NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Plan Description: Approval of a revision to the official plan of East Hanover Township, Lebanon County. The project is known as Mt. Zion School of Ministry. The proposed development is located on the east side of Harrison School Road. The Department's review of the plan revision has not identified any significant impacts resulting from this proposal. The DEP Code Number for this planning module is DEP Code No. A3-38909-189-3 and the APS Id is 811488. Any permits must be obtained in the name of Summit School of Ministry.

Notice of Proposed Interim Response
Secondary Disposal Areas of the Bear Creek Area Chemical Site
Butler and Armstrong Counties

 The Department of Environmental Protection (''Department''), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101—6020.1305) is proposing an interim response at the Jameson, Spitzer Pines, BOI #8, and Wade Parsonville Disposal Areas (referred to collectively as the ''Secondary Disposal Areas'') that make up part of the Bear Creek Area Chemical Site. This response is proposed pursuant to Sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 505(b)).

 The Bear Creek Area Chemical Site (''site'') contains at least twenty-four disposal areas (including the Secondary Disposal Areas) where the Department knows or has evidence to suggest that industrial wastes were historically disposed, and the surface water, groundwater, soils and sediments that have been contaminated from hazardous substances and contaminants that have migrated from the disposal areas. The individual disposal areas make up the Site Operable Unit or OU-1, and are located in Concord, Fairview, Parker, and Washington Townships, Butler County and Perry Township, Armstrong County. The Department has completed cleanup operations on three of the disposal areas (Apple Road, Hemlock Road, and Kelly Farm). Additionally, the Department previously provided approximately 800 homes and businesses with a permanent water system as part of the Groundwater Operable Unit (OU-2) for the site.

 The following hazardous substances have been found in waste and environmental media at the Secondary Disposal Areas: xylene, benzene, acetone, phenols, formaldehyde, methyl ethyl ketone, carbon disulfide, ethyl benzene, nickel, lead, copper, benzene sulfonic acid, meta-benzene disulfonic acid, para-phenol sulfonic acid, barium, cobalt, iron, manganese, zinc, antimony, cadmium, aluminum, vanadium, and arsenic.

 The following remedial action alternatives (Remedial Alternatives) were developed for the Secondary Disposal Areas: 1) No action alternative, which is required for all alternative comparisons; 2) Removal of all wastes (''Excavation and off-site disposal''); 3) Capping of the non-industrial wastes (Jameson Site only); and 4) Fencing the disposal areas (Spitzer Pines, Wade Parsonville, and BOI Site #8 only).

 Alternative 1—This alternative would involve no further action to eliminate or reduce threats posed by the site.

 Alternative 2—Excavation and Off-Site Disposal of All Wastes:

 • Excavation of all wastes and impacted soils;

 • Solidification of liquid wastes;

 • Off-site disposal in an approved facility;

 • Regrading and revegetation of excavated areas.

 Alternative 3—Excavation of industrial wastes containing hazardous substances for off-site disposal and capping of other wastes and impacted soils (Jameson Site only)

 • Excavation/removal and off-site disposal of industrial wastes and impacted soils;

 • On-site disposal of remaining non-industrial wastes beneath a soil cap;

 • Regrading and revegetation of excavation and disposal areas.

 Alternative 4—Fencing the Disposal Areas (Spitzer Pines, Wade Parsonville, and BOI Site #8 only)

 • Placement of permanent steel fencing

 • Placement of ''No Trespassing'' signs on the fence

 Each alternative was evaluated with respect to four comparison criteria of: (1) the extent to which each alternative protects the public health and the environment; (2) the extent to which each alternative complies with or otherwise addresses Applicable or Relevant and Appropriate Requirements (''ARARs''); (3) the extent to which each alternative is feasible, effective, implementable and permanent; and (4) the relative cost of each alternative. The comparative analysis identified advantages and disadvantages of each alternative, so that tradeoffs between the alternatives could be determined.

This alternative is proposed because it would protect the public and environmental receptors from exposure to site-related hazardous substances and eliminate the ongoing release and threat of release of hazardous substances into the environment from the site. Alternative 2 complies with ARARs relating to the action to be taken, is feasible, implementable, permanent, and effective, and is cost effective. Alternative 2 will be consistent with any future investigative activities or remedial response actions that may be needed to achieve a complete and final remedial response for the Jameson Disposal Area.

LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Potential CO emissions shall increase from 5.08 tpy to 87.6 tpy. The permittee shall monitor and record the staged air portion of the combustion air, along with all other existing monitoring and recordkeeping requirements associated with the furnace, to ensure compliance with all applicable emission limits and air quality requirements.

Barry Callebaut USA LLC operates a cocoa processing plant. Sources include a pre-roaster (controlled by a wet cyclone), a winnowing process (controlled by a cyclone), a Roaster and Nib Grinding process (controlled by a regenerative thermal oxidizer), boilers, an emergency generator, a cocoa butter process (non-permitted), lab equipment, and other miscellaneous components for processing cocoa beans into cocoa and cocoa butter. All combustion sources burn natural gas with the exception of the emergency generator, which operates on diesel fuel. Boiler (CBLE200-500) (Source ID 031) is rated at 20.16 MMBtu/hr and is subject to Subpart Dc. The emergency generator (Onan 250DFAC Gen Set) is subject to the requirements of Subpart IIII. Estimated potential emissions from the facility are: 9.28 TPY for NOx, 8.72 TPY for CO, 14.63 TPY for VOC, 12.21 TPY for PM, and less than 1.0 TPY for SOx and HAP. The permit will contain monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality regulations and requirements.

The facility's air emission sources include two (2) paint booths, rail bay open coating, surface coating operations outside paint booths for a motor generator department, two (2) particulate sources, twelve (12) combustion units each rated at less than 2 MMBTU/hr, two (2) cold cleaning degreaser, and two (2) electric insulating varnish tanks. The facility's air emission control devices include two (2) dust collectors, and surface coating filters for particulate capture.

 This permit modifies the VOC and HAP emission limit from the electric insulating varnish tanks. The VOC emission from varnish dip tank is limited to 1.5 lb per gallon and VPI tank emission is limited to 3.2 lbs per gallon. The HAP emissions are limited to 0.2 tpy combined from both electric insulating varnish tanks. The facilities' potential emission will be below the significant thresholds.
