FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

 E23-507. Aston Township, 5021 Pennell Road, Aston, PA, 1904, Aston Township, Delaware County, ACOE Philadelphia District.

 To perform the below listed water obstruction and encroachment activities associated minor re-alignment, stream bank restoration and regrading of the East Branch Marcus Hook Creek (WWF) under the Weir Park Drainage Improvements Project. Specific water obstruction and encroachment are:

 1. To replace an existing 51" X 72" culvert and construct and maintain in its place a 20-foot and 6-foot conspan arch bridge which conveys the East Branch Marcus Hook Creek through Weir Park.

 2. To provide for energy dissipation by lining the downstream side of the proposed bridge with rip-rap.

 3. To construct and maintain stream bank protection for the downstream right bank along with minor grading and the installation of cross vane deflectors upstream of the bridge to facilitate the Streambank restoration overall strategy.

 4. To construct and maintain a coir mat liner and plants through the project area and on the banks of the stream to create a riparian buffer area.

 The project site mid-section of the stream reach is located approximately 200 feet south of the intersection of Belleview Drive and Weir Road in Aston Township, Delaware County. (Meridian at the center of the River Reach -Latitude 39° 05` 38.13"; Longitude 75° 26` 24.17").

 The applicant is proposing to remove the existing SR 2029 two lane, 41 foot wide by 14.5 foot long single span bridge having a minimum underclearance of 7.5 feet; construct and maintain adjacent to and downstream a replacement two lane 16 foot span by 93.7 foot long open bottom arch culvert having a minimum underclearance of 8.0 feet in Taylor Run (WWF) with a drainage area of 2.95 square miles; fill and maintain a 761 ft long section of Taylor Run beginning at the bridge replacement; construct and maintain a relocated 664 ft long open channel of Taylor Run with a drainage area of 4 square miles; fill and maintain a 30 ft long section of Spur Run (WWF) tributary to the to be relocated Taylor Run section with a drainage area of 1 square mile; and construct and maintain a relocation of 134 ft of Spur Run needed to reconnect with the to be relocated Taylor Run section.

 In addition the applicant is proposing to install and maintain road associated stormwater outfalls; fill and maintain a 52 ft long section of an ephemeral UNT to Taylor Run (WWF) with drainage areas less than 100 acres and construct and maintain a relocated 35 ft long open channel of UNT to Taylor Run; temporarily impact 1,068 feet of stream for construction of the new structure and stream relocations; and provide onsite stream mitigation as part of the relocation of Taylor Run.

 This project is associated with the SR 2029, Logansport Road relocation and improvement project with these encroachments extending south of the SR 66 intersection with SR 2029, Logansport Road and just north of the intersection with SR 2030, Kelly Station Road in Bethel Township, Armstrong County (Leechburg PA Quadrangle, beginning North 13.9. inches and West 7.7 inches; Latitude 40° 42` 6" and Longitude -79° 33` 20"; to North 14.1 inches and West 8.2 inches; Latitude: 40° 42` 9" and Longitude: -79° 33` 31").

 3. one 8 inch and one 6 inch diameter steel natural gas pipelines and a temporary timber mat crossing impacting 8,413 square feet (0.19 acre) of a PSS wetland (Auburn Center, PA Quadrangle; Lat. 41° 42` 32", Long. -76° 02` 58"),

 4. one 8 inch and one 6 inch diameter steel natural gas pipelines and a temporary timber mat crossing impacting 1,934 square feet (0.04 acre) of a PEM wetland (Auburn Center, PA Quadrangle; Lat. 41° 41` 04", Long. -76° 03` 00"),

 5. one 8 inch and one 6 inch diameter steel natural gas pipelines and a temporary timber mat crossing impacting 396 square feet (0.01 acre) of a PEM wetland (Auburn Center, PA Quadrangle; Lat. 41° 42` 37", Long. -76° 03` 15").

 The Parkhurst Pipeline will consist of an 8" and 6" steel natural gas gathering line from the Parkhurst Well Pad to existing pipeline, all located within Auburn Township, Susquehanna County. The project will result in 170 linear feet of temporary stream impacts, 8,413 (0.19 acre) square feet of permanent wetland impacts and 2,330 (0.05 acre) square feet of temporary wetland impacts all for the purpose of conveying Marcellus Shale natural gas to market.

 The project consists of constructing approximately 0.91 mile of 12" steel natural gas gathering line and an 8" flex-steel waterline connecting the York 088 well site to the Thorne Field Riser located in Apolacon Township and Little Meadows Borough, Susquehanna County. The project will result in 376 lineal feet of temporary stream impacts, 7,631 square feet (0.18 acre) of temporary wetland, and 3,600 square feet (0.08 acre) of permanent wetland conversion, all for the purpose of conveyance of Marcellus Shale natural gas to market.

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 Description of Proposed Action/Activity: Permit approval for the modifications of sewage facilities consisting of: Replacing the entire length of the existing 4" diameter forcemain originating at the East Main Street Pump Station with a new 6" diameter PVC forcemain. An air release/vacuum valve will also be installed on the common manifold in the pump station.

 This proposed facility is located in Elizabethville Borough, Dauphin County.

 Description of Proposed Action/Activity: Permit approval for the construction of sewage facilities consisting of: A liquid aluminum chloride (28%) chemical feed system for phosphorus removal. Aluminum chloride will be introduced into the SBR influent stream on a continuous basis. A combination of diffused air and mechanical mixing will assure that the aluminum chloride is completely mixed throughout the SBR. The aluminum chloride solution will be conveyed through a 3/8" PVC line housed inside a 6" PVC carrier line. A new chemical feed building is proposed to be constructed to house the chemical feed system. Three 250-gallon totes of aluminum chloride will be stored within the proposed chemical feed building with sufficient secondary containment.
