YAK Communications (America), Inc.; A-311145

Tentative Order

By the Commission:

 YAK Communications (America), Inc. (YAK or the Company), whose utility code is 311145, is a telecommunications interexchange reseller certificated at A-311145 on January 10, 2002.

 By letter dated September 25, 2014, to the Commission, YAK stated that it went out of business as of June 17, 2014. Consistent with this pronouncement, the Commission was also aware that the Company had previously filed for bankruptcy on September 20, 2012, in the Circuit Court of the Eleventh Judicial Circuit in Miami-Dade County, Florida, having filed a claim in that proceeding; and that a final order in the bankruptcy proceeding was entered on July 25, 2013. Additional attempts by Commission staff to reach the Company since receiving the September 25, 2014 letter have been unsuccessful.

 Currently, there are no informal or formal complaints pending against the Company before the Commission. Based on the above facts, we tentatively conclude that it is appropriate to revoke YAK's certificate of public convenience without the necessity of a formal complaint as being in the public interest; Therefore,

It Is Ordered That:

 1. Revocation of YAK Communications (America), Inc.'s certificate of public convenience is hereby tentatively approved as being in the public interest.

 2. The Secretary serve a copy of this Tentative Order upon the Office of Consumer Advocate, the Office of Small Business Advocate, and the Bureau of Investigation & Enforcement, and also cause a copy of this Tentative Order to be published in the Pennsylvania Bulletin with a 30-day comment period.

 3. Absent the filing of adverse public comment within 30 days after publication in the Pennsylvania Bulletin, the Bureau of Technical Utility Services shall prepare a Final Order for entry by the Secretary and shall advise the affected Bureaus within the Commission in writing that the certificate of public convenience held by YAK Communications (America), Inc., utility code 311145, is cancelled, that its name be stricken from all active utility lists maintained by the Commission's Bureau of Technical Utility Services and the Assessment Section of the Bureau of Administrative Services, and that the docket may be closed.
