Taylor Township, Lawrence County Pursuant to Section 507 of the Hazardous Sites Cleanup Act, Act of October 18, 1988, P. L. 756, 35 P. S. §§ 6020.101—6020.1305 (''HSCA''), the Pennsylvania Department of Environmental Protection (''Department'') and United States Environmental Protection Agency (''USEPA'') have negotiated a Partial Consent Decree (''Settlement'') regarding the cleanup of the Remacor, Inc. Superfund Site in Taylor Township, Lawrence County, Pennsylvania (''Site''), and recovery of costs incurred and to be incurred in responding to the release or threat of release of hazardous substances at or in connection with the Site.
The payment to be made by each of the following Settling Defendants (''Defendants'') under this Consent Decree involves only a minor portion of the response costs at the Site within the meaning of Section 122(g)(1) of CERCLA, 42 U.S.C. § 9622(g)(1) and Section 707(a) of HSCA, 35 P. The Department's share of that Settlement is $26,224.32. The specific terms of this agreement are set forth in the Partial Consent Decree (''Settlement'') with the Department, USEPA and the Defendants that has been lodged with the U.S. District Court for the Western District of Pennsylvania. Each of the Defendants is a potentially responsible person at the Site that arranged for treatment, disposal at and/or transportation of hazardous substances to the Site. The Department will receive and consider comments relating to the Settlement for sixty (60) days from the date of this Public Notice. The Department has the right to withdraw its consent to the Settlement if the comments concerning the Settlement disclose facts or considerations that indicate that the Settlement is inappropriate, improper, or not in the public interest.
After the public comment period, the Settlement shall be effective upon Court approval after the Department notifies the Court and Defendants, in writing, that this Settlement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Settlement, or that no such comments were received.
The Settlement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, Pennsylvania.
