FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  McIntyre Township has applied for a Joint Permit Application to repair the existing flood mitigation project that protects the Village of Ralston along the mouth of Rock Run and Lycoming Creek in McIntyre Township, Lycoming County. The project includes removal of a sediment deposit at the mouth of Rock Run and Lycoming Creek and the placement of rock protection along the west channel bank of Lycoming Creek.

 Approximately 70 lineal feet of riprap slope protection will be installed and with 100 lineal feet of gravel bar removal. The project will also include constructing mudsill cribbing along the toe of riprap slope protection.

 The total estimated stream impacts for the project are approximately 5,951 ft² of permanent impacts and 257 ft² of temporary impacts. The proposed project will not permanently impact wetlands, cultural or archaeological resources, national/state/local parks, forests recreational areas, landmarks wildlife refuge or historical sites. Lycoming Creek and Rock Run are classified with a designated use of High Quality-Cold Water Fishery (HQ-CWF) and with an existing use of Exceptional Value (EV).

 Any pipeline repair, modification or section replacement being conducted in-stream shall be performed in dry work conditions by boring, dam and pumping, fluming or diverting stream flow around the section where activities are to be conducted. In-stream inspection, repair, replacement or maintenance activities on P-40 pipeline shall not be conducted in any Tioga County wild trout stream between October 1 and December 31 without prior written approval of the Pennsylvania Fish & Boat Commission. Enterprise P-40 Pipeline is located along the northern and southern right-of-ways of SR 0006 at the intersection of Elk Run Road and SR 0006. Any new or additional watercourse and/or wetland impact to be incurred for future P-40 pipeline inspection, repair or maintenance activity shall obtain prior written approval from the Department as an amendment to this authorization. Any amendment to this authorization shall be solely limited to the Enterprise P-40 pipeline and its 50-foot right-of-way.

 Has been given consent to construct, operate and maintain a marina that will occupy an approximately 10.2 acre area of the Monongahela River (WWF, N), consisting of a main dock run that will parallel approximately 1,440 linear feet of shoreline, from which 10 dock spurs and a deflector dock will extend approximately 275.0 feet (maximum) riverward from the normal pool elevation. These floating docks will accommodate 304 boat slips, and will be attached to seventy-one (71) piles, which will be driven into the river. Portions of a gangway ramp, utilities, switchback ramp, stair case, floating marina/store office building and elevator will permanently impact approximately 0.04 acre of floodway. In addition, approximately 0.06 acre of floodway will be temporarily impacted during construction. The project is located along the left descending bank of the Monongahela River (Pittsburgh East, PA Quadranfle; Latitude: 40° 25` 46.08"; Longitude: -79° 57` 52.67"), approximately 1,500.0 feet upstream from the Brady Bridge, roughly paralleling South Water Street between S 25th and S 27th Streets, in the City of Pittsburgh, Allegheny County.

 Extend 104 ft upstream and 110 ft downstream, and maintain an existing SR 70, 292 ft long, 6 ft by 7 ft RC box enclosure with a final length of 506 ft and with a drainage area of 139 acres;

 Fill and maintain a 378 ft long section of UNT to Pigeon Creek between the SR 481 enclosure replacement and the SR 70 enclosure extension; and construct and maintain a relocated 328 ft long open channel replacement of the filled UNT Pigeon Creek with a drainage area of 189 acres;

 In addition install and maintain road associated stormwater outfalls; fill and maintain 340 ft of UNTs to Pigeon Creek (WWF) with drainage areas less than 100 acres; and construct and maintain a 138 ft long open channel of UNTs to Pigeon Creek with drainage areas less than 100 acres; fill and maintain a total 0.4 acre of PEM/PSS wetland; temporarily impact 1,731 ft of stream and 0.17 acre of PEM wetland for construction of the encroachments. Stream mitigation will occur offsite on Sherrick Run (WWF), located in Mount Pleasant Township, Westmoreland County. The project will include the backfilling of 0.46 acre of open water and 0.22 acre of wetlands that have developed within the open surface mine pits.  The public hearing will be conducted on Thursday, April 23, 2015 at the Thornhurst Township Volunteer Fire Company, Thornhurst Township Volunteer Fire Company, 351 Old River Rd., Thornhurst, PA 18424, at 6:00 pm by the Waterways & Wetlands Program, Permitting Section, 2 Public Square, Wilkes-Barre, PA 18701-1915, (570) 826-2511.

 The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to West Pocono—North Pocono 230kV Transmission Line Hearing, Department of Environmental Protection, Waterways & Wetlands Program, 2 Public Square, Wilkes-Barre, PA 18701-1915. The Department will accept notices up to the day of the hearing. The Department requests that individuals limit their testimony to 5 minutes so that all individuals have the opportunity to testify. The Department can only review comments made with regard to the NPDES Permit Application No. PAI023514002 and Water Obstruction and Encroachment Permit Application Nos. E35-456 and E40-761 documentation and plans. Written copies of oral testimony are requested. Relinquishing time to others will not be allowed. Individuals attending the hearing will have the opportunity to testify if they so desire; however, individuals who preregister to testify will be given priority on the agenda.

Notice of Draft Permit Availability and Permit Suspension for the NPDES Permit for Stormwater Discharges Associated with Construction Activities for Mr. Lewis Martin in Cumberland County

 Pursuant to the Environmental Hearing Board's (''EHB's'') March 3, 2015 Order issued at EHB Docket No. 2014-028-L, the Department of Environmental Protection (''Department'') is republishing notice of the National Pollution Discharge Elimination System (''NPDES'') Individual Permit #PAI-0321-11-013 (''NPDES Permit'') for the discharge of stormwater associated with construction activities. Pursuant to the EHB's order, the approved NPDES Permit is suspended until further notice from the Department to allow the public adequate opportunity to comment on the suspended NPDES permit.

 The Department received a permit application submitted by Mr. Lewis Martin for this NPDES Permit for discharge of stormwater associated with construction activities. Mr. Martin proposed to disturb 8.24 acres for the purpose of constructing two poultry houses at his property located at 489 Big Spring Rd., in West Pennsboro Township, Cumberland County, Pennsylvania. The facility is located within the Big Spring Creek watershed. Big Spring Creek is a special protection water of the Commonwealth and has an existing use of High-Quality Cold Water Fishes and Migratory Fishes under Title 25 of the Pa. Code, Chapter 93. The permit application's Erosion and Sediment Control Plan and Post-Construction Stormwater Management Plan provide proposed effluent limitations.

 For this NPDES Permit, the application and the suspended NPDES Permit are currently available for review and comment. These materials contain tentative determinations of narrative effluent limitations of proposed effluent limitations and other terms and conditions for the permit application. In accordance with 25 Pa. Code § 92a.32(d), the frequency, volume, quality, and rate of the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102, which prescribes best management practice requirements that constitute the narrative effluent limitations for management of the stormwater runoff at the construction site. These determinations are republished as proposed actions for public review and comment prior to the Department taking a final action.

 The United States Environmental Protection Agency has waived the right to review or object to this proposed NPDES permit action under the waiver provision in 40 CFR 123.24(d).

 Persons wishing to comment on this NPDES Permit application and the suspended NPDES Permit are invited to submit comments to the Department within 30 days from the date of this public notice. With regard to the requirements of 25 Pa. Code § 92a.82(b) and the Environmental Hearing Board's opinion, the Department shall receive comments on the suspended NPDES Permit in the same manner it would a draft permit. Written comments should be addressed to the Regional Program Manager, Waterways and Wetlands Program, 909 Elmerton Ave., Harrisburg, PA 17110. Comments received within this comment period will be considered in the final determination regarding the application. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which such comment is based. After consideration of any written comments received, the Department will either revoke, revise or reissue the suspended NPDES Permit and publish notice of the Department's final action with respect to this NPDES Permit in the Pennsylvania Bulletin.

 The Department will also accept requests for public hearing on this suspended NPDES permit. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. If a hearing is scheduled, the Department will postpone its final determination until after a public hearing is held.
