FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

As proposed, the above listed activities will permanently impact 61-feet of stream and 160-square feet of wetland; whereas, temporary impacts of 21-feet of stream and 160-square feet of wetland will also be incurred. Any in-stream construction activity shall be performed in dry work conditions by boring, dam and pumping, fluming or diverting stream flow around the stream section where activities are to be conducted. Since the above listed streams are wild trout fisheries, no in-stream repair, replacement or maintenance activities on equestrian trial crossings shall be conducted between October 1 and December without prior written approval of the Pennsylvania Fish & Boat Commission. The Quehanna Equestrian Trails is generally located along the western right-of-way of Upper Three Run Road approximately 2.1-miles north of Pottersdale Road and Upper Three Runs Road intersection. The 160-square feet of permanent wetland impact being incurred for the Twelve Mile Run equestrian ford crossing has been deemed de minus, for which mitigation shall not be required.
41-661. Brett Snyder, 599 Lyons Barr Road, Mon-toursville, PA 17754. Snyder Property along Loyalsock Creek in Fairfield Township, Lycoming County, ACOE Baltimore District (Montoursville North, PA Quadrangle Lat: 41° 16` 36"; Long: -76° 55` 01").
To construct and maintain an existing single family home in Fairfield Township—Lycoming County, which is located within the floodway/floodplain of Loyalsock Creek. The project proposes three fill areas which would be offset by a borrow pit area located within the floodway.
The project will have a no net fill with approximately 1,200 cubic yards of cut and 1,200 cubic yards of fill. Approximately 1,184 cubic yards of material will be removed from a borrow pit located within the floodway of Loyalsock Creek. Excavated material from construction operations will be disposed out of the floodway. The proposed project and calculations show a balance in cut/fill which will have no effect on the flood storage capacity.
The proposed project will not permanently impact wetlands, cultural or archaeological resources, national/state/local parks, forests recreational areas, landmarks wildlife refuge or historical sites. Loyalsock Creek is classified with a designated use of Trout Stocked Fishery (TSF) and with an existing use of Exceptional Value (EV).

To remove coal waste and fill materials from 11.9 acres of the floodway and floodplain of the Schuylkill River (CWF, MF) in order to reduce coal waste from being transported into the Schuylkill River during high water. The coal waste will be disposed of in upland areas and no material removed from the floodway will return to the site. The final result of the project will be the creation of approximately 2.8 acres of new wetlands, 4.5 acres of new or enhanced riparian buffer, and 4.6 acres of wildlife food plots. No wetland or watercourse impacts are proposed for this floodplain restoration project. The project requires the approval of an Environmental Assessment for Section 401 Water Quality Certification. The project is located at 313 River Road, Auburn, PA 17922 in Auburn Borough and West Brunswick Township, Schuylkill County within the eastern half of the property whose boundary is defined by the Schuylkill River. FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
Important legal rights are at stake, however, so individuals should show this document to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.
