FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  To construct and maintain Phase 1 of the Robinson Fork Mitigation Bank, in accordance with Construction Plan Sets that will be acknowledged by the Department. This bank consists of restoration, enhancement and conservation activities within approximately 533 acres of the Robinson Fork watershed (WWF). The 533 acres that comprise Phase 1 of the Robinson Fork Mitigation Bank will be placed under conservation easements. The project includes activities affecting uplands, floodplains, approximately 76,990 linear feet of verified water courses; approximately 17,435 linear feet of unverified watercourses; and approximately 4.75 acres of wetland all within the Robinson Fork watershed; including the main stem of Robinson Fork, Beham Run tributary and numerous unnamed tributaries. Restoration activities will be constructed utilizing six approved standard designs or prototypes: Mainstem; Beham Wide; Beham Narrow; Alluvial Fan; Headwaters and Enhancement. The project will also include the installation of temporary road crossings during construction.

 The project includes affecting wetlands through the following-approximately 0.59 acre of permanent loss, approximately 1.79 acre of rehabilitation, approximately 2.37 acres of enhancement and approximately of 46.81 acres establishment/re-establishment. Approximately 3.45 acres of additional existing wetlands will be protected through site conservation easements.

 The project includes affecting watercourses and their floodplains through reestablishment, rehabilitation and enhancement activities resulting in improvement of approximately 76,990 linear feet of watercourse and floodplain; and to improve approximately 17,435 linear feet of additional watercourses through reestablishment, rehabilitation and enhancement upon verification of watercourse status. In addition, the potential to protect approximately 16,180 linear feet of stream channel and floodplain, as well as other drainage features that do not meet the definition of regulated waters of the Commonwealth under site conservation easements exists. Some areas involve habitat management, invasive plant species control and vegetative plantings.

 The results of the work performed under this permit may generate credits that can be utilized under the permittee's Water Obstruction and Encroachment Compensation Operations permit MB9915-0001 provided the permittee meets the terms and conditions of the applicable permits.

Phase I Hazardous Waste Facility Siting Application

Elcon Recycling Services, LLC; Falls Township, Bucks County; Notice of Public Hearing

 The Pennsylvania Department of Environmental Protection (DEP) has determined the Phase I Commercial Hazardous Waste Storage and Treatment Facility Siting Application submitted by Elcon Recycling Services, LLC, for their proposed facility to be located at 100 Dean Sievers Place, Morrisville, PA 19067, to be administratively complete. The purpose of a Phase I application is solely to determine whether the proposed site complies with Pennsylvania's exclusionary siting criteria for hazardous waste treatment facilities. DEP is now conducting a technical review of the application to determine whether the proposed site complies with the exclusionary siting criteria at 25 Pa. Code §§ 269a.21—269a.29. If the site does not meet the applicable criteria, a hazardous waste treatment facility may not be permitted there. If the site does meet the applicable siting criteria, the applicant must submit a detailed permit application, before a permit could be issued for construction and operation.

 As a part of the Phase I siting application review process, DEP has scheduled a public hearing for Wednesday, September 30, 2015. The hearing will be held from 7 p.m. to 9 p.m. at the Sheraton Bucks County Hotel at 400 Oxford Valley Rd, Langhorne, PA 19047. The hearing is intended to allow for public testimony on the Phase I application. DEP will record testimony and receive written comments throughout the hearing. DEP will also accept written comments from September 30, 2015 until October 14, 2015. Request to Waive Setback a Required by the Oil and Gas Conservation Law; Public Hearing

 Notice is hereby given that the Pennsylvania Department of Environmental Protection (Department) has received a request from Hilcorp Energy Company to waive the 330 foot setback as required by the Oil and Gas Conservation Law (OGCL) 58 P. S. §§ 401—419 regarding the Pulaski-Chrastina 8H wellbore, API No. 073-20526, located in Pulaski Township, Lawrence County. The notice is also given that the Department will conduct a public hearing for this waiver request on Wednesday September 16, 2015, from 6 p.m. to 9 p.m. in the first floor conference room at the Northwest Regional Office located at 230 Chestnut Street, Meadville, PA 16335.

 Hilcorp is proposing to drill the Pulaski-Chrastina 8H which will penetrate the Onondaga formation therefore the wellbore is subject to the OGCL and 25 Pa. Code Chapter 79. A well subject to the OGCL must be at least 330 feet from the nearest outside boundary line of the lease on which it is located, or if the lease is included in a voluntary unit, the well must be located 330 feet from the nearest unit line. The 330 foot setback applies to the entire length of both the vertical and horizontal well bore.

 Section 406(a) of the OGCL and 25 Pa. Code § 79.11(b) allow an applicant to submit a request to waive the 330 foot setback in their application for a well permit The public hearing will be held for the purpose of DEP accepting testimony on the above-proposed 330 foot waiver request.

 The public hearing will be held at the Department's Meadville Regional Office, First Floor Conference Room, 230 Chestnut Street, Meadville, PA 16335, on Wednesday, September 16, 2015, from 6 p.m. to 9 p.m.

 Persons wishing to present testimony at the hearing should contact the District Oil & Gas Operations, Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335-3494 (814/332-6860) at least one week in advance of the hearing to reserve a time to present testimony. Oral testimony will be limited to a maximum of five minutes and two written copies of the oral testimony are required. Each organization is requested to designate one witness to present testimony in its own behalf.

Comments should be submitted within 20 days of the date of this publication notice.

 All the documents regarding the waiver request are available for review from 8:00 a.m. to 4:00 p.m. at the DEP's Northwest Regional office. Appointments for scheduling a review must be made by calling 814-332-6340.

Request for Comments on the Proposed Revision to the Total Maximum Daily Load Developed for Thompson Run, Allegheny County

 The Department of Environmental Protection will accept comments as of August 29, 2015 for the Total Maximum Daily Load (TMDL) document was developed for stream segments in the Thompson Run Watershed, originally listed on the 1996 Pennsylvania Section 303(d), list of impaired waters. This report supersedes and replaces the February 25, 2003, Thompson Run Watershed TMDL report approved by the U.S. Environmental Protection Agency (EPA), Region 3 on June 6, 2003.

 The proposed plan provides calculations of the stream's total capacity to accept certain metals and maintain levels below water quality criteria. The applicable water quality criteria are as follows:
