UNDER ACT 2, 1995
PREAMBLE 2

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. This action is a renewal of the Title V Operating Permit. The existing permit was initially renewed on 12-29-1998 and was subsequently renewed on 8-4-2004. The facility is a meat processing plant that operates boilers and emergency generators. As a result of potential emissions of NOx, SOx, and PM, the facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments, and is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code Chapter 127, Subchapter G. The facility is not subject to Compliance Assurance Monitoring (CAM) pursuant to 40 CFR Part 64.

TVOP-65-00720: (1576 Arona Road, Irwin, PA 15642) On May 20, 2015, DEP issued a Title V Operating Permit renewal to Kennametal Inc. for their continued operation of Irwin facility located in Hempfield Township, Westmoreland County. Kennametal produces cemented tungsten carbide at this facility.

The facility is made up of eight attritors and four ballmills where heptane is added to make the carbide slurry. The heptane is used to prevent oxidation. The attritors have water cooling jackets on the lids. The ballmills are equipped with a cool water jacket which is supplied by municipal water. The drying room is equipped with 3 vacuum dryers; each utilizes a condenser which employs vacuum technology to collect and contain greater than 95% of the vapors of each batch. For the most part the drying cycle is considered to be a closed loop system. There are baghouses to control particulate emissions.

The pollutants of concern from this facility are VOC from heptane and small amount of particulate matters. The overall potential VOC emission limit for the facility is 152 tons per 12 consecutive month period. The proposed TVOP renewal contains emission restriction, test-ing, monitoring, recordkeeping, reporting and work practice standards derived from the applicable requirements of Pa. Code Title 25, Article III, Chapters 121—145.

The initial operating permit was issued on November 12, 2009, with an effective date of December 1, 2009. Pet Memorial Services continues to operate four (4) identical Crawford animal crematoriums (Source ID 101), rated at 450 lbs/hr each and one (1) EPA Technologies animal crematorium (Source ID 102), rated for 130 lbs/hr. As a modification to the crematoriums, opacity sensors have been added to each unit to ensure that the opacity does not exceed 10%, allow the facility to stoke the crematoriums as needed. Conditions have been added to the operating permit to address this modification. The facility also has a parts washer (Source ID 200) and an emergency generator (Source ID 700). These sources did not require a Plan Approval. Applicable requirements have been incorporated into the operating permit for these two sources. The following are potential emissions from the facility: NOx—17.21 TPY; VOC—17.1 TPY; SOx—13.96 TPY; PM—39.09 TPY; CO—55.89 TPY; and HCl—6.14 TPY. The permit will contain monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality requirements.

The renewal permit is for a non-Title V (State only) facility. The facility elects to cap facility-wide Nitrogen Oxide (NOx) emissions to less than 25 tons per year; therefore, the facility is a Synthetic Minor. The requirements of 40 CFR Part 60 Subpart IIII—Standards of Performance for Stationary Compression Ignition Internal Combustion Engines apply to the Detroit Emergency Generator (Source ID 107). The renewal permit will include monitoring, recordkeeping, and reporting requirements designed to keep the facility within all applicable air quality requirements.

To this end, FTI operates and maintains a gelcoat and a resin spray booth, from which the main pollutant emitted is styrene, a volatile organic compound (VOC) and a hazardous air pollutant (HAP). The potential to emit styrene from the facility exceeds 25 tons per year; however, VOC and HAP emissions from the facility are each restricted to less than 2.7 tons per year. Therefore, the facility is categorized as Synthetic Minor. No changes have occurred at the facility since the State Only Operating Permit (SOOP) was originally issued in March 2009. The renewal SOOP will continue to include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483.  For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.
