LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Property at 3419 Ritner Highway, West Pennsboro Township, Cumberland County. Teleflex / Former Arrow International Facility, 1001 Hill Avenue, Wyomissing, PA, Wyomissing Borough, Berks County. Langan Engineering & Environmental Services, Inc., 30 South 17th Street, Philadelphia, PA 19103, on behalf of Arrow International, Inc., 155 South Limerick Road, Limerick, PA 19468, submitted a Notice of Intent to Remediate site soils and groundwater contaminated with VOCs, chlorinated solvents, and metals. The site will be remediated to a combination of Residential Statewide Health and Site-Specific standards. Future use of the site will remain commercial/industrial. Northwest Region: Environmental Cleanup & Brown-fields Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

Marathon New Castle Site (MPC No. 3670), 718 East Washington Street, City of New Castle, Lawrence County. ARCADIS U.S., Inc., 310 Seven Fields Boulevard, Seven Fields, PA 16046, on behalf of Marathon Petroleum Company, submitted a Notice of Intent to Remediate. AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

PLAN APPROVALS

Northeast Region: Air Quality Program, 2 Public Square, Wilkes Barre, PA 18711-0790

40-00007A: Bemis Co., Inc. (20 Jaycee Drive, West Hazleton, PA 18202) for installation of a new flexographic printing press at their Bemis Performance packaging facility in West Hazleton Borough, Luzerne County.

 In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to Bemis Company, Inc. (20 Jaycee Drive, West Hazleton, PA 18202) for their Bemis Performance packaging facility in West Hazleton Borough, Luzerne County. This Plan Approval No. 40-00007A will be incorporated into a Title V Permit through an administrative amendment at a later date.

 Plan Approval No. 40-00007A is for the installation of one new flexographic printing press utilizing a currently existing catalytic oxidizer (C08) to control VOC emissions at their facility. The estimated increase in VOC emissions for this source is 54.1 Tons/year. The Plan Approval will contain additional recordkeeping, testing and operating restrictions designed to keep the facility operating within all applicable air quality requirements. The facility currently has a Title V Operating Permit No. 40-00007. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.

 Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711.

 Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to the address shown in the preceding paragraph. Each written comment must contain the name, address and telephone number of the person submitting the comments, identification of the proposed permit No. 40-00007A and concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 A public hearing may be held, if the Department of Environmental Protection, in its discretion, decides that such a hearing is warranted based on the comments received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or the Pennsylvania Bulletin or by telephone, where DEP determines such notification is sufficient. Southeast Region: Air Quality Program, 2 East Main Street, Norristown, PA 19401

46-0001: JBS Souderton, Inc. (741 Souder Road, Souderton, PA 18964) for installation of a new 48.28 MMBtu/hr gaseous-fired Johnston Boiler (Source ID 040) at the rendering plant in Franconia Township, Montgomery County. The boiler will be equipped with a low-NOx boiler and flue gas recirculation. JBS is a major source of Nitrogen Oxide (NOx) emissions, currently operating under TVOP No. 46-00001. The installation will not trigger New Source Review or Prevention of Severe Deterioration for any criteria pollutant, including Greenhouse Gases. The source is not subject to Compliance Assurance Monitoring pursuant to 40 CFR Part 64 because the potential pre-control NOx emissions are less than the major facility threshold for the Philadelphia Consolidated Metropolitan Statistical Area (25 tpy). The plan approval will include monitoring, testing, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

09-00053: Greif Packaging LLC (695 Louis Drive, Warminster, PA 18974) for the following changes at its existing steel drum manufacturing facility in Warminster Township, Bucks County:

 - Modification of the volatile organic compound (''VOC'')/hazardous air pollutant (''HAP'') emission capture and control system.

 - Installation of a new regenerative thermal oxidizer (''RTO'') and the removal of an existing RTO (Source ID C05 in State Only Operating Permit No. 09-00053).

 - An increase to the total operating time for the three spray booths and three associated (dedicated) bake ovens from 5,600 hours per year (on a 12-month rolling basis) to 6,600 hours per year (on a 12-month rolling basis).

 The facility is currently permitted under State Only (Synthetic Minor) Operating Permit No. 09-00053. Since the DEP renewed the State Only Operating Permit (''SOOP'') in 2008, Greif Packaging LLC modified the VOC emission capture and control system at the facility, such that the actual emissions of xylene, a HAP, have exceeded 10 tons/yr (on a 12-month rolling basis), the major facility threshold. As a result, the facility's status has changed from State Only to Title V, and the affected coating operations at the facility (i.e., the aforementioned spray booths and bake ovens, a silk screen machine, an inkjet printer, an adhesives operation, and all associated cleanup operations) have become subject to the provisions of 40 CFR Part 63, Subpart MMMM. These changes will be reflected in the Plan Approval, which is intended to supersede the SOOP for all sources except the existing RTO.

 To demonstrate compliance with the applicable organic HAP emission restriction from 40 CFR Part 63, Subpart MMMM (i.e., 0.31 kg/L coating solids [2.6 lbs/gal coating solids] for general use coatings), for the affected coating operations at the facility, Greif Packaging LLC has elected to use the emission rate without add-on controls option as the compliance option for all affected coating operations. Greif Packaging LLC's subsequent conversion (from when the VOC/HAP emission capture and control system at the facility was modified) to lower-VOC/HAP-content coatings is integral to the affected coating operations complying with the organic HAP emission restriction.

 Greif Packaging LLC has elected to restrict VOC emissions from the facility to less than 21 tons/yr and HAP emissions from the facility to less than 10 tons/yr for any individual HAP and less than 21 tons/yr for total HAPs. While this will not serve to change the facility's status as Title V or being subject to the provisions of 40 CFR Part 63, Subpart MMMM, it will ensure that the facility will not be subject to the Compliance Assurance Monitoring (''CAM'') requirements of 40 CFR Part 64 whenever the Plan Approval is incorporated into a Title V Operating Permit.

 The Plan Approval will include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

Northcentral Region: Air Quality Program, 208 West Third Street, Williamsport, PA 17701

14-00003F: Pennsylvania State University (Office of Physical Plant Building Room 101P, University Park, PA 16802) for a plan approval for a West Campus Steam Plant (WCSP) Improvement Project proposal at the WCSP which is located on the University Park Campus located in College Township, Centre County. This project's proposal consists of replacing two (2) coal-fired units with natural gas-fired, removing the old gas-fired boiler (Boiler No. 5) and converting two (2) existing coal-fired units to fire solely natural gas as fuel for operation in order to reduce the potential to emit levels of hazardous air pollutants (HAP) emissions below the major source of HAP thresholds, 10/25 tons per year for single HAP and combined HAP, respectively. As applicable and set forth in the following regulatory requirements, the application is subject to the best available technology (BAT) provisions of 25 Pa. Code §§ 127.1 and 127.12 apply to the new units that will replace Boiler No. 1 and 2. The details about the level of potential to emit for the air contaminants emissions from the new gas-fired units can be found below in the list of conditions for the proposal.

 The proposed boilers' emissions are also subject to National Standards of Performance for Stationary Industrial Boilers as codified in 40 CFR Part 60 Subpart Db. Additionally, the gas-fired unit criteria, as specified in 40 CFR 63.11195(e) apply to the new boilers by the permittee electing to fire the new boilers on distillate oil as per the gas-fired unit criteria specified in 40 CFR 63.11237. Firing on distillate oil will be restricted to local emergency gas curtailments and maintenance testing limited to 48 hours per year. The Department has determined that the proposed levels of the air contaminants emissions satisfy MACT requirements as well as the Department's BAT requirements.

 The stationary emergency generator sources specified in the proposal are subject to the National Standards of Performance for Stationary Spark-Ignited and Compress- ion Ignited Engines that are codified in 40 CFR Part 60 Subpart JJJJ and Subpart IIII, respectively. In addition, the stationary emergency generator sources are subject to the National Emission Standards of Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines that is codified 40 CFR Part 63 Subpart ZZZZ. The Department has determined that the proposed sources meet all applicable air quality regulatory requirements.

 The Department's review of the information submitted by Pennsylvania State University indicates that the proposed sources will meet all applicable air quality regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including the Department's BAT requirements of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department intends to approve the application and issue a plan approval for the construction and operation of the sources specified in this proposal for the WCSP Improvement Project. The facility is a major (Title V) facility. The project will lower the level of potential to emit for hazardous air pollutant (HAP) emissions below the major source thresholds. If the Department determines that the sources are constructed and operating in compliance with the plan approval conditions and the specification of the application for Plan Approval 14-00003F, the requirements established in the plan approval will be incorporated into Title V Operating Permit 14-00003 by the administrative amendment provisions pursuant to 25 Pa. Code § 127.450. The following is a summary of the conditions that the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable air quality regulatory requirements:

 1. Effective on the date of start-up of Source ID 031B (New Boiler No. 1), the operation of the boilers associated with Source IDs 034 and 035 shall not emit air contaminants at rates in excess of the following limitations: (1) 0.28 pound per million British thermal units (lb/MMBtu) of heat input and 27.44 tons in any 12 consecutive month period for NOx (expressed as NO2); (2) 0.084 lb/MMBtu of heat input and 8.23 tons in any 12 consecutive month period for CO; (3) 0.0056 lb/MMBtu of heat input and 0.56 ton in any 12 consecutive month period for VOC (inc.H2CO); (4) 120 lb/MMBtu of heat input and 11,832 tons in any 12 consecutive month period for CO2; (5) 0.008 lb/MMBtu of heat input and 0.74 ton in any 12 consecutive month period for total PM10; (6) 0.008 lb/MMBtu of heat input and 0.74 ton in any 12 consecutive month period for total PM2.5.

 2. Effective on the date of start-up of Source ID 031B, the permittee shall only fire pipeline-quality natural gas in the boilers associated with Source IDs 034 and 035.

 3. Effective on the date of start-up of Source ID 031B, the firing of natural gas in the boilers associated with Source IDs 034 and 035 shall never exceed 196,000 MMBtu of heat input in any 12 consecutive month period.

 4. (a) Effective on the date of start-up of Source ID 031B, the permittee shall conduct EPA reference method performance testing on the exhaust of each of the boilers associated with Source IDs 034 and 035 within 180 days of resuming operation after the physical changes as specified in Plan Approval 14-00003F application are completed in order to verify compliance with the restrictions for nitrogen oxide, carbon monoxide, volatile organic compounds (inc. formaldehyde) and carbon dioxide emissions.

 (b) The tests shall be completed by using only methods and procedures that are acceptable to the Department.

 5. Beginning on the day(s) when each of the performance tests for Source IDs 034 and 035 is conducted, the permittee shall operate the tested boiler(s) at maximum capacity for at least 24 consecutive hours to verify the maximum heat input rating capacity of each of the boilers associated with Source IDs 034 and 035 does not exceed 49 MMBtu/hr.

 6. As part of the fuel delivery system installation associated with the West Campus Steam Plant Improvement Project, the fuel delivery system associated with the boilers incorporated in Source IDs 034 and 035 shall be equipped with alarms for continuously monitoring the maximum operating pressure to the inlet of each boiler's burner.

 7. Effective on the date of start-up of Source ID 031B, the permittee shall obtain and maintain fuel receipts (such as a current, valid purchase contract, tariff sheet, or transportation contract) from the natural gas supplier that certify that the fuel for operation of Source IDs 034 and 035 meets the potential SO2 emissions.

 8. Effective on the date of start-up of Source ID 031B, the permittee shall keep records of the following for each of the boilers associated with Source IDs 034 and 035:

 (1) The total number of hours operated per month

 (2) The total amount of natural gas consumed per month

 (3) The total amount of natural gas consumed in each 12 consecutive month period

 (4) Monthly and 12-month rolling emissions

 9. The permittee shall perform annual tune-ups on each of the boilers associated with Source IDs 034 and 035 to minimize the unit's nitrogen oxide emissions. These tune-ups shall be performed within 12 months (+/- 1 month) of the unit's previous tune-up.

 10. (a) Upon completion of the changes as described in the supplemental information provided for Plan Approval 14-00003F application, the boilers incorporated into Source IDs 034 and 035 shall each be de-rated to a maximum heat input rating capacity equal to 49 MMBtu/hr and equipped to fire natural gas only as described in the supplemental information provided for Plan Approval 14-00003F application.

 (b) The permittee may elect to not operate the boiler(s) prior to the commencement of operation date to satisfy the requirement above as long as after the date of temporary shutdown, the boilers shall not be fired until the changes for de-rating the boilers as described in the supplemental information for Plan Approval 14-00003F application are completed.

 11. Effective on the date of start-up of Source ID 031B, each boiler of Source IDs 034 and 035 is defined to be a gas-fired boiler per the definition of 40 CFR 63.11237 and consequently not subject to the requirements specified in 40 CFR Part 63, Subpart JJJJJJ (National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers Area Sources) pursuant to the provision specified in 40 CFR 63.11195(e).

 12. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, each of the boilers associated with Source IDs 031B and 032B shall not emit air contaminants at rates in excess of the following limitations while firing natural gas: (1) 0.04 lb/MMBtu of heat input for nitrogen oxides, NOx (expressed as NO2); (2) 0.04 lb/MMBtu of heat input for carbon monoxide, CO; (3) 0.007 lb/MMBtu of heat input for total particulate matter (condensable and filterable) having an aerodynamic diameter equal to or less than 10 micrometers (PM10); (4) 0.007 lb/MMBtu of heat input for total particulate matter (condensable and filterable) having an aerodynamic diameter equal to or less than 2.5 micrometers (PM2.5); (5) 0.004 lb/MMBtu of heat input for volatile organic compounds, VOC (expressed as NMVOC); (6) 120 lb/MMBtu of heat input for carbon dioxide, CO2.

 13. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, each of the boilers associated with Source IDs 031B and 032B shall not emit air contaminants at rates in excess of the following limitations while firing distillate oil: (1) 0.10 lb/MMBtu of heat input for nitrogen oxides, NOx (expressed as NO2); (2) 0.04 lb/MMBtu of heat input for carbon monoxide, CO; (3) 0.03 lb/MMBtu of heat input for total particulate matter (condensable and filterable) having an aerodynamic diameter equal to or less than 10 micrometers (PM10); (4) 0.03 lb/MMBtu of heat input for total particulate matter (condensable and filterable) having an aerodynamic diameter equal to or less than 2.5 micrometers (PM2.5); (5) 0.004 lb/MMBtu of heat input for volatile organic compounds, VOC (expressed as NMVOC); (6) 159 lb/MMBtu of heat input for carbon dioxide, CO2.

 14. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the boilers associated with Source IDs 031B and 032B shall not emit hazardous air pollutants in a manner that the rate exceeds 2.8 tons in any 12 consecutive month period.

 15. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the boilers associated with Source IDs 031B and 032B shall not emit air contaminants in excess of the following limitations: (1) 63.0 tons in any 12 consecutive months for nitrogen oxides, NOx (expressed as NO2); (2) 59.0 tons in any 12 consecutive months for carbon monoxide, CO; (3) 12.0 tons in any 12 consecutive months for total particulate matter (condensable and filterable), having an aerodynamic diameter equal to or less than 10 micrometers (PM10); (4) 12.0 tons in any 12 consecutive months for total particulate matter (condensable and filterable), having an aerodynamic diameter equal to or less than 2.5 micrometers (PM2.5); (5) 5.9 tons in any 12 consecutive months for volatile organic compounds, VOC (expressed as NMVOC); (6) 178800 tons in any 12 consecutive month period of greenhouse gas emissions, GHG (expressed as CO2e)

 16. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall not permit the emission into the atmosphere of visible air contaminants in such a manner that the opacity of the emission from the boilers associated with Source IDs 031B and 032B is greater than 10% by using EPA reference Method 9 in appendix A-4 of 40 CFR Part 60.

 17. (a) Pursuant to the provisions of 40 CFR 60.44b, on and after the date on which the initial performance test is completed or is required to be completed under § 60.8, whichever date comes first, no owner or operator that combusts oil or natural gas shall cause to be discharged into the atmosphere from the boilers associated with Source IDs 031B and Source IDs 032B, any gases that contain NOx (expressed as NO2) in excess 0.20 lb/MMBtu. (b) Pursuant to the provisions of 40 CFR 60.44b(h), the NOx emissions restrictions apply at all times including periods of startup, shutdown, or malfunction. (c) Pursuant to the provisions of 40 CFR 60.44b(i), the NOx emissions restriction of 0.20 lb/MMBtu shall be determined on a 30-day rolling average basis.

 18. The provisions under 40 CFR 60.42b(k)(2) and 60.43b(h)(5), which exempts the unit from the SO2 and PM standard of 40 CFR 60.42b and 60.43b, respectively, apply to each of the boilers associated with Source IDs 031B and 032B based on the requirement to only fire natural gas as well as the requirement to only fire distillate oil with maximum, 500 ppm sulfur (by weight) which satisfies the very low sulfur oil requirements specified in 40 CFR 60.41b.

 19. (a) Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall only fire pipeline-quality natural gas in the boilers associated with Source IDs 031B and 032B, except as noted in (b). (b) The permittee may fire distillate oil that contains no more than 0.05 weight percent sulfur if: (1) No waste oil, waste-derived oil, or other waste materials has been added to the distillate oil; (2) Distillate oil firing only occurs during periods of emergency gas curtailments, gas supply interruption and periodic testing; (3) Periodic testing of distillate fuel does not exceed a combined total of 48 hours during any calendar year.

 20. Pursuant to best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, (a) The firing of natural gas in the boilers associated with Source IDs 031B and 032B shall never exceed 2,930,400 MMBtu of heat input in any 12 consecutive month period. (b) The firing of distillate oil in the boilers associated with Source IDs 031B and 032B shall never exceed 152,000 MMBtu of heat input in any 12 consecutive month period. (c) For every 1 MMBtu of heat input from the firing of distillate oil, the heat input associated with firing of natural gas shall be reduced by 1.19 MMBtu.

 21. (a) Pursuant to the provisions of 25 Pa. Code § 127.12b, within 180 days of the commencement of operation of each of the boilers associated with Source IDs 031B and 032B, the permittee shall conduct EPA reference method testing on each respective unit for nitrogen oxides, carbon monoxide, carbon dioxide, volatile organic compounds, total PM10 and total PM2.5 emissions to verify compliance with the emission limitations, including a Method 9 to verify compliance with the opacity limitations. (b) Subsequent EPA reference method testing shall be conducted every year from the date of the previous tests. The testing frequency may be revised based upon the satisfactory demonstration of compliance with the emission limitations. (c) All initial and subsequent stack testing shall be performed at the boiler's maximum routine operating conditions while firing natural gas.

 22. (a) Pursuant to the provisions of 40 CFR60.46b(e), within 60 days after achieving the maximum operating conditions of Source IDs 031B and 032B, but not later than 180 days after initial startup of each boiler, the permittee shall conduct initial performance testing in accordance with the applicable requirements specified in 40 CFR 60.8 and 60.46b(e)(1), including the requirement to use the continuous system during the performance tests.

 (b) The NOx from each of the boilers associated with Source IDs 031B and 032B shall be monitored for 30 successive steam generating unit operating days.

 23. The permittee shall continuously monitor the NOx emissions data collected pursuant to 40 CFR 60.48b(g)(2) to calculate a 30-day rolling average emission rate for each steam generating unit operating day.

 24. (a) In accordance with the provisions of 40 CFR 60.48b, the permittee shall install, maintain and operate a predictive emission monitoring system (PEMS) on the boilers associated with Source IDs 031B and 032B for nitrogen oxides and carbon monoxide emission. The PEMS installation, operation and maintenance procedures shall meet the requirements specified in Chapter 139 of Article III of the Rules and Regulations of the Department of Environmental Protection and the Department's Continuous Source Monitoring Manual.

 25. Pursuant to the provisions of 40 CFR 60.49b(g), the permittee shall maintain accurate and comprehensive records of the information required by § 60.49b(g) for each day that Source ID 031B operates and for each day that Source ID 032B operates (i.e. for each steam generating unit operating day as defined in 40 CFR 60.41b):

 26. (a) The permittee shall obtain and maintain fuel receipts (such as a current, valid purchase contract, tariff sheet, or transportation contract) from the fuel supplier that certify that each shipment of oil for the 25,000-gallon tanks and fired in Source IDs 031B and 032B as well as the natural gas fired in the boilers meets the distillate oil (maximum 500 ppm, by weight) and pipeline-quality natural gas sulfur content requirements, respectively.

 27. (a) The permittee shall keep accurate and comprehensive records for Source IDs 031B and 032B of natural gas and distillate oil firing in the boilers to verify that the units comply with the applicable requirements herein. On a monthly basis, the information kept for the record shall, at least include all of the following along with the supporting documentation as requested by the Department: the amount of natural gas fired for each steam generating unit operating day including the monthly totals and rolling 12-month totals; specific hours during which natural gas is combusted; hourly data (lb/MMBtu) generated by the predictive emission monitoring system; emissions calculations including monthly totals and rolling 12-month totals for NOx, CO, total PM10, total PM2.5, VOC, HAP and GHG emissions.

 28. In accordance with the provisions of 40 CFR 60.46b(e)(4) and 60.49b(h), the permittee shall submit excess emission reports for any excess emissions that occurred during the reporting period on a semiannual basis. The permittee shall include in the semiannual reports a statement certifying that only pipeline-quality natural gas and distillate oil (maximum 500 ppm, by weight) were fired in the boilers associated with Source IDs 031B and 032B during the reporting period.

 29. The permittee shall submit initial notifications in accordance with the provisions of 40 CFR § 60.7.

 30. In accordance with the provisions of 40 CFR 60.69b(c), the permittee shall submit a monitoring plan for the predictive emission monitoring system required for NOx monitoring.

 31. At least 6 months prior to the expected startup of Source ID 032B, the permittee shall submit to the Department for approval a Phase I plan for the PEMS for Source IDs 031B and 032B.

 32. The boilers/steam generating units associated with Source IDs 031B and 032B are subject to Title 40 Part 60 Subpart Db (Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units). The permittee shall comply with all applicable provisions specified in 40 CFR Sections 60.40b—60.49b.

 33. (a) On or prior to the date of start-up of New Boiler No. 2 (Source ID 032B), Boiler No. 2 (Source ID 032) and Boiler No. 5 (Source ID 033) shall be permanently shut down. (b) On or prior to the date of start-up of New Boiler No. 1 (Source ID 031B); (1) Boiler No. 1 (Source ID 031) shall be permanently shut down; (2) Boiler No. 6 (Source ID 034) and Boiler No. 8 (Source ID 035) shall be permanently operating on natural gas and according the maximum schedule and maximum rated capacity specified in Plan Approval 14-00003F and the application (Revision 4) for Plan Approval 14-00003F.

 34. The 20-kW, propane-fired emergency generator is subject to the National Standards of Performance for Stationary Spark-ignited Engines and National Emission Standards of Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines as codified in 40 CFR Part 60 Subpart JJJJ and 40 CFR Part 63 Subpart ZZZZ, respectively. The permittee shall comply with the applicable requirements from the provisions specified in 40 CFR Part 60 Subpart JJJJ and 40 CFR Part 63 Subpart ZZZZ. The generator shall be only operated in a manner to satisfy the requirements of 40 CFR 60.4243(d)(1) through (3). The maximum hours of operation shall never exceed 200 hours in any 12 consecutive month period.

 35. The two (2) 2-MW, diesel fuel-fired emergency generators are subject National Standards of Performance for Stationary Compression-ignited Engines and National Emission Standards of Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines as codified in 40 CFR Part 60 Subpart IIII and 40 CFR Part 63 Subpart ZZZZ, respectively. The permittee shall comply with the applicable requirements from the provisions specified in 40 CFR Part 60 Subpart IIII and 40 CFR Part 63 Subpart ZZZZ. The generators shall be only operated in a manner to satisfy the requirements of 40 CFR 60.4243(d)(1) through (3). The maximum hours of operation shall never exceed 200 hours in any 12 consecutive month period.

32-00427A: Notice is hereby given that the Department of Environmental Protection intends to issue a Plan Approval (PA-32-00427A) to Rosebud Mining Company (301 Market Street, Kittanning, PA 16201) to authorize the construction and temporary operation of a coal preparation plant at their Blairsville Coal Preparation Plant located in Burrell Township, Indiana County. The proposed coal preparation plant is a wet processing facility with the majority of processing taking place within an enclosed building. The wet cleaning process includes a heavy media cyclone, teeter bed separator, and froth flotation.

 The facility's main sources and controls include a Pit Conveyor, Clean Coal Conveyor, Radial Stackers, Double Deck Screen, Stoker Screen, ROM Stockpile, Stoker Product Stockpile, ROM Crusher, Oversize and Clean Coal Stockpiles, Front-end loader, and Truck loadout. Roadways will be controlled by paving and water sprays whereas fugitive emissions from the process will be controlled by water sprays and partial enclosures.

 This facility has the potential to emit the following type and quantity of air contaminants annually: 70.6 tons of PM, 19.8 tons of PM10, 1.5 tons of PM2.5, 30.0 tons of VOC. GHG being minimal is not included. The emission restriction, testing, monitoring, recordkeeping, reporting and work practice conditions of the Plan Approval have been derived from the applicable requirements of 40 CFR Part 60 and 25 Pa. Code Chapters 123 and 127.

 In accordance with 25 Pa. Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) has received an application and intends to issue a renewal of an Air Quality Operating Permit for the abovementioned facility.

 The subject facility had the following estimated actual emissions in 2012: 0.6 ton NOx; 0.6 ton CO; 0.3 ton PM10; 0.3 ton PM2.5; 0.2 ton VOC; 165.0 tons CO2; and 166.0 tons CO2e. The Operating Permit will include emission limits and work practice standards along with testing, monitoring, record keeping and reporting requirements to ensure the facility complies with all applicable air quality regulations.

 A person may oppose the proposed operating permit, or may provide the Department with additional information to consider in its review, or may request a public hearing, by filing a written protest with the Department at the address listed above. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law (35 P. S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a).  The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, state or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.
