PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Notice of Proposed Interim Response
Kwiatkowski Landfill Site
Hickory Township, Lawrence CountyThe Pennsylvania Department of Environmental Protection (''Department''), under the authority of the Hazardous Sites Cleanup Act, 35 P.S. Section 6020.101 et. seq. (''HSCA''), has determined that an interim response is necessary at the Kwiatkowski Landfill Site (''site''). The site is located approximately one mile east of the city of New Castle in Hickory Township, Lawrence County, Pennsylvania, on the north side of County Line Road.
The site consists of an approximately 85-acre abandoned mixed waste landfill, currently owned by the estates of brothers, Rudolph and Chester Kwiatkowski. The site lies to the north of County Line Road. An industrial area is located at the main entrance to the site. The main disposal area is located 100 feet west of the industrial area. Part of the site has three waste disposal impoundments, located in the southwest corner of the site, immediately adjacent to County Line Road. The impoundments are accessed from County Line Road via an access road. Two of these areas (''sludge lagoon 1 & 2'') contain industrial sludge wastes. Each lagoon measures approximately 40 feet by 15 feet by 5 feet deep. A third area (''pottery waste impoundment'') previously contained pottery waste which has degraded over time. The pottery waste impoundment measures approximately 90 feet by 40 feet by 1 foot. Collectively, sludge lagoons 1 & 2 and the pottery waste impoundment are identified as Operable Unit 1. Operable Unit 1 is the subject of this response.
In, 1985, 1987 and 1993 the United States Environmental Protection Agency (''USEPA'') conducted environmental investigations at the Site that included sampling the wastes and sediments in Operable Unit 1. In 1995, 1996 and 2004, the Department also investigated and sampled surface wastes and surface water at Operable Unit 1 the site.
These investigations revealed elevated levels of chlorinated solvents, and aromatic compounds. Specifically, soils and sediments in Operable Unit 1 contained high concentrations trichloroethylene, xylene, 1,1,2,2-tetra-chloroethane, 1,1,2-trichloroethane, 1,2-dichloroethene, 1,2-dichloropropane, benzene, bromodichloromethane, carbon tetrachloride, chloroform, methyl chloride, tetra-chloroethene, toluene, vinyl chloride, 2,4-dinitrophenol, bis(2-chloroethyl)ether, hexachlorobenzene, m-nitro-aniline, N-nitrosodi-N-propylamine, and pentachloro-phenol. Several heavy metals, including lead, arsenic were also detected over the Statewide Health Standards for Residential Direct Contact pursuant to the Pennsylvania Land Recycling and Environmental Remediation Standards Act (''Act 2'').
These elements and chemical compounds are ''hazardous substances'' pursuant to Section 103 of the HSCA, 35 P.S. § 6020.103. The presence of these hazardous substances in Site surface water, sediment, and waste and soil constituted a ''release'' and ''threatened release'' of hazardous substances at the Site pursuant to Section 103 of the HSCA, 35 P.S. § 6020.103.
The Department's two main objectives of the interim response action proposed for the site were: 1) to protect the public and environmental receptors from direct contact and inhalation risks with site-related hazardous substances, and 2) to eliminate the ongoing release and threat of release of hazardous substances into the environment from contaminated soil.
The Department considered three alternatives for the interim response: 1) no action, 2) fencing Operable Unit 1, and 3) excavation and removal of wastes contained in Operable Unit 1 and associated contaminated soils for proper off-site disposal.
In light of the above objectives, the Department evaluated each alternative to determine: (1) the extent to which each alternative protects the public health and the environment; (2) the extent to which each alternative is feasible, effective, implementable and permanent; (3) the relative cost of each alternative; and (4) the extent to which each alternative complies with or otherwise addresses the cleanup standards of Act 2, Pennsylvania Solid Waste Management Act, the Pennsylvania Clean Streams Law, and other Applicable or Relevant and Appropriate Requirements (''ARARs''); the extent to which each alternative was feasible, effective, implementable and permanent; and the relative cost effectiveness of each alternative.
Pursuant to Section 505(b) of HSCA, 35 P.S. § 6020.505(b), the Department proposes Alternative 3 as the interim response at the site. Alternative 3 is proposed because it would, in the most cost effective manner, protect the public and environmental receptors from direct contact with site-related hazardous substances and eliminate the ongoing release and threat of release of hazardous substances into the environment.
The response protects the public health and environment; complied with or otherwise addressed all ARARs relating contaminated soil removal and disposal, was feasible, implementable, permanent and effective to the maximum extent practicable; and was cost effective. The proposed action addressed the identified immediate threats to human health and the environment.
The proposed interim response is not a final remedial response pursuant to Section 504 of HSCA, and, therefore, is not required to meet the cleanup standards that apply to final remedial responses. However, the proposed alternative is consistent with any potential future remedial actions and future investigation activities.
This notice is being provided pursuant to Section 506(b) of HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment. The administrative record is located at the Department's Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335, and is available for review Monday through Friday from 8:00 a.m. to 4:00 p.m. Please telephone for an appointment at: 814-332-6648.

The meeting's purpose will be for the Department to answer the public's questions concerning the response at the site. The meeting will be held at Laurel high School, located at 2497 Harlansburg Road, New Castle, PA 16101. Also, the public will have an opportunity to present oral comments, for inclusion into the administrative record, regarding the proposed interim response, at a public hearing following the public meeting.

Code § 127.462(h), the Department of Environmental Protection (DEP) is hereby providing notice that on June 19, 2013, DEP issued a modified Air Quality Title V Operating Permit (TVOP) to Greenridge Reclamation, LLC. MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.
A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapter 77 are as follows:

Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
Coal NPDES Draft Permits

The following additional requirement applies to this draft permit:
Compliance Schedule
(1) The Department has determined that the water quality based effluent limitations (WQBEL) identified above for outfalls 005, 007, 008, 009, 023, 025, 026, and 027 are necessary to fulfill the present requirements of the Casselman River TMDL.
(2) Whereas the final WQBEL set out above for outfalls 005, 007, 008, 009, 023, 025, 026, and 027 are significantly more stringent than past effluent limits for those outfalls, and whereas the final effluent limits cannot be met without modifications to the existing treatment facilities, the permittee shall comply with the interim effluent limits set forth above during the compliance period and shall comply with the following paragraphs. If a new or revised Casselman River TMDL, when completed and approved by EPA, results in final WQBEL limits that are different than the final limits set forth above, the Department will modify this permit and compliance schedule accordingly. The permittee shall:
a. Within the first year following permit issuance, conduct an evaluation of the existing treatment facilities for Outfalls 005, 007, 008, 009, 023, 025, 026, and 027 and determine what modifications are required for each facility to meet the final effluent limitations set out above. By the end of the first year following permit reissuance, the permittee shall submit a report to the Department evaluating the treatment options and identifying the facility modifications required to meet the final WQBEL set out above.
b. As part of the report described in paragraph (a), the permittee shall also submit a Treatment Plan to the Department for approval including specifications of the facility modifications, proposed schedule for construction, and demonstration that construction will be performed as soon as possible. In addition, the permittee shall submit complete applications for all permits or permit amendments necessary to install and operate the modifications to the Department for review. Following approval of the Treatment Plan and issuance of all necessary permits for the facility modifications, construction of the revised treatment systems shall commence no later than fifteen months after reissuance of this NPDES permit. Construction and start-up of the facility modifications shall be completed, and attainment of the final WQBEL set forth above for Outfalls 005, 007, 008, 009, 023, 025, 026, and 027 shall be achieved, by no later than eighteen months after reissuance (renewal) of this NPDES permit.
(3) The permittee shall implement the treatment facility modifications necessary to achieve the final WQBEL set out above according to the following compliance schedule:
a. Submit a report describing its evaluation of treatment facility
modification which will assure compliance with the final
effluent limitations.As soon as possible, but no later
than within 1 year of permit
reissuance.b. Submit a treatment plan and complete applications for all
permits necessary for the treatment equipment to the
Department for approval.As soon as possible, but no later
than within 1 year of permit
reissuancec. Commence construction of system modifications required to
meet the final WQBELS.As soon as possible, but no later
than within 15 months of permit
reissuance.d. Complete treatment plant modifications /additions.
Compliance with final limits.As soon as possible, but no later
than within 18 months of permit
reissuance.e. Submit progress reports. Reports shall include updates,
attainment, or any progress made toward milestones, summary
of results of any supplemental sampling and a discussion of
compliance or non-compliance with interim and final
requirements.Every 6 months after permit
reissuance until completion of the
compliance period.(4) a. Pursuant to 40 CFR 122.62, the permittee may make request to the Department for approval of a modification of the time period for completing step (d) of the compliance schedule in the table above (completion of construction and start-up of the treatment facility modifications within eighteen months of NPDES permit reissuance). The permittee's request for approval of a modification must demonstrate that the respective compliance schedule step cannot be completed within the prescribed time period. The permittee shall also provide an alternative time frame for completion of construction and start-up of the treatment technology; the alternative must be based on completing construction as soon as possible. The permittee's economic inability to comply with any of the obligations of this Compliance Schedule shall not be grounds for any extension of time.
b. The permittee shall submit a request for modification of the compliance schedule pursuant to this paragraph in writing to the Department within 10 working days of the date the permittee becomes aware or reasonably should have become aware of the event impeding performance. The written submission shall include all necessary documentation specifying the reasons for the delay, the expected duration of the delay, and the efforts which have been made and are being made by the permittee to mitigate the effects of the event and to minimize the length of the delay. The initial written submission may be supplemented within ten working days of its submission.
c. The Department will decide whether to grant all or part of the extension requested on the basis of all documentation submitted by the permittee and any other information available to the Department and will notify the permittee in writing of its decision. In any subsequent litigation, Rosebud Mining Company shall have the burden of proving that the Department's refusal to grant the requested extension was an abuse of discretion based upon the information then available.
NPDES No. PA0234877 (Mining permit no. 56980107), AMFIRE Mining Co., LLC, One Energy Place, Latrobe, PA 15650, revised NPDES permit for a bituminous surface mine in Milford Township, Somerset County, affecting 222.1 acres.
