 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board.  On September 23, 2015, the Southeast Regional office approved an update to Upper Makefield Township (Township), Bucks County's official Plan under the Pennsylvania Sewage Facilities Act, 35 P. S. § 750.1 et seq. (''537 Plan'') (APS ID 879185 AUTH ID 1087694).

 The 537 Plan provides for the Township to continue to implement its Sewage Management Program and enforce its on-lot sewage disposal system management ordinance for all areas not currently served by public sewers.

 The 537 Plan also provides for the Township to implement the following steps, consistent with the Amended Implementation Schedule, dated July 20, 2015, submitted with the supplemental information for the identified Taylorsville and Dolington needs areas:

 1.) Taylorsville and Dolington Areas—The Township will amend its on-lot sewage disposal system (OLDS) management ordinance to delineate special sewage management program districts for the Taylorsville and Dolington areas. A document titled ''Preliminary Draft Potential OLDS Ordinance Amendments'' was provided with the supplemental information. The Taylorsville and Dolington special sewage management districts are shown on Exhibit C of the draft OLDS ordinance amendment.

 The amended OLDS ordinance will include supplemental provisions for the Taylorsville and Dolington areas that will include, but not be limited to, the following:

 i. Increasing the frequency of septic tank pumping from three to two years.

 ii. Requiring pumper/inspector reports to be submitted to the Township within fifteen days of the work being completed, regardless of whether problems are noted by the pumper/inspector. The Township will enter these reports into a database that will be created as part of the OLDS Conditions Monitoring Program to be established for the Taylorsville and Dolington areas.

 iii. Requiring property owners to perform annual inspections/assessments of the existing OLDS serving their properties utilizing the Property Owner Inspection Report Form developed by the Township. The Township will enter the results of these reports into the OLDS Conditions Monitoring Program database.

 iv. Implementing requirements for replacement of existing plumbing fixtures with low-flow/usage fixtures in conjunction with any plumbing repairs/upgrades performed on any property within the special sewage management program districts.

 2.) Taylorsville Area Only—The Township will evaluate the effectiveness of the increased operation and maintenance requirements on the performance of OLDS within the Taylorsville area by performing an updated OLDS survey.

 3.) Dolington Area Only—The Township has committed to conduct additional sewage facilities planning to address the long-term sewage disposal needs of the Dolington area. This planning effort will refine/reassess the currently preferred long-term sewage disposal alternative, reassess all currently identified long-term sewage disposal alternatives and identify any new alternatives that may be available based upon changes in current conditions and/or technology that may potentially occur over the short-term planning period.

Plan Description: The approved plan calls for the Gregg Township Municipal Authority (GTMA) to assume operation and ownership of the Brady Township Southeast Wastewater Treatment Plant, which is to be turned into a pump station after the installation of a force main from that treatment plant to the existing flow equalization tank, which is already owned and operated by GTMA, at Allenwood Federal Penitentiary. This will allow the Lycoming County Resource Management Services (LCRMS) to send 52,500 gallons per day of leachate from the LRCMS Landfill to the GTMA for treatment, once the landfill installs a leachate collection line that ties into the existing Brady Township Southeast Wastewater Treatment Plant collection system, as well as provide more available public sewage capacity for the Timber Run Industrial Park in Brady Township. The total project cost for the selected alternative is estimated to be $2,843,000 and will not impact the user rates of existing customers. The Gregg Township Municipal Authority will ultimately be responsible for an estimated $361,000 of the project costs, which they plan to cover via the use of $260,000 in leftover grant money and cash on hand or a conventional loan. LCRMS will be responsible for a $426,816 tapping fee, they are to cover the costs of construction of their leachate collection line and the force main from the proposed pump station to the flow equalization tank, as well as provide a debt retirement payment to GTMA for the existing Brady Township Southeast Wastewater Treatment Plant. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from the proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the authority.

Plan Description: The Component 3S Sewage Facilities Planning Module for Steve Kerstetter, DEP Code No. A3-50905-441-3S, APS Id 880831, consisting of a small flow treatment facility to serve as a repair for an existing single family residential lot, is disapproved. The proposed repair is located on Spring Road in Carroll Township, Perry County. The plan is disapproved because the submission failed to comply with public notification requirements in Chapter 71, Section 71.53(d)(6)(i), and the Component 3S form. The submission also failed to include evidence that a certified letter was sent to each owner of property over which the discharge would flow until perennial conditions are met.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

This initial permit is for a non-Title V (State only) facility. The major source of air emissions are: three (3) gas-fired boilers and six (6) diesel-fired emergency generators. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

46-00019: Lockheed Martin Corporation (230 Mall Blvd, King of Prussia, PA 19406) On September 24, 2015, located in Upper Merion Township, Montgomery County. This action is for the issuance of a renewal Synthetic Minor Operating Permit. The facility elected to take a 24.9 tons per year limit on NOx emissions. The facility is primarily involved in Computer programming Services, Guided missile and space vehicle manufacturing. Lockheed Martin operates boilers, generators, and other lab equipment. The permit contains all applicable requirements including monitoring, recordkeeping and reporting.

23-00103: Elwyn (111 Elwyn Road, Elwyn, PA 19063) On September 24, 2015 for a Non-Title V Facility, State-Only, Synthetic Minor Permit in Middletown Township, Delaware County. Elwyn is a facility caring for the needs of the developmentally disabled and disadvantaged. The sources of emissions include boilers and emergency generators. The company took an emission limit of 24.9 tons per year of NOx. The facility is subject to 40 CFR 60 Subpart IIII and 40 CFR 63 Subpart JJJJJJ. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.

46-00244: ACME Corrugated Box Inc. (2700 Turnpike Dr., Hatboro, PA 19040) On September 24, 2015 for the renewal of a Natural Minor Operating Permit in Upper Moreland Township, Montgomery County. Source of emissions at this facility is a natural gas-fired boiler. The potential air emissions from this facility are: NOx—19.2 TPY, CO—7.48 TPY, and 11,077 TPY of CO2e greenhouse gases. The boiler is subject to 40 CFR Subpart Dc. The boiler is exempt from the regulations of 40 CFR Subpart JJJJJJ and operating hours on commercial fuel oil is monitored to justify that. The permit contains monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality requirements.

46-00264: Caddick Construction Company, Inc. (P. O. Box 179, Ambler, PA 19002) On September 24, 2015 for a renewal of Synthetic Minor Operating Permit for a non-metallic mineral processing plant in Whitemarsh Township, Montgomery County. This Operating Permit renewal contains all state and federal regulations applicable to the facility including emission limitations, operating restrictions, work practice, monitoring, and recordkeeping requirements designed to keep the facility operating within all applicable air quality requirements.

09-00108: Bucks County Water & Sewer Authority—Totem Road Pump Station II (910 Haunted Lane, Bensalem, PA 19020) On September 24, 2015 for the operation of a packed bed tower wet air scrubber to control odors from the sanitary sewage pump station located in Bensalem, Bucks County. The permit is for a non-Title V (State Only) facility. The existing permit was issued on 10-6-2010 and will expire on 9-30-2015. The facility has the potential to emit 0.0008 ton of hydrogen sulfide per year and utilizes an odor scrubber as a control device. The facility's primary criteria pollutant sources are the two diesel fuel-fired backup emergency generators Based on the potential emissions of VOC and NOx, which are less than major source threshold, the facility is a Synthetic Minor. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

The sources consist of feed bins, screens, belts, and conveyors. The control devices are baghouses and a cyclone. The sources are considered minor emission sources of nitrogen oxide (NOx), sulfur oxides (SOx), carbon monoxide (CO), total suspended particulate (TSP) and VOC's. This is a renewal of the State-Only Synthetic Minor operating permit. The State-Only operating permit includes applicable state and federal requirements, work practice standards, testing, monitoring, recordkeeping and reporting requirements.

43-00310: NLMK Pennsylvania Corporation (15 Roemer Boulevard, Farrell, PA 16050) for its facility located in Farrell City, Mercer County. The de minimis emission increase is due to the installation of a new 0.85 MMbtu/hr natural gas fired batch vapor parts washer. This parts washer will be used to clean metal parts. The Department has started a list of de minimis increases as prescribed in 25 Pa. Code § 127.449(i).
