Lancaster Plan Description: The planning module for the Lamar Weaver Subdivision, DEP Code No. A3-36959-192-2, APS Id 834122, providing for the creation of a 1.132 acre lot using an individual on lot sewage disposal system is disapproved. The property is located on the east side of South Fairmount Road, approximately 800 feet north of Wissler Road in West Earl Township. This plan is disapproved because the preliminary hydrogeologic study inaccurately characterized the background nitrate-nitrogen concentration in the groundwater under the proposed subdivision. All of the water sample locations were about 1/4 mile away from the proposed lot and only one of those samples was within the same drainage basin as the proposed lot. Also, the proposed groundwater recharge easement used to mitigate the plume from the proposed on lot sewage disposal system is insufficient in size and position to be acceptable. The easement does not provide enough recharge down gradient of the proposed system to mitigate the impact prior to the plume moving down a well-defined drainage swale and onto the neighbor's property.

Southwest RegionThe Pennsylvania Department of Environmental Protection (''DEP''), under the authority of the Hazardous Sites Cleanup Act, 35 P. S. Section 6020.101 et. Seq. (''HSCA''), has initiated a prompt interim response at the McQuaid Property and Nearby Areas (''Site''). This response has been initiated pursuant to Sections 501(a) and 505(b) of the HSCA, 35 P. S. Sections 6020.501(a) 6020.505(b). The Site consists of properties located in a residential area of the Borough of Aspinwall and the Township of O'Hara in Allegheny County. The McQuaid Property is located at 37 Western Ave and the Nearby Areas are in the immediate vicinity of it.
An on-going investigation conducted by DEP at the Site indicates that these areas have been impacted or have the potential to be impacted by TCE and/or PCE contamination in the groundwater and soil. This contamination can potentially result in elevated levels of PCE/TCE in the indoor air of buildings in the area. Pending completion of the investigation, the extent of the contamination has yet to be determined.
The current and/or potential threat from the Site to human health or welfare from the Site to human health or welfare is the direct contact threat to persons entering buildings where there is the potential for exposure to hazardous substances in the air. The Site is in a residential area.
The Department considered the following two alternatives to address the threats at the Site: (Alternative 1) No action and (Alternative 2) Installation of vapor intrusion mitigation systems in impacted buildings. Alternative 2 was chosen because it complies with the applicable, relevant, and appropriate requirements.
This notice is being provided under Section 506(b) of the Hazardous Sites Cleanup Act. The Administrative Record which contains information forming the basis and documenting the selection of this response action is available for public review and comment at the Department's Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222 and is available for review between 9 a.m. and 4 p.m.
The Administrative Record will be open for comment until August9, 2014. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

This Determination of Applicability under Municipal Waste General Permit No. WMGM044 is for the processing of unpainted and untreated wood waste; gypsum board; brick, block and concrete waste; various organic wastes; non-asbestos containing asphalt shingles; pallets; skids; saw dust; source segregated paper; cardboard and newspaper; plastic waste; scrap metal; unused structural sound building materials; and architectural elements. The processed waste materials are beneficial use as (a) mulch or wood chips for further processing off-site, (b) aggregate material in roadway construction, (c) soil conditioner or soil amendment, (d) alternative fuel, (e) animal bedding, or (f) distributed to wholesale outlets. This determination of applicability initially limits permitted activities to processing of wood wastes under permit condition A.4.a. This permit was issued on April 23, 2014.

Consent Order and Agreement; Treatment of Post-Mining Discharges and Seeps at the Addison and Stutzman Mine Sites Mineral Resources Management, District Mining Operations, Cambria Office, 286 Industrial Park Road, Ebens-burg, PA 15931-4119
The Commonwealth of Pennsylvania, Department of Environmental Protection (Department), pursuant to Sections 4.2 and 4.3 of the Surface Mining Conservation and Reclamation Act, 52 P. S. §§ 1396.4b and 1396.4c; Section 5 of the Clean Streams Law, 35 P. S. § 691.5; and Section 1917-A of the Administrative Code of 1929, 71 P. S. § 510-17, and in settlement of a Complaint docketed at 596 M.D. 2009 before the Commonwealth Court of Pennsylvania has entered into a Consent Order and Agreement (COA) between the Department, Bituminous Coals, Inc. (BCI), and Fetterolf Mining, Inc. (FMI) concerning the treatment of post-mining discharges and seeps at the Addison and Stutzman Mine sites (jointly, the Sites). Both BCI and FMI are operated by Mr. M. Mitchell Fetterolf, who serves as President, Treasurer, and Chief Executive Officer.
The Addison Mine site, located in Addison Township, Somerset County, Pennsylvania, includes permitted mining activities at three sites: Addison #1 (MDP No. 40A77SM11), Addison #1 Mine (MDP No. 5679116), and the Addison Strip (SMP No. 56773136). Between 1981 and 2009, the Department determined there were numerous effluent limit violations as a result of BCI's mining discharge and subsequent treatment attempts.
The Stutzman Mine, MDP No. 56800103, is located in Stonycreek Township, Somerset County, Pennsylvania. In February 1986, the Department discovered four seep locations both on and off the site previously permitted to FMI and requested that FMI implement a permanent abatement plan for the seep treatment.
The Department also notified BCI and FMI in October 2004, that the initial bonds posted for the Sites in the amounts of $504,640 and $8,700 were insufficient to guarantee payment of perpetual treatment of the post-mining discharges and seeps. Jointly, BCI and FML claimed in a June 2005, letter that they lacked the financial resources to provide for perpetual payment and in September 2005, notified the Department that treatment of the discharges and seeps would cease when then-current materials had exhausted. The Department immediately took over treatment of the discharges and seeps after BCI and FMI ceased treatment activity on December 31, 2005. The Department then notified BCI and FMI in January 2006, of its intention to forfeit the bonds for the Sites. Those bonds are currently held by the Mid Continent Insurance Company.
On November 12, 2009, the Department filed a Complaint with the Commonwealth Court seeking that BCI and FMI be required to resume or begin to treat all of the discharges and seeps resulting from the operator's mining activity, and to post long-term financial guarantees so as to provide for those treatments.
Under the terms of the COA, in settlement of litigation, BCI and FMI have agreed to construct and/or repair the treatment systems for the discharges and seeps on the Sites. Rather than collecting on the forfeited bonds, the Department will direct funds from the Mid Continent Insurance Company, Inc., to a treatment trust that has been established with the Clean Streams Foundation for the perpetual treatment of the mine discharges resulting from the mining operations.
