Public Notice of the Availability of National Pollutant Discharge Elimination System General Permit for Discharges from Small Flow Treatment Facilities (PAG-04)

[Saturday, May 10, 2014]Under The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-5, 510-17 and 510-20), the Department of Environmental Protection (Department), by this notice, informs the public of the availability of the National Pollution Discharge Elimination System (NPDES) PAG-04 General Permit for Discharges from Small Flow Treatment Facilities. The General Permit will become effective at 12 a.m. on Monday, May 12, 2014.
The PAG-04 General Permit is intended to provide NPDES permit coverage to existing and proposed Small Flow Treatment Facilities (SFTF) for discharges from these facilities to waters of the Commonwealth. SFTFs are treatment works designed to adequately treat sewage flows of not greater than 2,000 gallons per day for final disposal using a stream discharge or other methods approved by the Department.
Notice of the availability of a draft PAG-04 General Permit was published at 44 Pa.B. 96 (January 4, 2014). A 30-day comment period was provided as part of the draft permit publication. No public comments were received.
The proposed Notice of Intent (NOI) fee for coverage under this General Permit is $100 for SFTF that are not Single Residence Sewage Treatment Plants. The Department anticipates that once coverage under the General Permit is authorized, coverage will continue without the need to submit a separate, subsequent NOI for renewal of coverage as long as the PAG-04 General Permit is renewed, unless the Department specifically requires the submission of a separate, subsequent NOI in writing. The permittee shall be responsible for complying with the final renewed, reissued or amended General Permit. If the permittee is unable to comply with the renewed, reissued or amended General Permit, the permittee must submit an application for an individual NPDES permit within 90 days of the final General Permit publication.
One modification was made to the draft permit in response to a comment received from the United States Environmental Protection Agency (EPA). The Department has clarified that where an EPA-approved Total Maximum Daily Load (TMDL) is in effect for a water body, the Department may require an applicant to apply for an individual NPDES permit where the SFTF discharge under the PAG-04 General Permit would not be consistent with the TMDL.

For PAG-04 General Permit NOIs, the Department will publish notice in the Pennsylvania Bulletin for approvals of coverage only (see 25 Pa. Code § 92a.84(c)(3) (relating to public notice of general permits)).
