Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period.  To modify and maintain a 16-foot wide single span steel beam bridge across Nesquehoning Creek (CWF, MF) having a 29-foot span and a 3.5-foot underclearance. Modifications include removing the timber abutments and constructing concrete abutments. This bridge was previously authorized as a temporary road crossing permitted under General Permit GP081312402, acknowledged on May 3, 2012.  The project begins approximately 1,400 feet west of the intersection of Tittle Road and Mountain Road (Wind Gap, PA Quadrangle Latitude: 40° 51` 31.75"; Longitude: -75° 20` 14.85") and ends approximately 1,200 feet southeast of the intersection of Birchwood Park Road and Meixell Valley Road (Saylorsburg, PA Quadrangle Latitude: 40° 53` 48.28", Longitude: -75° 22` 14.37") in Ross Township, Monroe County. Subbasin: 2B.

 To construct and maintain a road crossing of a tributary to Bear Creek (CWF, MF) consisting of an open bottom structural plate arch having a 25-foot span with a 9-foot underclearance, concrete headwalls, concrete wing walls and R-6 riprap. The project is located on the south side of West Deer View Drive (T-661) approximately 1.8 miles south of its intersection with SR 0895 (Friedensburg, PA Quadrangle Latitude: 40°33`46.9"; Longitude: -76°9`1.2"). E13-173. Lehigh Canal Recreation Commission, 141 Church Street, Lehighton, PA 18235. Parryville Borough, Carbon County, Army Corps of Engineers Philadelphia District.

 To remove the existing structure and to maintain a 35-foot wide concrete box beam bridge across the Lehigh Canal having a 72.5-foot span and a 7-foot underclearance. The bridge was constructed under Permit E13-146 to provide temporary construction access for the replacement of the I-476 bridge over the Lehigh River and Pohopoco Creek. The project is located approximately 1,000 feet west of the intersection of SR 0248 and Centre Street (Lehighton, PA Quadrangle Latitude: 40°49`1"; Longitude: -75°40`36"). Subbasin: 2B.

 To construct and maintain a 0.35-acre off-stream excavated pond in the floodway of a tributary to Dry Sawmill Run (HQ-CWF, MF) with a 4-inch diameter PVC intake pipe from the tributary crossing approximately 6 feet of EV wetlands and a 6-inch diameter PVC outlet pipe to the tributary crossing approximately 4 feet of EV wetlands.  To: 1) install and maintain a 37.0-foot long by 6.0-foot wide temporary steel bridge with a 4.0-foot underclearance across Brewster Hollow (WWF, MF); 2) relocate and maintain 251.0 linear feet of an Unnamed Tributary to Six Mile Run (WWF, MF) impacting approximately 20.0 feet wide x 10.0 feet long of floodway of Six Mile Run (WWF, MF); 3) install and maintain a 12.0-inch diameter PVC outfall pipe with a 9.0 feet wide by 6.0 feet wide R-3 riprap apron in and along Brewster Hollow (WWF, MF); 4) install and maintain a 12.0-inch diameter PVC outfall pipe in and along an Unnamed Tributary to Six Mile Run (WWF, MF); and 5) construct and maintain 135.0 linear feet of R-3 bank stabilization on the right side of Brewster Hollow (WWF, MF), for the purpose of constructing a passive acid mine drainage treatment system to treat the SX8-D1 acid mine drainage discharge to Brewster Hollow. The project is located north of Six Mile Run Road at the confluence of Brewster Hollow with Six Mile Run (Saxton, PA Quadrangle; Latitude: 40°09`43.2", Longitude: -78°13`41.3") in the town of Defiance in Broad Top Township, Bedford County. No wetlands will be impacted by this project.

E36-901: Martin Murray, Yarrum, LP, 5020 Ritter Road, Mechanicsburg, Pennsylvania 17055, in West Donegal Township, Lancaster County, ACOE Baltimore District

 To: 1) construct and maintain a 12.0-inch depressed, 35.0-foot long, 23.0-foot wide, 6.0-foot high concrete box culvert with fish baffles and endwalls in an unnamed tributary to Conewago Creek (TSF), permanently impacting 0.06 acre of palustrine forested/scrub shrub/emergent wetland and temporarily impacting 0.01 acre of palustrine forested/scrub shrub/emergent wetland; 2) construct and maintain a 6.0-inch depressed, 73.0-foot long, 12.0-inch high density polyethylene pipe permanently impacting 0.04 acre of palustrine forested/scrub shrub/emergent wetland; 3) place and maintain fill in palustrine emergent/forested wetlands, permanently impacting 0.20 acre of wetland and temporarily impacting 0.16 acre of wetland; 4) place and maintain 10.0 cubic yards of fill in the floodway of an unnamed tributary to Conewago Creek (TSF), all for the purpose of allowing for the construction of two warehouse distribution facilities; and 5) place and maintain fill in 0.01 acre of palustrine forested wetland for the purpose of creating a wetland mitigation area. The project is located along Industrial Road, approximately 0.28 mile west of its intersection with S.R. 230 (Latitude: 40°09`41.3"N, Longitude: -76°38`50"W) in West Donegal Township, Lancaster County. The applicant is required to provide 0.35 acre of replacement wetland and proposes to create 0.49 acre of replacement wetland onsite.

Application Period for Municipal Recycling Program Performance Grant Applications under Act 101, Section 904 of the Municipal Waste Planning, Recycling and Waste Reduction Act of 1988; Calendar Year 2012

 The Department of Environmental Protection (DEP) announces a request for applications from municipalities for recycling performance grant assistance for recycling programs pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 904. Municipalities include counties, cities, boroughs, incorporated towns, townships, home rule municipalities, their authorities, councils of governments, consortiums, or similar entities established by two or more municipalities under 53 Pa.C.S. Chapter 23, Subchapter A (relating to intergovernmental cooperation). This application period is for eligible materials recycled and marketed in calendar year 2012.

 Municipal Recycling Program Performance Grant funds will be awarded to municipalities based upon the weight of source-separated recyclable materials identified in § 1501(c)(1)(i) of Act 101 recovered by municipal recycling programs, and the population of the municipality as determined by the most recent decennial census. Calendar year 2012 Recycling Performance Grants will be calculated utilizing the formula established for the past two grant years.

 Applicants who have failed to comply with the conditions set forth in previously awarded grants, the recycling program performance requirements contained in Act 140 of 2006, the grant requirements of Act 101, or the regulations of Act 101 may not be awarded funds under this grant program. Applicants must ensure that they are in compliance with §  272.314(b)(2) relating to the submittal of the annual recycling report.

 Eligible materials include post-consumer: clear glass, colored glass, aluminum cans, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper, other marketable grades of paper, and plastics. Grants will be awarded only for properly documented, eligible materials that were actually marketed on or after Jan. 1, 2012, to and including Dec. 31, 2012. Applicants should only claim those tonnages for which they have documentation at the time they complete their application. Any residues, materials not listed as eligible, or any materials that cannot be documented as being generated within the municipality or marketed or recycled into new products or uses are not eligible for consideration toward the grant. In particular, recovered glass that is being stockpiled or used as daily cover at a landfill will not be considered as recycled. Applicants must be able to document the amount of residue attributable to their recycling program.

 Documentation to support all claims that eligible recyclable materials were generated within the municipality and marketed must be made available for auditing by the Department of Environmental Protection, the Office of the Auditor General, the Office of the Treasurer, or agents of those offices for four (4) years. DEP will not require applicants to retain hauler customer lists; however, the lists may be required to be examined in the event of an audit. It will be the applicant's responsibility to arrange for hauler customer lists to be provided, or for haulers to be present with their customer lists, during a grant audit. Supporting documentation is not required to be submitted with the application. Any tonnages not properly documented at the time of an audit will not be credited towards the applicant's Performance Grant award. No additional/supplemental documentation will be accepted after the audit is completed. Failure to submit a complete and accurate application may result in a denial of the application.

 Grant applications must be on forms provided by DEP for calendar year 2012. Grant applications must be delivered by 4 p.m., Sep. 30, 2013, or postmarked on or before this date. Applications received by the DEP after the deadline will be returned to the applicant. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

 Applicants who filed a Performance Grant application for calendar year 2011 will be mailed a current application by DEP as soon as it is available.
