, the sediment in the Presque Isle Bay AOC was evaluated against a delisting target based on discharges from the disposal of dredged material in the CDF. Using elutriate data for areas routinely dredged within the AOC and calculations to predict concentrations in the CDF discharge based on concentrations in the sediment, it was determined that sediment dredged from any location within the AOC could be placed in the CDF. As a result of both the practical and ecological evaluations, the restrictions on dredging activities BUI was delisted in 2007.
Development of the fish tumor delisting target for the Presque Isle Bay AOC was an iterative process. Following the recommendations of Great Lakes researchers, de-listing criteria were based on a comparison of liver and skin tumor incidence rates in Presque Isle Bay to a Lake Erie reference or ''least impacted control site''. The Department selected Long Point Inner Harbor, ON after evaluating a number of non-AOC sites on Lake Erie and several inland Pennsylvania lakes.
Assessing the fish tumor or other deformities BUI required examination of more than twenty years of data from sampling, analysis, research, and discussions. To organize the information and findings, the Department used the United States Policy Committee's Delisting Principles and Guidelines. The guidelines evaluate whether the impairment is limited to the AOC, has a natural cause, has been addressed by remedial measures, or is due to sources outside the AOC.
The Department used data collected in the post-Recovery Stage to identify and test a delisting target, which incorporated both liver and external tumors. Comparison to a selected ''least impacted control site'' showed that the liver tumor incidence in Presque Isle Bay met the delisting target. This was not the case for the external tumors. Data collected from Lake Erie sites did indicate that the liver tumor rate in Presque Isle Bay may be a reflection of a background rate for this species in the Great Lakes. The incidence of external tumors across the Lake Erie sites fluctuates more, with Presque Isle Bay incidence rates at the higher end of the spectrum.
Radiotelemetry migration studies found that the bullhead do not migrate outside the bay, which suggests that there is something different either in the genetic makeup of the fish or the bay's ecosystem. Comparison with tumor rates from three inland lakes and other locations in Lake Erie showed that the impairment is not typical of lakewide, region-wide, or area-wide conditions. The Department concluded that the external tumors impairment is a local issue and evaluated the possibility that the bay's bullhead are hybrids between two species and thus, more susceptible to disease, or the tumors are caused by a naturally occurring virus. Studies, while limited by the number of samples for viral investigation, did not support either hypothesis. An exposure study did not establish a cause and effect relationship between chemicals in the sediment and external tumors, even at the earliest detectable stage. It is possible that the external tumors are a result of multiple factors that synergistically act to produce cancer.
Given the large uncertainty both in the measurement and causes of skin tumors on brown bullheads, it is quite possible that skin tumors are a poor indicator of environmental health. As a result, the Department revised the delisting target, focusing on a comparison of liver tumor incidence rates between Presque Isle Bay and Long Point Inner Harbor. Post-Recovery monitoring data shows that the Bay meets this delisting target.
It is clear that the external tumors reflect conditions in the ecosystem, yet unclear as to what those changes are and how they relate to environmental contamination. The Department will monitor external tumors as a measure of ecosystem health and continue to investigate the cause(s) of the tumors. It was the external tumors found on the bay's brown bullheads in the late 1980s that resulted in the listing of Presque Isle Bay as an AOC.
Despite the absence of scientific data to support a causal relationship between contaminants in the bay's sediment and external tumors, PAHs, metals, and other legacy Chemicals of Potential Concern (COPCs) are present. Both ecological and human health risk assessments were commissioned using existing data from the AOC. Using appropriately conservative assumptions, the conclusion of both risk assessments is that the ecological and human health risk posed by legacy contaminants in the bay is low-moderate for all receptor groups evaluated.
The Department believes that the RAP process has accomplished its goal to the maximum extent practicable and the ultimate identification of the causes of the external tumors needs to be addressed outside the scope of the AOC program. Based on the decreased and stable tumor rates, review of the available scientific evidence, and in close consultation with local and national experts and its own PAC, the Department recommends delisting the Fish Tumor Beneficial Use Impairment. The removal of the final BUI indicates that environmental conditions in Presque Isle Bay are comparable to non-AOC locations in the Great Lakes. The Department concurs and recommends the delisting of Presque Isle Bay as an AOC.
Request for Written Comments
The Department is requesting comment on the Stage 3 Remedial Action Plan (RAP) which summarizes the studies, data, and literature supporting the recommendation to delist. The Department intends to publish notice of a final action after it considers any comments it receives. The Department intends to include comments and any responses as part of the RAP files. The first is on Friday, August 10, 2012 from 4:00 to 6:00 pm in room 110 at the Tom Ridge Environmental Center. The second is on Tuesday, August 28, 2012, from 6:00 to 8:00 pm at the Erie County Conservation District.
