Federal Interstate Consistency for Modification of Letter of Permission to Perform Maintenance Dredging at Conneaut Harbor, Ohio

[Saturday, August 3, 2013]This public notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)). The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that the Buffalo District Army Corps of Engineers (USACE) intends to issue a Modification of a Letter of Permission (LRB-1993-01812) authorizing the Conneaut Port Authority (CPA) to perform maintenance dredging of the Federal Recreational Channel of Conneaut Harbor, located in Ashtabula County, OH. Dredging is currently authorized with a requirement that the recovered dredge material be placed in the nearshore zone immediately to the east of the Conneaut Harbor east wall. The CPA is requesting a modification to allow for open lake disposal of the dredged material based on more recent USACE core sampling within the Federal Recreational Channel which indicates that these sediments are primarily silts and clays with some fine grained sands. The authorized open-lake placement area is located 4 miles from the West Breakwater Light at an azimuth of 314°00`. This proposed modification is not applicable to any areas outside of the Federal Recreational Channel.
The USACE has submitted a Federal Interstate Coastal Consistency Determination to the Pennsylvania Coastal Resources Management Program in accordance with 15 CFR Part 930, Subpart I (relating to consistency of Federal activities having interstate coastal effects). The USACE has certified that the proposed Federal activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's approved Coastal Zone Management Plan to the maximum extent practicable. Interested parties may request a copy of the Federal Coastal Consistency Determination from the Department contact listed as follows.
The Department will consider all comments received within 15 days of the date of this notice before issuing a final Federal interstate consistency concurrence or objection. Comments submitted by facsimile will not be accepted. Comments, including comments submitted by e-mail must include the originator's name and address.
