FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. To perform the below-listed water obstruction and encroachments associated with Pennsylvania Turnpike Phase III widening and improvement construction activities in Section D10 (Milepost 355.9 to Milepost 357.6). The activities include the widening and reconstruction of approximately 1.7 miles of eastbound Pennsylvania Turnpike (I-276) to a four-lane roadway between the I-95 overpass and the I-276 Bridge over SR 0013. It also includes the widening and reconstruction of approximately 0.9 mile of westbound I-276 to a four-lane roadway between the I-95 overpass and 1,300` east of the I-276 Bridge over New Rodgers Road (SR 0413). Specific water obstruction and encroachments are:
1. To construct and maintain a new ramp-bridge partially over (aerial impact) Mill Creek (WWF, MF) to facilitate the overall purpose of the project.
2. To extend and maintain 8 x 6 culvert (DB 245) at Road Station 222+75.02 by 25 feet carrying an unnamed tributary (UNT) to Mill Creek (WWF).
3. To extend and maintain 6`8" x 5`6" culvert (DB 246) at Road Station 513+87.97 by 25 feet carrying an UNT of Neshaminy Creek.
4. To replace and maintain a 127-foot three-span bridge over Mill Creek (WWF, MF) (DB-248). The new structure will be a single span steel plate I-girder bridge with 11 feet underclearance.
5. To extend and maintain two existing culverts at stations 489+82 and 554+66.
6. To fill and maintain wetlands (PFO) at several locations as per route design stations, approximately 0.483 acre.
7. To fill and maintain wetlands (PSS) at several locations as per route design station, approximately 0.059 acre.
8. To fill and maintain wetlands (PEM) at several locations as per route design stations, approximately 1.465 acres.

The project has two component areas. It spans from west to east along I-276 starting just west of the proposed interchange where the present I-95 passes over I-276 and runs approximately 1.7 miles and terminates at the Delaware River Turnpike Bridge on the Pennsylvania side. It also spans from north to south extending along I-95 from one mile north of I-276 in Middletown Township, Bucks County to the east bank of the Neshaminy Creek in Bristol Township. This phase of the project passes through Bensalem, Bristol, and Middletown Townships, Bucks County, center of area Latitude 40°7`45", and Longitude 74°53`23".
The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

To construct and maintain an access pier and day docks in and along the Delaware River. The access pier will be ''L-shaped''. The portion of the access pier perpendicular to the shoreline will be approximately 111 feet long and will be 12-feet wide. The portion of the access pier that will be parallel to the shoreline will be approximately 200 feet long and will be 15 feet wide.
Two (2) floating day docks will be installed from two (2) points of the perpendicular access pier.
The inshore day dock will be approximately 247 feet long and will be 181/2 feet wide. The approximate number of boats to use this day dock will be fourteen (14) with a maximum length of 25-feet.
The outshore day dock will be approximately 280 feet long and 181/2 feet wide. The approximate number of boats to use this day dock area will be seven (7) with a maximum length of 40 feet. The piers and day docks will be constructed of steel pipe piles and pre-cast concrete platform sections.
The site is located near Otter and Mill Streets (Bristol, PA-NJ Quadrangle map (Latitude: 40° 05` 37"; Longitude: 74° 51` 20").

[Permit #E65-07-006] CNX Gas Company LLC, 280 Indian Springs Road, Suite 333, Indiana, PA 15701. To replace a culvert located in Tributary 42938 to Beaver Run (TSF) along an existing access road to a proposed gas well pad, in Washington Township, Westmoreland County, Pittsburgh ACOE District, State Water Plan Basin 18B, (Vandergrift Quadrangle, 5.875 inches N, 10.5625 inches W; Latitude N 40°31`57.21", Longitude W -79°34`13.00"). The applicant proposes to install 53 feet of 60" HDPE culvert at the stream crossing for a permanent 30 feet wide access road for the Marco Gas Well Pad. Proposed Linear Impact of the crossing is approximately 75 ft within the project area. The proposed access road also encroaches upon the floodway (50 ft) of T42938 to Beaver Run (TSF). Impacts to the floodway are approximately 435 linear feet within the project area. The upstream watershed drainage at the access road crossing is approximately 1,700 acres (2.65 mi2).

Rosebud Mining Company (Logansport Mine) v. Commonwealth of Pennsylvania, Department of Environmental Protection; EHB Docket No. 2013-004-R
The above matter involved the appeal of the National Pollutant Discharge Elimination System Permit No. PA0235407 (''NPDES Permit''), which was incorporated into the revised Bituminous Coal Mining Activity Permit No. 3991301 (Coal Mining Permit), both of which were issued to Rosebud on December 10, 2012, authorizing operations at the Logansport Mine. The NPDES Permit authorized the discharge of treated wastewater from mine drainage treatment facilities at Outfalls 001, 002, 003, 004 and 005 to waters of the Commonwealth.
The Department's final action to resolve this NPDES Permit appeal was a settlement as reflected by a February 2014 Consent Order and Agreement entered into by the Department and Rosebud. The major provisions of the settlement require Rosebud to agree to abide by new proposed effluent limitations based upon Rosebud's combining certain outfalls and relocating certain outfalls to the Allegheny River. Rosebud agreed not to challenge these effluent limitations upon their final issuance by the Department and in the interim agreed to abide by the terms and conditions in the existing NPDES Permit, until such time as Rosebud has completed the combining and relocation of the outfalls and the new Amended Permit is issued by the Department. The public notice of a draft Amended Permit was published in the Pennsylvania Bulletin, Vol. 44, No. 5, February 1, 2014, page 677.
