The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

Gipe Estate, Ronald Gipe, Executor, 463 Lindman Drive, Chambersburg, PA 17202, submitted a Remedial Investigation and Final Report for soils and groundwater contaminated with leaded and unleaded gasoline from the operation of a former automotive repair facility. The report is intended to document remediation of the site to the Residential Statewide Health and Site Specific standards.
Kevin Hayes Residence/E.G. Smith, Incorporated, 105 Telford Avenue, West Lawn, PA 19609, Spring Township, Berks County. Liberty Environmental, Inc., 50 North Fifth Street, 5th Floor, Reading, PA 19601, on behalf of Kevin Hayes, 105 Telford Avenue, West Lawn, PA 19601, submitted a Final Report for site soils contaminated with #2 fuel oil. The report is intended to document remediation of the site to meet the Residential Statewide Health Standard.
LAND RECYCLING AND

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Former Excel Storage Facility, Route 447, Stroud Township, Monroe County, Mary King, Civil & Environmental Consultants, Inc., has submitted a Remedial Investigation Report and Cleanup Plan on behalf of her client, Robert Riegler, Route 244 Storage Center, LLC, Route 447, East Stroudsburg, PA 18301, concerning the remediation of trichloroethene (TCE), tetrachloroethene (PCE) and cis-1,2-dichloroethene (c-1,2-DCE) in shallow exterior soils and below the interior floor slab. The reports documented attainments were submitted in partial fulfillment of the Non-Residential Site Specific Standard for soil and groundwater and were approved on February 15, 2013.
Former Camp Olympic Dairy, 3158 South Cedar Crest Blvd., Lower Macungie Township, Lehigh County, Douglas Sammak, American Analytical & Environmental, Inc., has submitted a Final Report (on behalf of his client, Lee Lichtenwalner, Lower Macungie Township Official, 3400 Brookside Road, Macungie, PA 18062), concerning the remediation of soil found to have impacted by unleaded gasoline from an abandoned underground storage tank. The report was submitted to document attainment of the Residential Statewide Health Standards for soil. The report was submitted to document attainment of the Residential Statewide Health Standard for soil and was approved on February 21, 2013.

REC Oil / Former Sunoco Bulk Storage Facility, 280 North East Street, York, PA 17403, City of York, York County. Enviro Trac, Ltd., 176 Thorn Hill Road, Warrendale, PA 15086, on behalf of REC-Oil, 280 North East Street, York, PA 17403 and Environmental Compliance Management, 345 King Street, Myerstown, PA 17067, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with PAHs, VOCs and lead. The combined Remedial Investigation and Final Report did not demonstrate attainment of the Nonresidential Statewide Health and Site-Specific Standards, and was disapproved by the Department on February 21, 2013.

This general permit was originally issued to York Building Products Co., Inc. for the beneficial use of baghouse fines and scrubber pond precipitates for use as an aggregate in roadway construction, a soil additive, a soil conditioner, or a component or ingredient in the manufacturing of construction products, generated at the Roosevelt Blacktop Plant, 1070 Roosevelt Avenue, York, PA in West Manchester Township, York County.
On January 30, 2013, York Building Products Co., Inc. notified the Department of the sale of their assets to York Materials Group LLC which took place on January 15, 2013. Based on the information provided in these notifications, the beneficial use activity performed by these facilities is now under the ownership and management of York Materials Group LLC.
Notice is hereby given of the re-issuance of the General Permit Number WMGR028SC004 granting York Materials Group LLC the beneficial use of baghouse fines and scrubber pond precipitates, generated at the Roosevelt Blacktop Plant, 1070 Roosevelt Avenue, York, PA in West Manchester Township, York County, as specified in the general permit. The Southcentral Regional Office approved the re-issuance of this general permit on February 26, 2013.

15-00019: Exelon Generation Co., LLC (300 Exelon Way, Suite 330, Kennett Square, PA 19348) on February 15, 2013, to renew the Title V Operating Permit in East Pikeland Township, Chester County. The initial permit was issued on July 2, 2000, for their electric utility power station located at 100 Cromby Road, Phoenixville, PA. The facility is a major source for all criteria pollutants. Sources include utility Boiler 1, utility Boiler 2, Cromby Auxiliary Boiler, Natural Gas Preheater, Centrifuge Dryers A and B, Reheat Burners ABC, Diesel Generator, Mechanical Collector 1, ''D'' Secondary Collector Cyclone, Electrostatic Precip 1, Wet Scrubber Train ABC, Dryer A Cyclone, Dryer B Cyclone, Baghouse 1, and SNCR for Boiler 1. Boiler 1 was previously subject to 40 C.F.R. Part 60, Subpart HHHH. Subpart HHHH has since been vacated. Boiler 1 and Boiler 2 are subject to 40 C.F.R. Part 63, Subpart UUUUU. The Auxiliary Boiler and Natural Gas Heater are subject to 40 C.F.R. Part 63, Subpart DDDDD. The Diesel Generator is only used for emergencies and is subject to 40 C.F.R. Part 63, Subpart ZZZZ, but is exempt from having to meet the requirements of this subpart and subpart A of 40 C.F.R. Part 63, including the initial notification requirement. Boiler 1 is considered a major source of PM, SOx, CO, and NOx The pollutants SOx and NOx are monitored using a Continuous Emission Monitoring System (CEMS), which exempts the source from Compliance Assurance Monitoring (CAM) requirements for SOx and NOx CAM requirements already exist for PM emissions from this source. CAM does not apply to the CO emissions. Boiler 1 and Boiler 2 are both subject to the Clean Air Interstate Rule (CAIR). Applicable conditions were already incorporated into the permit. The following are potential site-wide emission rates for this facility: NOx—5,341.1 TPY; SOx—17,781.9 TPY; PM—2,125.1 TPY; CO—679.8 TPY; VOC—32.74 TPY; HAP—137.5 TPY; and GHG—3,149,609 TPY (reported as CO2e). Allowable emissions from the facility have not increased as a result of this permit renewal. Individual limits apply to the various sources at the facility. The operating permit contains requirements to keep the facility operating within all applicable air quality requirements for this source. The Department intends to re-issue an Acid Rain Permit for this site, as well. For the time period from January 2013 to December 2017, the Title IV Permit (ORIS number 3159) is included by reference in the Title V Operating Permit renewal. Boiler 1 and Boiler 2 are Phase II units, as defined in 40 C.F.R. Section 72.2, and are both subject to Acid Rain Program permitting for SOx. For calendar years 2013—2017, the SOx allowance allocations for Boiler 1 are 2,207 tons per calendar year. For the same time period, the SOx allowance allocations for Boiler 2 are 2,114 tons per calendar year. When the Acid Rain program was first implemented, the facility opted into the early election NOx reduction plan for Boiler 1. Boiler 1 became subject to an early election Phase I NOx limitation of 0.50 lb/MMBtu, on an annual average basis, which was effective through 12-31-2007. Per 40 C.F.R. 76.8, on January 1, 2008, Boiler 1 became subject to a new NOx limit of 0.46 lb/MMBtu, on an annual average basis. Boiler 2 does not burn coal and is therefore only subject to the sulfur emission requirements of the Acid Rain Program. All necessary conditions and requirements will be included in the Acid Rain Permit.
23-00038: Delaware County Regional Water Quality Control Authority—Western Regional Treatment Plant—DELCORA (100 E 5th Street, P. O. Box 999, Chester, PA 19016) on February 21, 2013, to renew the facility's Title V Operating Permit originally issued on August 8, 2006 at 3201 West Front Street, City of Chester, Delaware County. The major sources of pollution at the facility are VOC, NOx, SOx, CO, HAP and PM. The operation is subjected to federal NSPS and NESHAP regulations. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the plant operating within all applicable air quality requirements.

15-00082: Downingtown Area School District (445 Manor Avenue, Downingtown, PA 19335) on February 15, 2013, to operate six (6) boilers which provide heat to the campus buildings and three (3) emergency generators in Downingtown Borough, Chester County. This action is a renewal of the State Only Operating Permit (Synthetic Minor). The original State Only Operating Permit was issued on November 18, 2002. The facility took operating hour restrictions for the emission sources to limit the Nitrogen Oxides emissions produced by the consumption of fuels. The renewal contains all applicable monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

10-00234: Karns City Area School District (1446 Kittanning Pike, Karns City, PA 16041-1818) on February 19, 2013, renewed the State Only Operating Permit for the Junior/Senior High School in Fairview Township, Butler County. The primary sources at the facility are 2 natural gas fired boilers, 2 natural gas fired hot water heaters, and an emergency generator. The facility is a Natural Minor. Potential emissions are estimated as follows: PM 2.7 tpy; NOx 37 tpy; SOx 2 tpy; CO 11 tpy; VOC less than 1 tpy. The permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
25-00092: Noram Seating (18 Market Street, Union City, PA 16438-1327) on February 20, 2013, issued a renewal of the State Only Operating Permit for their wooden chair manufacturing facility in Union City Borough, Erie County. The sources at the facility include a 1.7 mmbtu/hr wood fired boiler controlled by a cyclone and miscellaneous wood working operations controlled by fabric collectors. The facility is a natural minor. The facility is an Area Source for MACT. The wood fired boiler is subject to the requirements of 40 CFR 63, Subpart JJJJJJ—NESHAP for Industrial, Commercial, and Institutional Boilers at Area Sources. The PM, SOx, NOx, CO, and VOC emissions are less than 10 TPY, 0.2 TPY, 3 TPY, 4.5 TPY, and 0.1 TPY, respectively. The renewal permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

The facility's air emission sources include a hot mix asphalt plant, a portable concrete crushing plant, and fugitive emissions from material handling and vehicle traffic. The hot mix asphalt plant is controlled by baghouse.
