Service of Notice of Motor Carrier Applications

 The following temporary authority and/or permanent authority applications for the right to render service as a common carrier or contract carrier in this Commonwealth have been filed with the Pennsylvania Public Utility Commission. Formal protests and petitions to intervene must be filed in accordance with 52 Pa. Code (relating to public utilities). A protest shall indicate whether it applies to the temporary authority application, the permanent authority application, or both. Filings must be made with the Secretary, Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105-3265, with a copy served on the applicant by March 25, 2013. Documents filed in support of the applications are available for inspection and copying at the Office of the Secretary between 8 a.m. and 4:30 p.m., Monday through Friday, and at the business address of the respective applicant.

Applications of the following for approval to begin operating as common carriers for transportation of persons as described under each application.

A-2012-2332927. Revised Golden Bridges Senior Services, LLC (904 Warrendale Village Drive, Warrendale, Allegheny County, PA 15086)—for the right to begin to transport, as a common carrier, by motor vehicle, persons in paratransit service, from points in the Counties of Allegheny, Armstrong, Beaver, Butler, Washington and Westmoreland, to points in Pennsylvania, and return.

A-2012-2333982. ETA Priority Transport, Inc., (2350 McKean Street, Philadelphia PA 19145), for the right to begin to transport as a common carrier, by motor vehicle, persons in paratransit service between points in the City and County of Philadelphia, excluding areas under the jurisdiction of the Philadelphia Parking Authority.

A-2012-2334078. Mahlon R. Diller (7700 Scenic Drive, Shippensburg, PA 17257), for the right to begin to transport as a common carrier, by motor vehicle, persons in paratransit service, from the County of Franklin to points in Pennsylvania, and return.

A-2012-2334208. Luxe Limousine Services, Inc. (2223 South 20th Street, Philadelphia, PA 19145) for the right to begin to transport, as a common carrier, persons in limousine service, from points in the Counties of Bucks, Chester, Delaware, Montgomery and Philadelphia to points in Pennsylvania, and return.

A-2012-2336002. Mae E. Mosser (232 Masser Road, Allenwood, Union County, PA 17810)—for the right to begin to transport, as a common carrier, by motor vehicle, persons in paratransit service, limited to persons whose personal convictions prevent them from owning or operating motor vehicles, from points in Lancaster County, to points in Pennsylvania, and return.

Herbert Jeffries (463 Swamp Road, Morgantown, Lancaster County, PA 19543)—for the right to begin to transport, as a common carrier, by motor vehicle, persons in paratransit service, limited to persons whose personal convictions prevent them from owning or operating motor vehicles, from points in Lancaster County, to points in Pennsylvania, and return.

Derrick John Cimini (5670 South Route 44 Hwy, Jersey Shore, PA 17740) for the right to begin to transport, as a common carrier, by motor vehicle, persons in group and party service, in vehicles seating 11 to 15 passengers, including the driver, from points in Lycoming County, to points in Pennsylvania, and return.

And Ex Cor (530 Lawler Street, Philadelphia, PA 19116) for the right to begin to transport, as a common carrier, by motor vehicle, persons, upon call or demand, to and/or from points within Bristol, Chalfont, Churchville, Croydon, Doylestown, Dublin, Eddington, Fairless Hills, Feasterville, Forest Park, Ivyland, Langhorne, Levittown, Morrisville, New Hope, Newtown, Penndel, Perkasie, Richboro, Trevose, Warminster, Yardley all in Bucks County; and in Ambler, Ardncore, Blue Bell, Bridgeport, Bryn Athyn, Bryn Mawr, Collegeville, Conshohocken, Eagleville, East Greenville, Flourtown, Fort Washington, Glasgow, Glenside, Hatboro, Hatfield, Horsham, Jenkintown, King of Prussia, Kulpsville, Lansdale, Maple Glen, Norristown, North Wales, Oreland, Plymouth Meeting, Pottstown, Skippack, Washington Hill, Willow Grove, all in Montgomery County: excluding all services that are under the jurisdiction of the Philadelphia Parking Authority.

A-2012-2338683. Twin Valley Medical Transport, Inc. (P. O. Box 858, Morgantown, PA 19543) for the right to begin to transport, as a common carrier, by motor vehicle, persons, in paratransit service, from points in Berks, Lancaster, and Chester Counties, to points in Pennsylvania, and return.

A-2012-2338326. MTR Transportation, Inc., t/a K-Cab Co. (6725 Keefers Lane, Bloomsburg, PA 17815) for the right to begin to transport, as a common carrier, by motor vehicle, persons in group and party service, in vehicles seating 11 to 15 passengers, including the driver, between points in the Counties of Columbia and Montour: the Borough of Riverside, Northumberland County; the Borough of Nescopeck and the Townships of Salem and Nescopeck, Luzerne County, and from points in said counties, boroughs and townships to points in Pennsylvania, and return; excluding areas under the jurisdiction of the Philadelphia Parking Authority. (17 Corning Street, Lock Haven, Clinton County, PA 17745)—for the discontinuance of service and cancellation of the certificate as a common carrier, by motor vehicle, persons in limousine service between points in the City of Lock Haven, the Boroughs of Flemington, Mill Hall, Beech Creek, Avis, Loganton and Renovo, and the Townships of Dunnstable, Allison, Bald Eagle, Woodward, Castanea, Beech Creek, Colebrook, Grugan, Lamar, Pine Creek, Logan, Greene, Porter and Wayne, all located in the County of Clinton, and from points in said territory, to points in Pennsylvania, and return.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation & Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation & Enforcement Prosecutory Staff hereby represents as follows:

 1. That Major Tours, Inc., respondent, operates its business from 751 Cypress St., Lansdowne, PA 19050.

 2. That respondent was previously certificated as a Group and Party 16 or Greater carrier at Docket A-00104867, prior to cancellation on February 13, 2001.

 3. That on October 13, 2012, carrier did provide transportation from points in Philadelphia, PA 19144, to the Mount Airy Casino located in Mount Pocono, PA 18344, for $875.00 in compensation, while not holding authority to do so.

 4. That respondent, in performing the acts described in Paragraph 3 of this complaint, violated the Public Utility Code, 66 Pa.C.S. § 1101, in that respondent provided transportation for compensation between points in the Commonwealth of Pennsylvania while not holding a certificate of public convenience issued by this Commission. The penalty is $1,000.00. Future violations may result in possible criminal prosecution with penalties up to $10,000.00 and one year in prison.

Wherefore, the Bureau of Investigation and Enforcement's Prosecutory Staffs hereby requests that the Commission fine Major Tours, Inc., the proposed civil penalty of one thousand dollars ($1,000.00) for the illegal activity described in this complaint and order such other remedy as the Commission may deem to be appropriate.

 Your payment is an admission that you committed the alleged violation and an agreement to cease and desist from further violations. Upon receipt of your payment, the complaint proceeding shall be closed. In such case, to prevent the suspension of your vehicle registration(s), you must file an application for authority with the Secretary of the Commission, P. O. Box 3265, Harrisburg, PA 17105 3265. If no application is received within the twenty (20) day time period, the Bureau of Investigation and Enforcement will proceed with the request for suspension of your vehicle registration(s). Your response should be directed to the Compliance Office, Bureau of Technical Utility Services, P. O. Box 3265, Harrisburg, Pennsylvania 17105 3265.

 D. If you file an Answer which admits or fails to deny the allegations of the Complaint, the Bureau of Investigation and Enforcement will request that the Commission issue a Secretarial Letter imposing the penalty proposed in the Complaint.

 E. If you file an Answer which contests the Complaint, the matter will be assigned to an Administrative Law Judge for hearing and decision. The judge is not bound by the optional fine set forth in the Complaint.
