FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To rehabilitate and maintain a three span stone masonry arch by installing galvanized steel liners and a concrete knee walls below stream bad for scour protection over the Bushkill Creek (HQ-CWF, MF). The existing structure has a normal clear span of 29.7 feet, 29.5 feet and 19.9 feet for spans 1, 2, and 3 respectively and an underclearance of 19.7 feet, 19.5 feet and 13.7 feet respectively. The proposed work will result in a normal clear span of 26.8 feet for span 1 and 2 and 18.9 feet for span 3 and an underclearance of 19.3 feet, 19.1 feet and 12.9 feet respectively. The project is located along S.R. 2023, Section 01B, Segment 0010, Offset 1407 (Easton, PA Quadrangle, Latitude: 40°41`42"; Longitude: -75°12` 34").

E64-302. Shingle Hollow Group, LLC, 4 Leonard Way, Deposit, NY 19754, in Buckingham Township, Wayne County, U.S. Army Corps of Engineers, Philadelphia District.

 To remove a portion of Beaver Dam Pond (DEP Dam #D64-072) and to construct and maintain a 16-ft wide road crossing of Stockport Creek (HQ-CWF, MF) consisting of a 73-ft long, 11.8-ft span, 7.6-ft high corrugated metal arch culvert, riprap aprons, and rock deflectors. The project is located along the north side of Stockport Road, approximately 0.9 mile west of the intersection of S.R. 191 and T-605 (Stockport Road) (Hancock, NY Quadrangle, Latitude: 41°53`49.8"; Longitude: -75°17`44.2").

E35-459. Moosic Borough, 715 Main Street, Moosic, PA 18507, in Moosic Borough, Lackawanna County, U.S. Army Corps of Engineers, Baltimore District.

 To construct and maintain an outfall in Springbrook (HQ-CWF, MF) consisting of a 24-inch diameter HDPE pipe and endwall. The project is located at Salina Street (Avoca, PA Quadrangle, Latitude: 40°32`29.0"; Longitude: -75°38`03.5").

E60-219. Old Sawmill Campground, 1499 Seven Kitchens Road, Winfield, PA 17889-9147. Old Sawmill Campground Bank Stabilization in Union Township, Union County, ACOE Baltimore District (Northumberland, PA Quadrangle N: 40°53`42"; W: -76°49`48").

 To construct and maintain: 1) R-6 to R-2 riprap protection along the right riverbank for a total length of 1,214 feet and projecting no more than 10 feet channelward of the Ordinary High Water Mark, 2) 13 log vane deflectors that will be anchored into the bank of the riprap areas and that will not project more than 20 feet channelward of the Ordinary High Water Mark to reduce/eliminate the accelerated erosion that is occurring along the river bank and to protect the mature trees on the riverbank located at the river's edge of the Old Sawmill Campground along the right bank of the West Branch of the Susquehanna River. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

District Oil & Gas Operations: Eastern Oil & Gas District, 208 West Third Street, Suite 101, Williamsport, PA 17701

E5729-084: Chief Oil and Gas, LLC, 1720 Sycamore Road, Montoursville, PA 17754, Forksville Borough, Sullivan County, USACE Baltimore District.

 To construct, operate, and maintain:

 1. An intake structure impacting 40 linear feet of the Loyalsock Creek (EV) (Eagles Mere Quadrangle 41°29`36"N, 76°36`27"W);

 2. A 12 inch diameter waterline and a ford crossing impacting 40 linear feet of the Loyalsock Creek (EV) (Eagles Mere Quadrangle 41°29`32"N, 76°36`25"W).

 The project will result in approximately 40 linear feet of temporary stream impacts and approximately 40 linear feet of permanent stream impacts for the purpose of installing an access road, waterline, and intake structure for Marcellus Shale gas development in Forksville Borough, Sullivan County.

 Project proposes to remove the McNamara Dam for the purpose of eliminating a threat to public safety and restoring approximately 900 feet of stream channel to a free-flowing condition. The project is located across a tributary to Field Brook (CWF, MF) (Hop Bottom, PA Quadrangle, Latitude: 41.6299; Longitude: -75.8044).

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period.  Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

09-00032: Eureka Stone Quarry, Inc. (PO Box 249, Chalfont, PA 18914) On June 18, 2015 for renewal of the State Only Operating Permit for a facility comprising a stone crushing operation and two asphalt plants located in Warrington Township, Bucks County. The renewal includes minor changes in standard conditions in accordance with Department of Environmental Protection (DEP) guidelines. Minor corrections in source representations and conditions are made. No. 2 fuel oil is removed as an approved fuel, since the facility only uses natural gas as fuel for the asphalt plants. Ranges for allowable pressure drops for four baghouses controlling particulate matter emissions are set. A limit of 30% reconstituted asphalt pavement (RAP) by weight of total asphalt produced is set for Asphalt Plant #2. The permit will require stack testing for nitrogen oxides (NOx), carbon monoxide (CO), sulfur dioxide (SO2), volatile organic compounds (VOC) and particulate matter (PM) when the RAP content exceeds 20%. RAP use is not allowed in Asphalt Plant #1. The facility is limited to emissions of 24.9 tons/year NOx and VOC on a 12-month rolling basis. The renewed Operating Permit does not authorize any increase in air emissions of regulated pollutants above previously approved levels. The renewal contains all applicable requirements including monitoring, recordkeeping and reporting.

23-0220: Eddystone Rail Co. (5 Industrial Highway, Eddystone, PA 19022-1585) On June 18, 2015 for installation of a crude oil unloading facility at their current site of the Exelon Generation Co, Eddystone Generating Station, in Eddystone Borough, Delaware County. The installation of a marine vessel loading operation with the VOC and HAP emissions routed through a vapor recovery to a non-assisted ground flare for the control of HAP and VOC emissions is subject to the NESHAP requirements of 40 CFR 63, Subpart Y. The facility has taken a throughput limitation to emit less than the major source thresholds, with the projected actual emissions expected to be no more than 24.0 tons of NOx, 23.61 tons of VOCs, and 1.17 ton of total HAPs per year. This project does not trigger applicability toward PADEP's NSR regulations or the federal PSD regulations. The plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

Per this application, Barry Callebaut does not intend to make any changes to the current process operations, only to the controls for the Pre-Roasting Process (Source ID 102). The Pre-Roasting Process has no hourly restrictions on operation. However, the Pre-Roasting Process is restricted to a 12-month total throughput of 64,152 metric tonnes. VOC emissions from the facility will be reduced by approximately 15 tons per year. NOx emissions will have an insignificant increase (<1 ton per year) due to the nitrogen content of PM being sent to the Anguil Regenerative Thermal Oxidizer. The Plan Approval will contain monitoring, recordkeeping, and operating conditions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.
