[Saturday, May 3, 2014]The Department of Environmental Protection (Department) is proposing to revise the Commonwealth's State Implementation Plans (SIP) to address the requirements of section 110(a)(1) and (2) of the Clean Air Act (CAA) (42 U.S.C.A. § 7410(a)(1) and (2)) for the 2008 8-Hour Ozone National Ambient Air Quality Standard (NAAQS), the 2010 1-Hour Nitrogen Dioxide (NO2) NAAQS, the 2010 1-Hour Sulfur Dioxide (SO2) NAAQS and the 2012 Annual Fine Particulate Matter (PM2.5) NAAQS. Additionally, the Department is proposing an SIP revision addressing the requirements of section 128 of the CAA (42 U.S.C.A. § 7428) for all NAAQS. Section 110(a)(1) and (2) of the CAA direct each state to develop and submit to the United States Environmental Protection Agency (EPA) a plan that provides for the implementation, maintenance and enforcement of the NAAQS within 3 years after promulgation of a new or revised primary or secondary NAAQS. This type of SIP revision is commonly referred to as an infrastructure SIP. The proposed SIP revision for section 128 of the CAA for all NAAQS is in the same document as the proposed infrastructure SIP revision for the 2008 Ozone NAAQS and consists of the information provided for sections 110(a)(2)(E)(ii) and 128 of the CAA and the statutory provisions in Appendix B. The infrastructure SIP revisions for ozone, NO2, SO2 and PM2.5address section 110(a)(2)(A), (B), (C), (D)(i) and (ii), (E)(i)—(iii), (F)(i)—(iii), (G), (H), (J), (K), (L) and (M) of the CAA. The Department does not address section 110(a)(2)(I) of the CAA in these SIP revisions per the September 2013 ''Guidance on Infrastructure State Implementation Plan (SIP) Elements under Clean Air Act Sections 110(a)(1) and 110(a)(2)'' provided by the EPA. The SIP revision for section 128 of the CAA addresses sections 110(a)(2)(E)(ii) and 128 of the CAA for all NAAQS.

The Department is seeking public comment on the proposed section 110(a)(1) and (2) of the CAA infrastructure SIP revisions and the proposed section 128 of the CAA SIP revision, which address the requirements of section 110(a)(1) and (2) of the CAA for the 2008 Ozone NAAQS, the 2010 NO2 NAAQS, the 2010 SO2 NAAQS and the 2012 PM2.5 NAAQS and the requirements of sections 110(a)(2)(E)(ii) and 128 of the CAA for all NAAQS. The Department will hold three public hearings, if requested, to receive comments on the proposals. The first hearing will be held from 10 a.m. to 12 p.m. on June 4, 2014, in the Schuylkill River Room, Department of Environmental Protection Southeast Regional Office, 2 East Main Street, Norristown, PA. The second hearing will be held from 10 a.m. to 12 p.m. on June 4, 2014, in the Juniata River Room, Department of Environmental Protection Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA. The third hearing will be held from 10 a.m. to 12 p.m. on June 4, 2014, in the Waterfront A Room, Department of Environmental Protection Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA.
Persons wishing to present testimony at these hearings should contact Alex Haas, P. O. Box 8468, Harrisburg, PA 17105, (717) 787-9495, alehaas@pa.gov to reserve a time. For each hearing, the hearing will be cancelled if no person has requested to testify at the hearing by 12 p.m. on June 2, 2014. If one or more of the hearings are cancelled, the Department will notify the public on its previously listed web site. Witnesses should keep testimony to 10 minutes and provide two written copies of their statement at the hearing.
