Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To construct and maintain a stormwater control measure that includes an approximate one-acre infiltration basin, a polishing wetlands, and a water discharge control structure within and adjacent to a channel and floodway of an unnamed intermittent tributary to the Pennypack Creek (TSF, MF).

 The site is located on the property of The College Settlement of Philadelphia, West Welsh Road, Horsham (Amber, PA Quad Lat. 40° 10` 24.26N"; Long. -75° 09` 35.23").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. § 1341(a)].

 To authorize the following water obstructions and encroachments associated with the South Valley Parkway Roadway Improvement Project:

 1. To construct and maintain a road crossing of Nanti-coke Creek (CWF, MF) consisting of a 6 span pre-stressed concrete bulb-tee beam bridge, having a 700-foot span and an approximate 79-foot underclearance.

 2. To remove the existing structure and to construct and maintain a stream enclosure in Warrior Creek (CWF, MF) consisting of a 193-foot long, 9-foot x 16-foot concrete box culvert depressed 12-inches below streambed with baffles and riprap aprons.

 The overall project will permanently impact 1.01 acre of wetlands and 2,351 feet of stream channel and temporarily impact 0.41 acre of wetland and 406 feet of stream channel. The permittee is required to provide 1.66 acres of replacement wetlands.

 The proposed project is located along SR 0029 and includes 2.25 miles of new highway alignment to the north of SR 0029/SR 2008 and ties into the existing SR 2008 alignment (Wilkes-Barre West, PA Quadrangle Latitude: 41°12`04"; Longitude: -75°57`39") in Hanover Township and City of Nanticoke, Luzerne County.

E13-177. Carbon County Conservation District, 5664 Interchange Road, Lehighton, PA 18235. Nesquehoning Borough, Carbon County, Army Corps of Engineers Philadelphia District.

 To construct and maintain a 1,040-foot long stream channel restoration project in and along Nesquehoning Creek (CWF, MF) consisting of the following work: Five rock cross vanes with scour pools, 450-L.F. of boulder bank revetment areas with log deflectors, 510-L.F. of vegetated riprap, fish enhancement structures such as random boulder placement and plantings along the streambanks, and a reduction of existing side slopes and bank height along the entire reach of the project. The project is located north of Park Avenue, approximately 3.1 miles west of the intersection of SR 209 and SR 93 (Nesquehoning, PA Quadrangle Latitude: 40°51`32"; Longitude: -75°50`47.8"). Subbasin: 2B.

 Has been given consent to construct and maintain floodway fill in an area approximately 21,729 square feet (0.5 acre) of the floodway to the Youghiogheny River for the purpose of constructing a 27,000 square foot hotel facility and its associated entrance drive, parking area and a stormwater detention system for the site for the purpose of providing lodging for the business district of the City of Connellsville. The project is located near the intersection of North First Street and North Third Street in the City of Connellsville, Fayette County (Quadrangle: Connellsville; Latitude: 40° 01` 13.92"; Longitude: -79° 35` 45.84"; Sub-basin: 19D; Chapter 93 Type: WWF).

Notice of Planning Grant Awards under section 901 of the Municipal Waste Planning Recycling and
Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

Water Quality Certification under section 401 of the Federal Clean Water Act for the Tri-County
Bare Steel Replacement Project

 On February 20, 2015, Columbia Gas Transmission, LLC (Columbia) filed an application with the Federal Energy Regulatory Commission (FERC) in Docket No. CP15-95-000 under Section 7(b) and (c) of the Natural Gas Act (NGA) seeking a Certificate of Public Convenience and Necessity (Certificate) authorizing abandonment, construction,/ and operation of the Tri-County Bare Steel Replacement Project (Project), located in Allegheny, Washington, and Greene Counties, Pennsylvania. The proposed Project would include replacing 34 miles of 20-inch-diameter bare steel piping with coated steel pipeline at the following locations:

 • Segment 1: replace approximately 14 miles with 14.9 miles from the Hero Valve to Waynesburg Compressor Station in Greene County.

 • Segment 2: replace approximately 8 miles with 10.7 miles from the Redd Farm Station to Sharp Farm Station in Washington County.

 • Segment 3: replace approximately 12 miles with 11.9 miles from the Sharp Farm Station in Washington County to the Walker Farm Station in Washington and Allegheny Counties.

 The pipeline would also include associated appurtenant facilities including bi-directional pig launcher/receivers, cathodic protection, main line valves, and taps.

 The Department, by this notice, proposes to certify that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The Department further proposes to certify that the construction, operation and maintenance of the projects complies with Commonwealth water quality standards and that the construction, operation and maintenance of the projects does not violate applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the projects complies with the conditions proposed for this certification, including the criteria and conditions of the following permits:

 1. Discharge Permit—Columbia shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Columbia shall obtain and comply with PADEP's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permits—Columbia shall obtain and comply with a PADEP Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 673.1—693.27), and Flood Plain Management Act (32 P. S. §§ 679.101—679.601.) and all applicable implementing regulations (25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Columbia.

 5. Operation—For each Project under this certification, Columbia shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Columbia.

 6. Inspection—The Projects, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits required, and Pennsylvania's Water Quality Standards. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Projects.

 7. Transfer of Projects—If Columbia intends to transfer any legal or equitable interest in the Projects which is affected by this Certification, Columbia shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.

 8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, Southwest Regional Office, Rita Coleman, Waterways and Wetlands Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

 9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Columbia has not complied with the terms and conditions of this Certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Columbia's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this Certification shall be construed to preclude the institution of any legal action or relieve Columbia from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or state law or regulation.

 11. Severability—The provisions of this Certification are severable and should any provision of this Certification be declared invalid or unenforceable, the remainder of the Certification shall not be affected thereby.

 The Environmental Assessment prepared by FERC may be viewed on FERC's website at www.ferc.gov under the Docket No. CP15-95-000.

 Prior to final action on the proposed section 401 Water Quality Certification, consideration will be given to any comments, suggestions or objections which are submitted in writing within 30 days of this notice. Comments concerning the proposed 401 Water Quality Certification should be directed to Ms. Rita Coleman, Southwest Region Waterways and Wetlands Program Manager at the above address or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD). Comments must be submitted in writing and contain the name, address and telephone number of the person commenting and a concise statement of comments, objections or suggestions on this proposal. No comments submitted by facsimile will be accepted. The Department will consider all relevant and timely comments received. Comments must be submitted within 30 days of this notice.
