FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Applicant is proposing to:
1. operate and maintain an existing 180 lf long, 8" diameter perforated plastic stream enclosure/underdrain in an unnamed tributary (UNT 1) to Chartiers Creek (WWF) and associated fill;
2. remove an existing 150 lf stream enclosure of another unnamed tributary (UNT 2) to Chartiers Creek (WWF) and to construct and maintain, in its place, an approximately 760` long, stream enclosure, consisting of a 48" diameter reinforced concrete pipe, and associated fill and outfall structure;
3. remove an approximately 300 lf stream enclosure from a downstream reach of UNT 2, and to reconstruct approximately 370' this watercourse;
4. construct and maintain a utility line crossing of the reconstructed portion of UNT-2;
5. extend an existing 20 lf pipe in another unnamed tributary (UNT 3) to Chartiers Creek (WWF) by an additional 255 lf (8" diameter perforated plastic underdrain), and to operate and maintain the combined 275 lf stream enclosure;
6. operate and maintain fill in approximately 0.11 acre of wetlands;
7. and to place and maintain fill in an additional 0.25 acre of wetland (PEM/PSS)
and to regrade and stabilize existing stockpiles of soil material, for the purpose of constructing The Foundry at South Strabane, a multiple structure, retail and service development complex. To compensate for these impacts, the applicant proposed to construct approximately 1,191 lf of on-site stream mitigation and approximately 1,310 lf of off-site stream mitigation, to restore approximately 300 ft2 of Wetland 6, and to construct approximately 0.56 acre of replacement wetland, adjacent to the reconstruction section of UNT-2.
The previous permit, issued July 27, 2007 authorized: The placement and maintenance of fill in 0.935 acre of wetlands, to place and maintain fill in three (3) unnamed tributaries to Chartiers Creek, each having a drainage area of less than 100 acres, for a total impact of 2,375`; to operate and maintain a geosynthetic reinforced embankment wall within portions of the floodway of a tributary to Chartiers Creek; and to construct and maintain various outfalls. To compensate for those impacts, the applicant had proposed the construction of approximately 1.1 acres of replacement wetlands, and provide for stream mitigation in accordance with the special conditions of that permit.
