STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. Plan Description: The approved plan provides for the construction of a 4.5 MGD treatment facility with a biological nutrient removal process; that is able to handle peak flows of 25 MGD. In addition the plan is approved for the construction of 8,530 LF of new 48 and 42 inch interceptor to allow all the flows to get to the new treatment plant. The estimated cost of these new facilities is $30,000,000.00. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. All required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The plan approval is for a state-only (non-Title V) facility. This project does not trigger PSD or Non-Attainment NSR applicability. This installation of these sources are subject to the NSPS requirements of 40 CFR 60, Subparts VVa and Kb (Leak Detection and Repair (LDAR) and storage Tanks, respectively). Potential emissions from the facility are projected to be less than 9.0 tons of VOCs per year. The plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

15-0104D: Tasty Baking Oxford, Inc. (700 Lincoln Street, Oxford, PA 19363) on February 5, 2013, to install a new bread production line at their facility in Oxford Borough, Chester County. The facility is a Title V facility and a major source for VOC emissions. With the increase in VOC emissions from the new bread line, the facility has applied for a Plantwide Applicable Limit (PAL) of 41.7 tons per year for VOC emissions. VOC emissions from the new bread line will be minimized by a catalytic oxidizer, with a destruction efficiency of 95% (or a maximum concentration of 7 ppmdv, reported as propane). Miscellaneous sources associated with the project include: (a) five (5) gas water heaters [four (4) units rated at 400,000 Btu/hr and one (1) unit rated at 200,000 Btu/hr]; (b) one (1) infrared space heater for the trash room, rated at 100,000 Btu/hr; (c) five (5) makeup air handling units (natural gas fired) rated at 1.20 MMBtu/hreach; and (d) Markem printers, used to print coding information on packages. Potential annual emissions from the new bread line operation are: 10.32 TPY for VOC; 8.33 TPY for NOx; 5.37 TPY for CO; 0.66 TPY for PM; 0.05 TPY for SOx; and 0.16 TPY for HAP. Emissions of filterable PM shall not exceed 0.04 grains per dry standard cubic feet. The catalytic oxidizer shall be subject to an initial catalyst inlet temperature requirement of 600°F. Both the inlet and outlet temperatures of the catalyst shall be continuously monitored and recorded. The pressure drop across the catalyst shall be monitored and recorded daily. Annual sampling and testing shall be performed to ensure the catalyst is in good condition. This project is not subject to NSPS, NESHAP, MACT, PSD, NSR, or CAM. The Plan Approval will contain additional monitoring, recordkeeping, and operating conditions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

09-0010D: TEVA Pharmaceuticals USA, Inc. (650 Cathill Road, Sellersville, PA 18960) on February 6, 2013, for addition of a proposed Glatt 120 Fluid Bed Processor to their facility in West Rockhill Township, Bucks County. The potential volatile organic compound emissions from this source will be shared with an existing Glatt 120 Fluid Bed Processor that was previously permitted under plan approval 09-0010B and were estimated to be 11.7 tons per year on a 12-month rolling sum basis. The facility limit for volatile organic compound emissions is 24 tons per year on a 12-month rolling sum basis.

09-0024J: Waste Management of Pennsylvania, Inc. (1000 New Ford Mill Road, Morrisville, PA 19067) on February 6, 2013, for a landfill expansion known as the Valley Fill, at their Tullytown Resource and Recovery Facility (TRRF) in Tullytown Borough, Bucks County. TRRF is a major facility. The Valley Fill will ''piggyback'' an area of approximately six acres of the existing TRRF. Emissions of volatile organic compounds (VOC) and hazardous air pollutants (HAPs) shall be controlled by both an interim and final landfill gas collection and control system (GCCS). Landfill gas collected by the GCCS will be routed to an off-site user with a portion used in an on-site engine to generate power for on-site use. Two existing flares at the TRRF have sufficient capacity to serve as back-up control devices in the event the landfill gas cannot be transmitted to the end users. The final GCCS shall be designed and operated according to the specifications and operational standards of the New Source Standards of Performance (NSPS) for Municipal Solid Waste Landfills 40 CFR Part 60, Subpart WWW. The interim and final GCCS comprise Best Available Technology (BAT) for the source. The Valley Fill shall be limited to controlled emissions increases of 10.5 tons/yr of volatile organic compounds (VOC) and 1.0 tons/yr of hazardous air pollutants (HAPs), calculated after closure. Emissions of particulate matter (PM10/PM2.5) from landfill operations will remain below 100 tons/yr, as currently permitted. Emissions from the flares will remain below existing permitted levels. The facility is also subject to the requirements of National Emissions Standard for Hazardous Air Pollutants for Source Categories (Maximum Achievable Control Technology), Subpart AAAA: Municipal Solid Waste Landfills and will comply with all applicable requirements. The Plan Approval contains conditions for monitoring and recordkeeping designed to keep the facility operating within all applicable air quality requirements.

46-0005: AK Merck, Sharp & Dohme, Corp. (770 Sunmeytown Pike, West Point, PA 19486-0004) on February 7, 2013, to install a non-selective oxidation catalyst on two (2) existing peaking generators (Source Numbers 740 and 751), in Upper Gwynedd Township, Montgomery County. The plan approval is for a Title V facility. The installation of the oxidation catalyst is required by 40 CFR 63, Subpart ZZZZ. This project triggers PADEP's NSR regulations, though there will be no increase in actual emissions. This is due to the low actual baseline emissions of these units compared to their potential emissions, and in conjunction with the aggregation of de minimus NOx emission increases at this facility in the past. The plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

32-00040: GenOn Wholesale Generation L.P., (121 Champion Way, Suite 200, Canonsburg, PA 15317) on February 11, 2013, to issue a Title V Operating Permit for continued operation of a coal refuse-fired power plant, known as the Seward Generating Station, in East Wheatfield Township, Indiana County.

 In accordance with 25 Pa. Code § 127.431, the Department of Environmental Protection (DEP) is providing notice that on February 11, 2013, DEP has issued a Title V Operating Permit to GenOn Wholesale Generation L.P. for the continued operation of a coal refuse-fired power plant, known as the Seward Generating Station, located in East Wheatfield Township, Indiana County.

 The facility contains air contamination sources consisting of two (2) circulating fluidized bed (CFB) waste coal-fired boilers, with maximum fuel heat inputs of 2,532 MMBtu/hour, each. Emissions from the CFB boilers are controlled by limestone fed into the fluidized bed to control SO2 emissions, selective non-catalytic reduction systems (SNCR) and low combustion temperatures to control NOx emissions, flash dryer absorber (FDA), coarse particulate cyclone separation with reinjection into the bed, followed by pulsejet cleaned fabric filters to control PM emissions and further control SO2 emissions. Collection of SO2 and acid gases, including hydrochloric acid and hydrofluoric acid, by calcium in the limestone takes place in the boiler, FDA, cyclone, and fabric filter. Supporting equipment at the site includes one 685-bhp emergency diesel generator engine, one 600-bhp emergency diesel boiler feedwater engine, one 265-bhp emergency diesel firewater pump engine, two diesel air compressor engines (440-bhp & 300-bhp), a 100,000 gas fuel oil storage tank, coal and limestone processing and handling and conveying equipment including a fuel barn, four, fuel oil-fired limestone dryers, with a total heat input capacity of 68 MMBtu per hour, and plant roads. This facility has the potential to emit the following type and quantity of pollutants: 312 tons per year of PM10, 3,361 tons per year of NOx, 3,346 tons per year of CO, 113 tons per year of VOC, 13,385 tons per year of SO2, 144 tons per year of ammonia, 0.15 tons per year of lead, 0.28 pounds per year of mercury, and 5,417,000 tons of CO2e greenhouse gases.

 No emission or equipment changes have been approved by this action. The emission restriction, testing, monitoring, recordkeeping, reporting and work practice conditions of the TVOP have been derived from the applicable requirements of 40 CFR Parts 52, 60, 63, 64, 68, 72, 73, 74, 75, 76, 96, 97, 98 and PA Code Title 25, Article III, Chapters 121 through 145.

09-00177: North Penn Polishing and Plating, Inc. (40 West Park Avenue, Sellersville, PA 18960) on February 5, 2013, for renewal of a Non-Title V Facility, State-Only, Natural Minor Permit in Sellersville Borough, Bucks County. The initial permit was issued on June 27, 2007. North Penn Polishing and Plating, Inc. perform various electroplating and electro-less plating operations. Sources of emissions at this facility include two small boilers, a degreaser, and a multiple electroplating and electro-less plating tanks. The two boilers emit NOx, CO, PM, SOx, and VOC. The degreaser emits VOC and HAP. The plating tanks emit PM and HAP. Total emissions from the facility are as follows: 3.97 tons per year (tpy) of NOx, 2.22 tpy of CO, 8.44 tpy of SOx, 0.75 tpy of PM, 3.27 tpy of VOC, and 0.17 tpy of HAP. The boilers will not be subject to the requirements of 40 CFR 63, Subpart JJJJJJ, as they would only burn fuel oil during periods of gas curtailment, gas supply emergencies, or for periodic testing (not to exceed 48 hours during any calendar year). Applicable conditions have been incorporated into the permit renewal. Per this permit renewal, the Decorative Chrome Tank (Source ID 101) has been converted from using hexavalent chrome to a trivalent chrome bath. Conditions have been revised as they pertain to 40 CFR Part 63, Subpart N. The requirements of 40 CFR Part 63, Subpart WWWWWW have been incorporated into the permit renewal, as they apply to various non-chrome electroplating operations. These conditions are addressed under Source ID 103. The permit contains monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within the aforementioned emission rates and all applicable air quality requirements.

09-00059: Saint Mary Medical Center (1201 Langhorne Newtown Road, Langhorne, PA 19047) on February 6, 2013, for a renewal Non-Title V Facility, State-Only, Synthetic Minor Permit in Middletown Township, Bucks County. Saint Mary Medical Center is a general medical and surgical Hospital. The facility has taken site level restrictions for natural gas and No. 2 fuel oil usage. The fuel restrictions will ensure that Saint Mary Medical Center remains under the emission thresholds of 25 tpy NOx. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.

15-00053: The Chester County Hospital (701 E. Marshall Street, West Chester, PA 19320) on February 6, 2013, for renewal of a Non-Title V Facility, State-Only, Synthetic Minor Permit in West Chester Borough, Chester County. The Chester County Hospital operates and maintains two boilers three emergency generators, and a fire pump. There is a facility-wide limit on the emissions of nitrogen oxides of 24.9 tons per year. The facility has stopped using No. 6 Fuel Oil in their boilers, and they have removed storage tanks for No. 6 Fuel Oil. The facility now uses No. 2 Fuel Oil as a backup fuel for their boilers. The language of the State Only Operating Permit reflects this change in fuel. The facility has the potential to emit 32.7 tons of sulfur dioxide per year and 6.25 tons of particulate matter per year when burning No. 2 Fuel Oil in their boilers. The facility has the potential to emit 21.76 tons carbon monoxide per year and 2.44 tons of volatile organic compounds per year when burning natural gas. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.

09-00085: Tate & Lyle Ingredients Americas, Inc. (East Post Road, Morrisville, PA) on February 7, 2013, to operate two (2) 10.5 MMBtu/hr boilers which use natural gas as a primary fuel source in Bucks County. No. 2 fuel oil is used when there is gas curtailment and is limited to a maximum of 90 days of use per year. No new sources have been installed or modifications have taken place since the permit was last renewed in 2008. Emissions from these sources do not exceed any major thresholds. The permit includes monitoring, record keeping and reporting requirements to address all applicable air quality requirements.

(835 Washington Street, Saint Marys, PA 15857-3605) on February 7, 2013, issued a renewal of the State Only Operating Permit for their electric lamp bulb and tube facility in Saint Marys City, Elk County. The facility sources include base cement mixers, reclaim bagging, amorphous silica coating, SO2 injection, miscellaneous VOC emissions, cold degreasers (parts washers), miscellaneous natural gas usage, space heaters, boiler, an emergency generator, and an emergency diesel fueled fire pump. The facility is subject to the NESHAPs for Area Sources for Reciprocating Internal Combustion Engines (RICE) in 40 CFR 63 Subpart ZZZZ. The potential VOC emissions from the facility are less than 50 TPY. Hazardous Air Pollutants (HAPs) are less than 10 TPY for individual HAPs and less than 25 TPY combined HAPs. NOx and CO emissions are less than 15 TPY. SO2 emissions are less than 42 TPY. Particulate emissions are less than 52 TPY. The renewal permit contains emission restrictions, record-keeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

46-00232: Cemcolift, Inc. (280 Township Line Road, Hatfield, PA 19440) on February 5, 2013, for revocation of a State-Only, Synthetic Minor Operating Permit in Hatfield Township, Montgomery County. Cemcolift manufactured elevator systems and components for commercial and residential use. This facility was a Synthetic Minor facility for VOC. Total VOC emissions from the facility were limited to 11.30 tons per year. Cemcolift ceased operations and sent a written letter to the Department requesting their operating permit be revoked. Cemcolift had leased the building at this address prior to shutdown of operations.
