THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Existing Activity: The application is for the amendment of an NPDES permit for an existing discharge of treated sewage from Hatfield Township STP. The amendment includes: (1) rerate of the facility to an annual average design flow of 6.98 MGDs and a maximum monthly hydraulic design capacity of 10.68 MGDs, and (2) to incorporate site-specific copper criteria based on a streamlined WER study.

The copper limits contained in this permit are based on site-specific copper criteria recommended in a Determination of Copper Water Effect Ratio (WER) for West Branch Neshaminy Creek and Hatfield Township Municipal Authority (HTMA) (Tetra Tech, Inc., October 14, 2013). Effluent and stream samples were obtained in August and September, 2013, under low flow conditions in the receiving water. Whole Effluent Toxicity (WET) testing was conducted on these samples following EPA's streamlined procedure for evaluating the WER for copper. The study results yielded WERs of 6.2 (dissolved copper) and 6.0 (total recoverable copper). Applying the total recoverable WER, the site-specific water quality criteria for copper are 132.0 ul/l (acute) and 84.3 ug/l (chronic).

Application No. PA0246441, Concentrated Animal Feeding Operation (CAFO), Deer Stone Ag (Willow Brook Farm CAFO), 10049 Ferguson Valley Road, Lewistown, PA 17044-8601.
Deer Stone Ag., Inc. has submitted an application for an Individual NPDES permit for an existing CAFO known as Willow Brook Farm CAFO, located in Granville Township, Mifflin County.
The CAFO is situated near Unnamed Tributary to Strodes Run in Watershed 12-A, which is classified for High Quality Waters—Cold Water Fishes, and High Quality Waters—Cold Water Fishes. The CAFO is designed to maintain an animal population of approximately 720.52 animal equivalent units (AEUs) consisting of 1,200 Gestating Sows, 200 Lactating Sows, 4,000 Nursery pigs, 10 Boars, 12 Cow/Calf pairs, and 3 Finishing Steers. Swine manure is collected in underbarn a shallow pull plug pit that is then transferred to a two stage lagoon. Cattle manure is handled as solid penpack. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

Application No. PA0246808, Concentrated Animal Feeding Operation (CAFO), Hurst Clair (Hurst Farm CAFO), 788 Kingpen Road, Kirkwood, PA 17536.
Hurst Clair has submitted an application for an Individual NPDES permit for an existing CAFO known as Hurst Farm CAFO, located in Little Britain Township, Lancaster County.
The CAFO is situated near Unnamed Tributary to West Branch Octoraro Creek in Watershed 7-K, which is classified for High Quality Waters—Cold Water Fishes and. The CAFO is designed to maintain an animal population of approximately 504.22 animal equivalent units (AEUs) consisting of 3,600 Finishing Swine, 50 milking cows, 5 dry cows and 16 heifers. Manure is stored in an underbarn, deep pit, concrete storage, or a concrete bottom manure storage lagoon. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.
Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. Comments should be sent to the SCC, Agriculture Building, Room 310, 2301 North Cameron Street, Harrisburg, PA 17110.
