FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

All in-stream pipeline construction activities shall be performed in dry work conditions by directional drilling, dam and pumping, fluming or diverting stream flow around the work areas. Construction of the TL-610 Extension 1 Tioga Area Expansion Project outside of maintained right-of-way will result in 1.086-acres of temporary wetland impact with 0.39-acre of permanent wetland loss. Complete restoration of temporary wetland impacts shall be required. The 0.39-acre of permanent wetland loss shall be mitigated by the permittee. The project`s northern terminus is located along the southern right-of-way of Clymer Township Road 559 and the southern terminus is located along the western right-of-way of Tioga State Forest Wilson Point Road.

Applicant proposes to remove the existing SR 19, two lane, 29.2 ft. wide, two span, concrete arch bridge having a total length of approximately 150 ft., and having minimum normal pool underclearance of 14 ft.; and to construct and maintain downstream and adjacent to the existing bridge an 88.1 ft. total width, two lane, two span, concrete beam replacement bridge having a total length of approximately 154 ft. and having minimum normal pool underclearance of 9.7 ft. over the South Fork of Ten Mile Creek (WWF) with a drainage area of 132 square miles. In addition, fill 0.04 acre of PEM wetland; construct and maintain an 18 ft. extension to an existing 100 ft. long, 7.1 ft. by 7.1 ft. box culvert enclosure and relocate 51 ft. of an adjoining unnamed tributary with a drainage area of 326 acres; for project construction and demolition install temporary causeways and temporary fill of 0.14 acre of PEM wetlands; construct and maintain associated replacement stormwater outfalls; and construct and maintain stream mitigation off-site. The bridge and road improvement project is located within and between Waynesburg Borough and Franklin Township Greene County (Waynesburg Quadrangle, Latitude 39° 53` 47" and Longitude 80° 10` 14").

The Polk to Fike Pipeline Project includes the construction of approximately 21,000 feet of 12" gas gathering line with a 60 foot Right of Way (ROW), two surface sites, and five access roads. The Project has 10 stream and 3 wetland crossings of Fike Run (HQ-CWF) and unnamed tributaries to Fike Run. The 10 stream crossings will be a combination of flume pipe diversions for the pipe and temporary mobile bridges for the temporary access roads. The wetland crossings will consist of two HDD bores and one open trench with timber mats. The total disturbance for this project is 35.1 acres. This pipeline crosses from PA into WV. (Friendsville & Brandonville, Quadrangle N: 39° 44` 7"; W: -79° 30` 44").

The applicant proposes to construct a passive treatment system for the Robbins Hollow 10A and 10B acidic discharges from previous mining operations. The system, which would be authorized under a restoration waiver, will consist of a small collection system, limestone bed and settling pond. The limestone bed is designed to settle and retain precipitated metals and discharge water with a pH of 6-7. The settling pond will discharge to the same roadside ditch that currently carries the flow. The channel that carries the discharge to Robbins Hollow will not be impacted. As proposed, there will be two wetland impacts associated with the work:

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

STATE CONSERVATION COMMISSION
NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.
For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
