Cash4LifeTM Terminal-Based Lottery Game

 Under the State Lottery Law (72 P. S. §§ 3761-101—3761-314) and 61 Pa. Code § 875.4 (relating to notice of terminal-based lottery game rules), the Secretary of Revenue hereby provides public notice of the rules for the following terminal-based lottery game:

 1. Name: The name of the terminal-based lottery game is Cash4Life. The game will commence at the discretion of the Secretary of Revenue and will continue until the Secretary publicly announces a suspension or termination date.

 2. Definitions: The following words and phrases, when used in this notice, have the following meanings, unless the context clearly indicates otherwise:

Annuity Option—The manner in which the Cash4Life Top Prize and Second Level Prize may be paid in annual installments for the Annuitant's Measuring Life.

Annuitant—The person or Entity who receives the benefits of an annuity resulting from a Cash4Life winning play for the Top Prize or Second Level Prize paid under the Annuity Option.

Cash Ball Number—The number selected from the field of numbers one (1) through four (4), which is selected by the player or randomly generated using the Quick Pick option, which forms the last number of a Cash4Life Play. The Cash Ball Number may be the same number as one of the five numbers a player selects from the Player Number Sequence.

Cash Option—The manner in which the Cash4Life Top Prize or Second Level Prize may be paid in a lump sum single payment.

Cash4Life—A terminal-based lottery game offered by the Pennsylvania Lottery as a Party Lottery to the Cash4Life Regional Game Agreement.

Cash4Life Drawing—The drawing conducted during which the Cash4Life Winning Numbers are selected.

Cash4Life Play or Play—The six numbers imprinted on a Cash4Life ticket, prefixed by letters A through E, to be played by a player in Cash4Life. The six numbers are comprised of a Player Number Sequence and a Cash Ball Number.

Cash4Life Official Game Rules—The governing rules for the Cash4Life game offered in accordance with the Cash4Life Regional Game Agreement.

Cash4Life Regional Game Agreement—The agreement between the Party Lotteries which establishes the terms for selling the Cash4Life game in the Party Lotteries' jurisdictions.

Cash4Life Winning Numbers—The six numbers, the first five (5) of which are comprised of a Winning Number Sequence and the sixth of which is comprised of a Winning Cash Ball Number, that are randomly selected during each Cash4Life Drawing and that shall be used to determine winning Cash4Life Plays.

Drawing Officials—The personnel authorized by the Party Lotteries to conduct and ensure the integrity of the Cash4Life Drawings.

Finance and Operating Procedures for Cash4Life—Administrative procedures for the operation of the Cash4Life game.

Guaranteed Annuity Portion—The portion of the Annuity Option where the prizewinner is guaranteed annuity payments for the first twenty (20) years of the Claimant's Measuring Life.

Leap Day—February 29, occurs every fourth year.

Measuring Life or Life—The period over which a Top Prize or Second Level Prize is paid out under the Annuity Option. Except as provided below, for each Top Prize winning Play or Second Level Winning Play, the Measuring Life shall be the natural life of the individual who a Party Lottery determines to be a valid prizewinner. However, under the following circumstances the Measuring Life shall be fixed at twenty (20) years: (1) a claim by a minor under the age of 18 at the time the claim is submitted; (2) a claim by a person other than an individual; or (3) a claim by more than one person for the same winning Cash4Life Play.

Party Lottery or Lotteries—The group of state lotteries that joined together to offer the Cash4Life game under the terms of the Cash4Life Regional Game Agreement, the Cash4Life Official Game Rules and the Finance and Operating Procedures for Cash4Life.

Player Number Sequence—A sequence of five (5) numbers ranging from one (1) through sixty (60), which are selected by the player or randomly generated using the Quick Pick option, that form the first five (5) numbers of a Cash4Life Play.

Prize Fund—The portion of Cash4Life gross sales set aside for the payment of prizes. The Prize Fund for any drawing is expected to be 55% of sales, but may be higher or lower based upon the number of winners at each prize level and the funding required to contribute to the Top Prize and Second Level Prize.

Second Level Prize—The Cash4Life prize awarded for matching the Player Number Sequence with the Winning Number Sequence.

Top Prize—The Cash4Life prize awarded for matching the Player Number Sequence and the Cash Ball Number with the Winning Number Sequence and the Winning Cash Ball Number.

Winning Number Sequence—The sequence of five (5) numbers ranging from one (1) through sixty (60) that are randomly selected during a Cash4Life Drawing that comprise a portion of the Cash4Life Winning Numbers.

Winning Cash Ball Number—The one (1) number ranging from one (1) through four (4) that is randomly selected during a Cash4Life Drawing that comprises the last number of the Cash4Life Winning Numbers.

 3. Price: The price of a Cash4Life Play is $2.

 4. Description of the Cash4Life lottery game:

 (a) Cash4Life is designed to give players the opportunity to win one prize for each Cash4Life Play.

 (b) Cash4Life Plays may be purchased from an authorized retailer or at a Pennsylvania Lottery self-service terminal that sells terminal-based lottery game tickets.

 (1) To purchase a Cash4Life Play at an authorized retailer, a player must remit the purchase price and select their Player Number Sequence and Cash Ball Number by submitting a completed Cash4Life bet slip to the authorized retailer, by verbally selecting their numbers, or by requesting the Quick Pick option by relaying the same to the authorized retailer.

 (2) To purchase a Cash4Life Play at a Lottery self-service terminal, a player must insert into the self-service terminal the total purchase price and select their Player Number Sequence and Cash Ball Number by inserting a completed Cash4Life bet slip, by manually entering their number selections, or by selecting the Quick Pick option.

 (c) Players can win prizes as provided in section 7 (relating to prizes available to be won and determination of prize winners).

 (d) Players may purchase Cash4Life Plays for the next available Cash4Life Drawing or up to ten (10) consecutive Cash4Life Drawings, commencing with the next available Cash4Life Drawing.

 (e) A Cash4Life Play may not be canceled or voided once printed by a Lottery terminal or a Pennsylvania Lottery self-service terminal that sells terminal-based lottery game tickets, even if it is printed in error.

 5. Cash4Life bet slip and ticket characteristics and restrictions:

 (a) Cash4Life bet slip characteristics and restrictions.

 (1) Cash4Life bet slips are optically readable cards issued by the Pennsylvania Lottery that a player may use to select up to five (5) Cash4Life Plays. It features five (5) game areas each containing sixty (60) numbered squares from one (1) to sixty (60) where a player selects their Player Number Sequence and four (4) numbered squares from one (1) to four (4) where a player selects their Cash Ball Number and one square which is used to select the Quick Pick option.

 (2) Cash4Life bet slips shall be available at no cost to the player.

 (3) A Cash4Life Play must be selected in accordance with the instructions printed on the Cash4Life bet slip.

 (4) A Cash4Life bet slip has no pecuniary or prize value, does not constitute evidence of the purchase of a Cash4Life Play or the Player Number Sequence or Cash Ball Number selected, and may not be used to claim a prize.

 (5) A Cash4Life bet slip must be completed manually. The use of mechanical, electronic, computer generated, or any other non-manual method of marking bet slips is prohibited.

 (6) Using a Cash4Life bet slip, the player may make number selections for up to five separate Cash4Life Plays. For each separate Cash4Life Play desired, a player must complete their number selections in a separate GAME area on the bet slip (GAME A, GAME B, GAME C, GAME D, and/or GAME E).

 (7) A player may choose to have their number selection(s) made using the Quick Pick option by marking the box for Quick Pick on the bet slip under each desired GAME area.

 (b) Cash4Life ticket characteristics and restrictions.

 (1) A Cash4Life ticket will contain between one to five Cash4Life Plays, the purchase date, the drawing date or range of dates of the Cash4Life Drawing or Drawings in which the Cash4Life Play(s) is/are entered, the total cost of the Plays purchased, and validation data.

 (2) A Cash4Life ticket shall be the only valid evidence of the purchase of a Cash4Life Play, and the only valid documentation for claiming a prize.

 (3) The Cash4Life Plays recorded on a Cash4Life ticket shall only be valid for the Cash4Life Drawing date or range of dates printed on the ticket.

 6. Time, place and manner of conducting drawings:

 (a) Time of drawing. A Cash4Life Drawing will be held at a time as determined by the Party Lotteries and publicly announced by the Secretary.

 (b) Place of drawing. Cash4Life Drawings will be conducted at a location selected by the Party Lotteries.

 (c) Manner of conducting drawings. The Drawing Officials will select, at random, with the aid of mechanical devices or any other selection methodology as authorized by the Party Lotteries, the Cash4Life Winning Numbers.

 7. Prizes available to be won and determination of prize winners:

 (a) Cash4Life prize winners will be determined as follows:

 (1) Top Prize. Holders of tickets upon which the Cash4Life Play matches the Cash4Life Winning Numbers selected by the Drawing Officials for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be the winner of the Top Prize.

 (i) Shares of the Top Prize shall be determined as follows:

 (A) If there is one Top Prize winning play among the Party Lotteries, the annuitized Prize value will be $1,000 per day for Life, paid in annual installments of $365,000, or a one-time lump sum cash prize payment. If there is one Top Prize winning play among the Party Lotteries, the value of the Cash Option will be $7,000,000.

 (B) If there is more than one and less than or equal to fourteen Top Prize winning plays among the Party Lotteries, the annuitized payment based on an annuitized prize value of $1,000 per day will be divided by the total number of Top Prize winning Plays. The minimum annuitized Prize value for this category will be $500 a week for Life, paid in annual installments. The two to fourteen Top Prize winning Play winners may choose the Cash Option as an alternative to the Annuity Option. The amount of the Cash Option shall be the amount of the Cash Option if there were only one prize winning Play, specified in section 7(a)(1)(i)(A), divided by the total number of Top Prize winning Plays.

 (C) In the event there are fifteen or more Top Prize winning Plays among the Party Lotteries, no Annuity Option shall be available. Rather, the prize money for the Top Prize shall be divided equally among all Top Prize winning Plays and paid in one lump sum payment to each winner. The minimum Top Prize shall not be less than any prize payout for the second through the ninth prize levels for the same Cash4Life Drawing.

 (ii) The Top Prize will be paid as an Annuity Option unless a player elects in writing to receive the Top Prize as a Cash Option payment. The election must be made in writing within sixty (60) days from the date the Lottery determines the player is entitled to a Top Prize, and is irrevocable.

 (iii) The Top Prize amount may be subject to the provisions of section 7(b) below.

 (2) Second Level Prize. Holders of tickets upon which the Player Number Sequence portion of a player's Cash4Life Play matches the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the drawing in which the Cash4Life Play is entered, shall be the winner of a Second Level Prize.

 (i) Except as provided in these Cash4Life game rules, the Second Level Prize will be paid either as an Annuity Option or Cash Option. For each Second Level Prize winning Play, the annuitized prize value will be $1,000 per week for Life, paid in annual installments of $52,000, or a one-time lump sum cash prize payment, unless a liability limit, established in section 7(b), would be exceeded. The Cash Option for a Second Level Prize winning Play shall be $1,000,000, unless a liability limit, established in section 7(b), would be exceeded.

 (ii) If a liability limit, established in section 7(b), is exceeded and the annuity prize value of a Second Level Prize falls below $500 per week for Life, then all Second Level Prize winning Plays will be paid in a single lump sum cash payment and no annuitized payment option will be available. The minimum Second Level Prize shall not be less than any prize payout for the third through the ninth prize levels for the same Cash4Life Drawing.

 (3) Third Level Prize. Holders of tickets upon which four of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match four of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials and the Cash Ball Number portion of the player's Cash4Life Play matches the Winning Cash Ball Number portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $2,500.

 (4) Fourth Level Prize. Holders of tickets upon which four of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match four of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $500.

 (5) Fifth Level Prize. Holders of tickets upon which three of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match three of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials and the Cash Ball Number portion of the player's Cash4Life Play matches the Winning Cash Ball Number portion of the Cash4Life Winning Numbers selected by Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $100.

 (6) Sixth Level Prize. Holders of tickets upon which three of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match three of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $25.

 (7) Seventh Level Prize. Holders of tickets upon which two of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match two of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials and the Cash Ball Number portion of the player's Cash4Life Play matches the Winning Cash Ball Number portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $10.

 (8) Eighth Level Prize. Holders of tickets upon which two of the numbers of the Player Number Sequence portion of a player's Cash4Life Play match two of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $4.

 (9) Ninth Level Prize. Holders of tickets upon which one of the numbers of the Player Number Sequence portion of a player's Cash4Life Play matches one of the numbers of the Winning Number Sequence portion of the Cash4Life Winning Numbers selected by the Drawing Officials, and the Cash Ball Number portion of the player's Cash4Life Play matches the Winning Cash Ball Number portion of the Cash4Life Winning Numbers selected by the Drawing Officials, for the Cash4Life Drawing in which the Cash4Life Play is entered, shall be entitled to a prize of $2.

 (b) Liability Limit.

 (i) For a Cash4Life Drawing, if the total prize liability for the Second Level Prize exceeds the amount available in the Prize Fund for the Second Level Prize plus five million dollars ($5,000,000), then each Second Level Prize shall be paid on a pari-mutuel basis.

 (ii) For a Cash4Life Drawing, if there are more than seven Top Prize winning Plays sharing the Top Prize and at least one Second Level Prize winning Play, the Top Prize and Second Level Prizes shall become pari-mutuel. In this situation the Top Prize and Second Level Prize winning Plays shall equally share a Prize Fund comprised of the Cash Option amount of the Top Prize, established in section 7(a)(1)(i)(A), and the lesser of either the Prize Fund for the Second Level Prize plus five million dollars ($5,000,000) or the Cash Option of the Second Level Prize, established in section 7(a)(2), multiplied by the number of winning plays eligible for a Second Level Prize.

 (iii) The Party Lotteries may establish a liability limit for the third through the ninth prize levels. In the event that the third through the ninth prize levels liability limit would be exceeded for a particular Cash4Life Drawing, the prize amounts for the prize levels established in section 7 shall be adjusted in accordance with a formula established by the Party Lotteries so that the aggregate liability for prizes in such Cash4Life Drawing shall not exceed the Liability Limit. This prize liability limitation, if employed, will be posted on the Lottery's publically accessible website.

 8. Prize Restrictions.

 (a) All Cash4Life prize payments, other than the Top Prize and the Second Level Prize, will be made as a lump-sum cash payment.

 (b) A holder of a ticket evidencing a winning Cash4Life Play is entitled only to the highest prize won by those numbers for the drawing in which the Cash4Life Play is entered.

 (c) All prize levels will be rounded down to the nearest whole dollar.

 (d) The number of prize categories and the allocation of the Prize Fund among the prize categories may be changed at the discretion of the Party Lotteries and any such change will be published in a notice in the Pennsylvania Bulletin, and announced publicly. Any such changes will apply prospectively to Cash4Life Drawings as of the date specified in the notice published in the Pennsylvania Bulletin.

 (e) Cash4Life Winning Numbers are certified by the independent auditor responsible for auditing the Cash4Life Drawing. The Lottery shall not be responsible for Cash4Life Winning Numbers reported in error.

 (f) An Annuitant will be paid their appropriate Top Prize share or Second Level Prize share on an annual basis for their Measuring Life, or for the twenty (20) year term of the Guaranteed Annuity Portion whichever is longer. In the event that an Annuitant dies within the twenty (20) year Guaranteed Annuity Portion, any remaining prize payments in the Guaranteed Annuity Portion will be paid according to 61 Pa. Code § 811.16 (relating to prizes payable after death of prize winner). The initial payment under the Annuity Option will be paid as soon as possible upon the completion of internal validation procedures and in accordance with 61 Pa. Code § 875.10 (relating to terminal-based lottery game ticket validation and requirements).

 (g) Prizes shall be redeemed or claimed only in the jurisdiction of the Party Lottery where the Cash4Life play was purchased.

 (h) The Top Prize and Second Level Prize calculations shall not include Leap Day.

 9. Probability of winning. The following table sets forth the prizes, the probability of winning each prize, and the percent of each dollar in sales anticipated to be paid in prizes in each prize level:

 10. Unclaimed Prizes. For winning Cash4Life plays for which no claim or redemption is made within the specified claim period, the corresponding prize monies shall be returned to the other Party Lotteries in accordance with the Finance and Operating Procedures for Cash4Life. The portion of the unclaimed prize or expired prize money that is returned to the Lottery will be paid into the State Lottery Fund and used for the purposes provided for by the State Lottery Law.

 11. Ineligible Players. A Cash4Life play may not be purchased by, and a prize will not be paid to, a lottery board member, commissioner, officer or employee of a Party Lottery, or a spouse, child, brother, sister or parent residing as a member of the same household in the principle place of residence of any such person. A Cash4Life play may not be purchased by, and a prize will not be paid to, individuals identified in 72 P. S. § 3761-309 or 61 Pa. Code. § 875.15 (relating to purchase and prize restrictions).

 12. Applicable Law. In purchasing a Cash4Life play, the purchaser agrees to comply with and be bound by all applicable Pennsylvania statutes and regulations, the Pennsylvania Lottery's policies and procedures, the Cash4Life Official Game Rules and these Cash4Life game rules. Claims arising from Cash4Life game sales occurring in the Commonwealth shall be resolved exclusively with the Pennsylvania Lottery according to the laws of Pennsylvania. Conflicts between the Cash4Life Official Game Rules and the Cash4Life game rules as published in the Pennsylvania Bulletin shall be resolved in favor of the Cash4Life Official Game Rules. In the event the Cash4Life game rules as published in the Pennsylvania Bulletin are silent, the applicable Cash4Life Official Game Rules shall apply.

 13. Retailer Incentive and Marketing Promotion Programs.

 (a) The Lottery may conduct a separate retailer incentive program for retailers who sell the Cash4Life lottery game as authorized 61 Pa. Code § 875.17 (relating to retailer promotional programs).

 (b) Retailer incentive and marketing promotion programs, including the use of unfunded free tickets, may be implemented at the discretion of the Secretary. If needed, funds for the programs, including the payment of prizes resulting from the programs, will be drawn from the Lottery Fund.

 (c) The Pennsylvania Lottery may conduct promotional drawings associated with the Cash4Life game. The Cash4Life game tickets will be imprinted with a unique code to be used by players to enter the promotional drawings. The promotional drawings may be held independently of or in conjunction with the regular Cash4Life Drawings. The Secretary will announce the existence of the promotional drawings. Winners of promotional drawings will be randomly selected from the group of qualified entries. A description of the available prize(s) and the specific rules and other information necessary for the conduct of the promotional drawings will be posted to the Lottery's publicly accessible website. A copy of the same will also be kept on file with the Lottery and will be available upon request.
