LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office.  The Department has received the following Notices of Intent to Remediate:

Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

Kline Lease, Harmony Township, Forest County. Atlantic Environmental Group, Inc., 453 State Route 227, Oil City, PA 16301 on behalf of Cougar Energy, Inc., 1049 West 2nd Street, Oil City, PA 16301 has submitted a Notice of Intent to Remediate. On or about March 26, 2012, during operation of an oil well, a gathering/product transmission line ruptured resulting in approximately 55 gallons of well fluids (crude oil & potentially brine water) to be released onto the soil. On April 20, 2012, a second spill occurred down gradient of Kline Well No. 17 resulting in the release of crude oil and brine water that impacted soils and a channel of an intermittent stream. The Notice of Intent to Remediate was published in The Titusville Herald on March 2, 2013. The intended future use of the site will be for agricultural use.

Berry Plastics (Fmr. Corry Hiebert Prop Old), City of Corry, Erie County. Moody & Associates, Inc., 11548 Cotton Road, Meadville, PA 16335 on behalf of Corry Area Industrial Development Corporation, 1524 Enterprise Road, Corry, PA 16407 has submitted a Notice of Intent to Remediate. The site was originally developed for sheet metal furniture manufacturing. The manufacturing process generated waste solvents, paint sludge, cutting oil, etc. Soil and groundwater have been found to be contaminated with volatile organic compounds. The intended future use of the site is industrial. The Notice of Intent to Remediate was published in the Corry Journal on March 6, 2013. The site will be remediated to Special Industrial Area Standards.

Northcentral Region: Environmental Cleanup Program Manager, 208 West Third Street, Williamsport, PA 17701

US Xpress, Boggs Township, Centre County. Pennsylvania Tectonics, Inc., 723 Main Street, Archbald, Pa 18403 on behalf of PennDOT District 2-0 Office, 1924 Daisy Street, Clearfield, Pa 16830 has submitted a Notice of Intent to Remediate soil contaminated with diesel fuel. The applicant proposes to remediate the site to meet the Statewide Health Standard.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

 Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the source is constructed and operating in compliance with applicable requirements in 25 Pa. Code Chapters 121—143, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.


Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

24-083V: Mersen USA (215 Stackpole Street, St. Mary's, PA 15857) for installation of seven (7) baking kilns and associated regenerative thermal oxidizers and wet scrubber at their facility in the City of St. Mary's, Elk County. This is a Title V facility.

 Pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection (DEP) intends to issue Plan Approval 24-083V to Mersen USA for the installation of a seven baking kilns and associated regenerative thermal oxidizers and wet scrubber at their facility in the City of St. Marys, Elk County. The Plan Approval will subsequently be incorporated into the facility's Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.

 Plan Approval No. 24-083V is for the installation seven batch carbon baking kilns. Emissions from these sources will be controlled by associated thermal oxidizer(s) and limestone slurry wet scrubber, which is proposed as Best Available Technology (BAT) for the proposed source. Based on the information provided by the applicant and DEP's own analysis, the proposed source(s) will have a total potential to emit of approximately 43.8 tons of sulfur oxides (SOx), 8.4 tons of nitrogen oxides (NOx), 4.4 tons of carbon monoxide, 4.4 tons of volatile organic compounds (VOC), 2.1 tons of particulate matter less than 10 microns (PM-10), and 2.0 tons of total hazardous air pollutants (HAP) per year.

 The Plan Approval will be subject to the Compliance Assurance Monitoring provisions of 40 CFR Part 64, and will contain additional testing, monitoring, reporting, recordkeeping and work practice requirements designed to keep the facility operating within all applicable air quality requirements. Copies of the application, DEP's analysis, and other documents used in the evaluation are available for public inspection between the hours of 8 a.m. and 4 p.m. weekdays at the address shown below.  Anyone wishing to provide DEP with additional information they believe should be considered may submit the information to the address shown below. Comments must be received by the Department within 30 days of the last day of publication. 63-00968A: MarkWest Liberty Midstream and Resources, LLC (1515 Arapahoe Street Tower 2, Suite 700, Denver, CO 80202-2126) for installation and initial temporary operations of eight (8) new rich burn natural gas-fired compressor engines and the increased capacity of a currently authorized dehydrator at the MarkWest Liberty Midstream and Resources, LLC Smith Compressor Station in Smith Township, Washington County.

 In accordance with 25 Pa. Code § 127.48, the Department of Environmental Protection (DEP) will hold a public hearing on Wednesday May 1, 2013, from 7:30 to 8:30 p.m. at the Smith Township Municipal Building, 1848 Smith Township State Road, Slovan, PA 15078.

 There will be an open house immediately preceding the public hearing at 6:30 p.m.

 The hearing is to take testimony concerning the Department's intent to issue an Air Quality Plan Approval to allow the installation and initial temporary operations of eight new rich burn natural gas-fired compressor engines and the increased capacity of a currently authorized dehydrator at the MarkWest Liberty Midstream and Resources, LLC Smith Compressor Station located in Smith Township, Washington County. The Department published a separate notice of intent to issue this plan approval in the Pennsylvania Bulletin to allow for public comment regarding this proposal.

 Potential to emit from the facility (including previously authorized sources) is estimated to be 50.1 tons of nitrogen oxides, 56.9 tons of carbon monoxide, 43.6 tons of volatile organic compounds, 5.5 tons of particulate matter, 6.74 tons of total hazardous air pollutants, 1.9 tons of formaldehyde, 0.51 ton of benzene, and 91,607 tons of carbon dioxide equivalents per year. Best available technology for the proposed sources is combusting natural gas, rich burn combustion for each engine controlled by three-way catalysts, good combustion practices including the use of air to fuel ratio controllers and proper maintenance and operation.

Intent to Issue Operating Permits under the Air Pollution Control Act and 25 Pa. Code Chapter 127, Subchapter F.

15-00130: Schramm, Inc, (800 East Virginia Avenue, West Chester, PA 19380-4430) for a Renewal, Non-Title V Facility, State-Only, Synthetic Minor Permit in West Goshen Township, Chester County. Schramm, Inc. is an industrial manufacturing plant where mobile drill rigs for water and mineral exploration are designed and manufactured. The facility has taken individual site level restrictions of 22.3 tons per year for NOx, VOC and combined HAP emissions. The emission restrictions will ensure that Schramm Inc remains under the emission thresholds. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.

15-00051: Allan A. Myers, L.P.—d/b/a Independence Construction Materials,—Devault Asphalt Plant (Route 29, (Devault) Charlestown Twp., PA 19432) for a non-Title V, State Only, Synthetic Minor operating permit in Charlestown Township, Chester County. This action is a renewal of the State Only Operating Permit. The permit was initially issued on 5-21-2008 and will expire on 9/30/2013. The Allan A. Myers Devault Asphalt Plant consists of counter-flow drum mix asphalt plant, with a rated capacity of 450 tons per hour (tph) and an aggregate drum dryer/burner that uses natural gas as the primary fuel and No. 2 fuel oil as the backup fuel. The plant utilizes a combination baghouse/cyclone for control of particulate matter emissions. The plant also has a recycled asphalt pavement (RAP) crusher, rated at 250 tph. The renewed permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

Northeast Region: Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711-0790

40-00050: Pioneer Aggregates, Inc. (202 Main Street, Laflin, PA 18702) for operation of a stone crushing and screening operation in Dennison Township, Luzerne County. The operation consists of a one jaw crusher and three cone crushers with water sprays for control of particulate emissions. This is a renewal of a State-Only operating permit. The State-Only operating permit includes emissions, work practice standards and testing, monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

54-00001: Guilford Mills, Inc. (1754 NC Highway 903 Kenansville, NC 28439) to issue a renewal State Only (Synthetic Minor) Operating Permit to Guilford Mills Inc., for their Penn Dye and Finishing Plant in Pine Grove Borough, Schuylkill County. The sources at the facility include three boilers, one hot water heater, five tenter frame and mix tank sources, one textile fabric dyehouse & mixing area, and one face finishing operation. Reported emissions for year 2011 from the facility include carbon monoxide (CO)—1.05 tpy, nitrogen oxides (NOx)—7.34 tpy, particulate matter (PM10)—1.72 tpy, sulfur oxides (SOx)—1.76 tpy, and volatile organic compounds (VOC)—8.29 tpy, which are below the major emission thresholds. The facility is taking elective restrictions in emissions, fuel and throughput to maintain Synthetic Minor status. The proposed State Only (Synthetic Minor) Operating Permit contains applicable requirements for emissions limitations, monitoring, record keeping, reporting and work practice standards designed to ensure facility compliance with Federal and State air pollution regulations.

 The subject facility has actual emissions around 2.7 tpy VOC, 1.0 tpy of combined HAPs & 0.5 tpy of a single HAP. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.

 The subject facility has actual emissions of one tpy of VOC. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include provisions derived from 25 Pa. Code § 129.52 (Surface Coating Processes) and 40 CFR 63 Subpart HHHHHH (National Emission Standards for Hazardous Air Pollutants for Paint Stripping and Miscellaneous Surface Coating at Area Sources).

 In accordance with 25 Pa. Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) has received an application and intends to issue a renewal of an Air Quality Operating Permit for the abovementioned facility.

 The subject facility had the following actual emissions in 2011: 42.8 tons VOC; 29.1 tons PM10; 14.5 tons PM2.5; 1.2 tons NOx; 0.4 ton SOx; 33.7 tons CO2; and 33.7 tons CO2e. The Operating Permit will include emission limits and work practice standards along with testing, monitoring, record keeping and reporting requirements to ensure the facility complies with all applicable air quality regulations. All foundry operations are subject to 40 CFR Part 63, Subpart ZZZZZ—National Emission Standards for Hazardous Air Pollutants for Iron and Steel Foundries Area Sources.

 In accordance with 25 Pa. Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) has received an application and intends to issue an Air Quality Operating Permit for the abovementioned facility.

 The subject facility has actual emissions around 1.1 tpy PM10, 16.5 tpy of CO, 1.2 tpy NOx, 2.0 tpy SOx, & 0.3 tpy VOC. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include provisions derived from 40 CFR 60, Subpart I—Standards of Performance for Hot Mix Asphalt Facilities & 40 CFR 60, Subpart OOO—Standards of Performance for Nonmetallic Mineral Processing Plants.

In accordance with 25 Pa. Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) has received an application and intends to issue a renewal of an Air Quality Operating Permit for the abovementioned facility. The subject facility has the following potential emissions: 11.89 TPY of NOx; 2.97 TPY of CO; 42.20 TPY of SOx; 40.09 TPY of PM/PM10, 0.61 TPY of VOC/total HAPs and 13,646 TPY of GHGs. The operating permit will include emission limits and work practice standards along with testing, monitoring, record keeping and reporting requirements to ensure the facility complies with all applicable air quality regulations.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapter 77 are as follows:

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d).
