PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

Centre Plan Description: The approved plan calls for the University Area Joint Authority to replace and relocate approximately 1,260 linear feet of gravity conveyed sanitary sewer in the area of Selders Circle, Ferguson Township; for the purpose of accommodating necessary changes to the storm sewer system in that area. This proposed plan of sanitary sewer replacement and relocation does not involve any increase in sanitary sewer collection/conveyance capacity from what is currently in place. The total project cost, estimated to be $193,000, will be paid for with available monies from University Area Joint Authority's construction fund, and the project will not impact monthly user rates. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from the proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the authority.

West Providence Township Municipal Authority, 83 East Fifth Avenue, Everett, PA 15537—Sewer Replacement Project.
The Pennsylvania Infrastructure Investment Authority which administers the Commonwealth's State Revolving Fund is intended to be the funding source for this project. The project is undertaken by the Authority to meet the requirements of the Consent Order Agreement with the Department of Environmental Protection (Department). The project involves replacement of the existing terra-cotta pipes with new PVC pipes and improvements to the three existing pump stations. The new sewers will be placed in the same location as old system and only on the previously disturbed areas. The Department's review of the project and information received has not identified any significant adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this proposed project from the State Environmental Review Process.

Lancaster Plan Description: The approved plan provides for the construction of a 35,000 gpd extended aeration wastewater treatment plant to serve the Village of Goodville. The plant would be located along Route 23 near the intersection of Fetterville Road. The Plan also changes the stream discharge location of the previously approved Act 537 Plan (C2-36927-ACT) from a stormwater swale, to Cedar Creek, a tributary to the Conestoga River. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

York Plan Description: The planning module for Highland Commons, DEP Code No. A3-67958-228-2, APS Id 826099, providing for a five lot commercial subdivision of a 9.67 acre tract proposing individual on lot sewage disposal systems using denitrification is disapproved. The proposed development is located on the west side of the Susquehanna Trail, approximately 600 feet south of the Loganville Borough line, in Springfield Township. This plan is disapproved because the groundwater sample that was taken at the site had a nitrate-nitrogen concentration of 11.2 mg/l. This is greater than the US EPA maximum contaminant level (MCL). The groundwater is already polluted; therefore, the use of on lot sewage disposal systems is not approvable for this site. Even with the proposed denitrification units the discharge to the groundwater will exceed the MCL and is considered pollution of the groundwater. Pursuant to Section 606 of the Clean Streams Law, when groundwater at the site is already polluted, a proposal for a new discharge to that polluted groundwater cannot be approved. The proposal, as submitted, will potentially create a public health hazard and further contamination of the waters of the Commonwealth.

Perry Plan Description: The planning module for the Mark Leinbach Subdivision, DEP Code No. A3-50928-136-3, APS Id 833961, consisting of one new single family residential lot to be served by the Loysville Village Municipal Authority sewage collection, conveyance and treatment system, is disapproved. The proposed development is located at on Hoover Lane, Tyrone Township, Perry County. This plan is disapproved because the module fails to show that easements were obtained to cross adjacent properties to the point of connection to existing facilities as prescribed by Chapter 71, Section 71.52(a)(6)(i), the plot plan fails to show the point of connection to existing sewage facilities in accordance with the requirements of Component 3, Section G.3.f., the module fails to address the relationship of the proposed development to existing sewage needs by identifying areas adjacent to the project which are in need of improved sewage facilities in accordance with Chapter 71, Section 71.52(a)(2)(i), and the module fails to provide treatment and conveyance flows that are consistent with Chapter 94 reporting data in accordance with the requirements of Component 3, Section J.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The Final Report demonstrated attainment of the Statewide Health and Background Standards and was approved by the Department on February 21, 2014.

Plan Revision Approval under the Municipal Waste Planning, Recycling and Waste

The Department of Environmental Protection (Department) approved the York County Municipal Waste Management Non-Substantial Plan Revision (''Revision'') on February 20, 2014. Key features of the revision include updated municipal solid waste calculations, updating population information, continued flow control to the county run incinerator, and ongoing recycling options. The Revision is a public document and may be viewed at the Southcentral Regional Office, at the address noted above. Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).
Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
