FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To repair the existing timber covered bridge on T-310 (Champion Hill Road) over Muncy Creek including; both left and right low chords, stringers, vertical members, the far abutment, and the timber siding. This project also proposes to remove sediment to protect the structure from future flood damages. Sediment removal will permanently impact 580 linear feet of Muncy Creek, which is classified as Exceptional Value.

 E63-587-A1. HCB Foundry LLC, 11111 West 95th Street, Overland Park, KS 66214, South Strabane Township, Washington County; ACOE Pittsburgh District

 Applicant is proposing to:

 1. operate and maintain an existing 180 lf long, 8" diameter perforated plastic stream enclosure/underdrain in an unnamed tributary (UNT 1) to Chartiers Creek (WWF) and associated fill;

 2. remove an existing 150 lf stream enclosure of another unnamed tributary (UNT 2) to Chartiers Creek (WWF) and to construct and maintain, in its place, an approximately 760` long, stream enclosure, consisting of a 48" diameter reinforced concrete pipe, and associated fill and outfall structure;

 3. remove an approximately 300 lf stream enclosure from a downstream reach of UNT 2, and to reconstruct approximately 370' this watercourse;

 4. construct and maintain a utility line crossing of the reconstructed portion of UNT-2;

 5. extend an existing 20 lf pipe in another unnamed tributary (UNT 3) to Chartiers Creek (WWF) by an additional 255 lf (8" diameter perforated plastic underdrain), and to operate and maintain the combined 275 lf stream enclosure;

 6. operate and maintain fill in approximately 0.11 acre of wetlands;

 7. and to place and maintain fill in an additional 0.25 acre of wetland (PEM/PSS)

 and to regrade and stabilize existing stockpiles of soil material, for the purpose of constructing The Foundry at South Strabane, a multiple structure, retail and service development complex. To compensate for these impacts, the applicant proposed to construct approximately 1,191 lf of on-site stream mitigation and approximately 1,310 lf of off-site stream mitigation, to restore approximately 300 ft2 of Wetland 6, and to construct approximately 0.56 acre of replacement wetland, adjacent to the reconstruction section of UNT-2.

 The previous permit, issued July 27, 2007 authorized: The placement and maintenance of fill in 0.935 acre of wetlands, to place and maintain fill in three (3) unnamed tributaries to Chartiers Creek, each having a drainage area of less than 100 acres, for a total impact of 2,375`; to operate and maintain a geosynthetic reinforced embankment wall within portions of the floodway of a tributary to Chartiers Creek; and to construct and maintain various outfalls. To compensate for those impacts, the applicant had proposed the construction of approximately 1.1 acres of replacement wetlands, and provide for stream mitigation in accordance with the special conditions of that permit.

 The project is located at the south corner of the intersection of Manifold Rd and US Route 19 in South Strabane Township, Washington County. (Pittsburgh ACOE District, Washington East Quadrangle, N: 12.11" W: 13.31" Latitude 40° 11` 30" Longitude 80° 13` 13")

 E63-646. Washington Trotting Association, Inc., 9107 W. Russell Road, Las Vegas, NV 89148, North Strabane Township, Washington County; ACOE Pittsburgh District

 The applicant proposes to construct and maintain a 46-foot long, 10 feet wide x 5 feet high box culvert in an unnamed tributary to Chartiers Creek (WWF) to provide access to the proposed Meadows Hotel. The project is located at 210 Racetrack Road, on the east side of Racetrack Road, approximately 3,500.0 feet south from the intersection of Racetrack Road and Johnson Road (Washington East, PA Quadrangle N: 10.6 inches; W: 16.7 inches, Latitude: 40° 13` 4.0"; Longitude: 80° 12` 5.84") in North Strabane Township, Washington County.

 E04-343. Pine Valley Bible Camp, 504 Chapel Drive, Ellwood City, PA 16117, North Sewickley, Beaver County; ACOE Pittsburgh District

 The applicant proposes to encroach upon 26,190 square feet in the floodway of Brush Creek (WWF) in order to construct two buildings along with additional site improvements for the purpose of rebuilding the applicant's camp. The project is located on the west side of Chapel Drive, approximately 2,500.0 feet south from the intersection of Chapel Drive and Harpers Ferry Road (Zelienople, PA Quadrangle N: 10.25 inches; W: 16.5 inches, Latitude: 40° 48` 29.7"; Longitude: 80° 14` 42.5") in North Sewickley Township, Beaver County.

 To construct, operate and maintain the Meshoppen Creek Impoundment, which consists of a 10.1 million gallon centralized freshwater impoundment and associated access roads, with the following impacts:

 1. 875 square feet of permanent impacts to Palustrine Emergent (PEM) Wetlands via the placement of fill in the wetlands (Springville, PA Quadrangle, Latitude: N41°37`40.87", Longitude: W76°56`52.15");

 2. 875 square feet of permanent impacts to Palustrine Emergent (PEM) Wetlands via the placement of fill in the wetlands (Springville, PA Quadrangle, Latitude: N41°37`40.14", Longitude: W76°56`53.19");

 3. 4,800 square feet of permanent impacts to Palustrine Emergent (PEM) Wetlands via the placement of fill in the wetlands (Springville, PA Quadrangle, Latitude: N41°37`43.36", Longitude: W75°56`51.32"); and

 4. 1,325 square feet of permanent impacts to Palustrine Emergent (PEM) Wetlands via the placement of fill in the wetlands (Springville, PA Quadrangle, Latitude: N41°37`43.54", Longitude: W75°56`53.84").

 The project will result in 7,875 square feet (0.18 acre) of permanent PEM wetland impacts all for the purpose of installing a 10.1 million gallon centralized freshwater impoundment to support Marcellus shale development.

No wetlands will be impacted by this project.

 EA36-030: Millcreek Preservation Association, Farm and Home Center, 1383 Arcadia Road, Room 200, Lancaster, Pennsylvania 17601, in East Lampeter Township, Lancaster County, ACOE Baltimore District

 To construct and maintain a stream restoration project along 5,000.0 feet of Mill Creek (WWF) including: 1) 3,600.00 feet of streambank grading; 2) 3,600.0 feet of rock toe protection; 3) three cross rock vanes; 4) two log vanes; 5) seven rock vanes; 6) two mudsills; and 7.) 300.0 feet of bankfull bench construction. The project is located near the intersection of Windy Hill Road and Strasburg Pike (Leola, PA Quadrangle; Latitude 40°01`19.3"N, Longitude: 76°14`8.97"W) in East Lampeter Township, Lancaster County.

 Project proposes to perform maintenance dredging and modify the Shalom Farm Pond Dam impacting a deminimus area of wetland (PEM) equal to 0.02 acre. The dam is located across a tributary to North Fork Pine Creek (CWF) (Mars, PA Quadrangle; Latitude: 40.6598, Longitude: -80.0384).

 Project proposes to breach the Koppel Reservoir Dams for the purpose of eliminating a liability to the Borough and restoring the stream to a free flowing condition. The dams are located across Stockman Run (WWF) (Beaver Falls, PA Quadrangle; D04-004 - Latitude: 40.8382; Longitude: -80.3471; D04-007 - Latitude: 40.8376; Longitude: -80.3476).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
