Corrective Amendment to 204 Pa. Code § 303.16(a)

[Saturday, April 5, 2014]The Commission on Sentencing has discovered a discrepancy between the agency text of 204 Pa. Code § 303.16(a) (relating to Basic Sentencing Matrix) as deposited with the Legislative Reference Bureau and the official text as published at 43 Pa.B. 3655, 3730, 3731 (June 29, 2013) and the text as codified in the Pennsylvania Code Reporter (Master Transmittal Sheet No. 467, October 2013). The example offenses in the chart were incorrect.
Therefore, under 45 Pa.C.S. § 901: The Commission on Sentencing has deposited with the Legislative Reference Bureau a corrective amendment to 204 Pa. Code § 303.16(a). The corrective amendment to 204 Pa. Code § 303.16(a) is effective as of September 27, 2013, the effective date of the amendment to this section.
The correct version of 204 Pa. Code § 303.16(a) appears in Annex A.

2. When restrictive intermediate punishments are appropriate, the duration of the restrictive intermediate punishment programs are recommended not to exceed the guideline ranges.
3. When the range is RS through a number of months (e.g. RS-6), RIP may be appropriate.
4. All numbers in sentence recommendations suggest months of minimum confinement pursuant to 42 Pa.C.S. 9755(b) and 9756(b).
5. Statutory classification (e.g., F1, F2, etc.) in brackets reflect the omnibus OGS assignment for the given grade.
