PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

The plan also provides for extension of sanitary sewers with septic tank effluent pumps and low pressure force mains to the PA 333 Area, the Blue Juniata Drive Area and the Anderson Road Area which includes a small portion of Bratton Township. The Plan proposes one new pump station, number 4, and an associated force main to relieve an existing bottleneck in the collection system and the rehabilitation of pumping stations numbers 2, 5, 6, 7, 8, 9, and 10. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Main Street, Elverson, PA 19520 submitted a Baseline Environmental Report on behalf of his client, Redevelopment Authority of Luzerne County, 16 Luzerne Avenue, Suite 210, West Pittston, PA 18643, concerning the remediation of soil found to have been impacted by lead and groundwater found to have been impacted by iron, manganese and several semi-volatile organic compounds as a result of historic rail yard operations and locomotive repair and maintenance facilities on the property. The Baseline Environmental Report was submitted in partial fulfillment of the Special Industrial Area requirements and was approved on January 18, 2012.
