Unemployment Compensation; Shared-Work Program

[Saturday, March 3, 2012]The act of June 17, 2011, (P. L. 16, No. 6) (Act 6) added Article XIII, entitled ''Shared-Work Program,'' to the Unemployment Compensation (UC) Law (43 P. S. §§ 916.1—916.13). Under the program, if a qualified employer is facing temporary layoffs that would affect at least 10% of the employees in a department, shift or other unit, the employer may seek approval for a shared-work plan. Under the plan, the employer would reduce the work hours of all employees in that unit by a set percentage instead of laying off any workers. The participating employees, if otherwise eligible for UC, would receive the same percentage of their UC benefit rate for each week covered by the plan.
Under section 3304(a)(4)(E) of the Federal Unemployment Tax Act (26 U.S.C.A. § 3304(a)(4)(E)) and section 303(a)(5) of the Social Security Act (42 U.S.C.A. § 503(a)(5)), a state may use moneys in its UC trust fund to pay benefits for shared work if the shared-work provisions of the state's UC statute are approved by the United States Department of Labor. Accordingly, Act 6 provides that Article XIII of the UC Law shall take effect upon publication of a notice in the Pennsylvania Bulletin that the provisions of Article XIII have been approved by the United States Department of Labor.
The Department of Labor and Industry (Department) is hereby providing notice that the United States Department of Labor has approved Article XIII, Shared-Work Program, of the UC Law. The Department will begin to accept applications from employers for approval of shared-work plans immediately.
