Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Specific Water Obstruction and Encroachment activities associated with this project are:
1. To replace and maintain the existing three-span continuous multi-beam bridge with a proposed two-span composite concrete spread box beam bridge which carries Harleysville's Pike Bridge (SR 0113) over an unnamed tributary of Skippack Creek.
2. To fill approximately 0.002 acre of palustrine wetlands (Wetland W9) to facilitate the construction of the proposed bridge wingwalls (Wing A) at the southwest approach of the bridge.
3. To impact approximately 18 linear feet (279 square feet) of stream by extending an existing 36-inch diameter pipe to facilitate the proposed roadway widening. (Waterway S13).
4. To replace and extend a 36-inch ACCMP diameter pipe with accompanied construction of a rock apron at the discharge point impacting approximately 64 linear feet of stream (471 square feet). (Waterway S15).
5. To relocate approximately 150 feet section of the stream to provide for the construction of a proposed 150 feet retaining wall (2,171 square feet). (Waterway S15).
The project is located approximately 150 feet northeast of the intersection where SR 0113 passes over the PA Turnpike Northeast Extension in Franconia Township, Montgomery County (Telford, PA, Quadrangle Latitude 40°18`01", Longitude 75°22`12").
The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

Notice of Planning Grant Awards under Section 901 of the Municipal Waste Planning
Recycling and Waste Reduction Act of 1988, Act 101The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).
Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

The Department will hold a public hearing on the draft NPDES permit renewal application at the LaBelle Volunteer Fire Department, located in Luzerne Township at 1101 LaBelle Road, LaBelle, PA 15450 on Friday, December 4, 2015, from 1:00 p.m. to 3:00 p.m. The nature of the public hearing is to solicit concerns and comments regarding the draft NPDES permit renewal for the LaBelle Site. The public hearing will be held in accordance with 25 Pa. Code § 92a.83.
The public hearing is being held at the request of the Citizens Coal Council (CCC) and Environmental Integrity Project (EIP), who state the draft permit is insufficient under the Clean Water Act and fails to achieve water quality standards because:
• It fails to include some of the most polluting point source discharges from the Matt Canestrale Contracting, Inc. site.
• It uses the coal refuse technology-based limits for a host of other pollutants which are likely to be in the waste streams from the site.
• DEP did not consider whether water-quality based limits are necessary when it is clear that the current technology-based limits are not sufficient to prevent violations of the water quality standards.
• DEP failed to carry out a comprehensive reasonable potential analysis on the tributaries of the Monongahela.
A Department representative will be available to receive both written and oral testimony regarding the draft NPDES permit. Testimony will be placed into public record for the draft NPDES permit and considered by Department staff in the review process.

Water Obstruction and Encroachment Permit Received CDO-007 Major Amendment. Consol Pennsylvania Coal Company LLC, 1000 Consol Energy Drive, Canonsburg, PA 15317. Templeton Fork Stream and Wetland Mitigation Area, East Finley and West Finley Townships, Washington County, Pittsburgh ACOE District (Claysville, PA Quadrangle, Templeton Fork project area centroid latitude 40° 00` 16" N, Longitude 80° 25` 47" W). A major amendment is proposed to Permit CDO-007 previously approved on July 13, 2015. The applicant proposes to offset the stream and wetlands affected by the Enlow Fork Mine Oak Spring Slope and Supply Yard located in East Finley and West Finley Townships, Washington County, by developing a restoration site along a portion of Templeton Fork Stream located near Templeton Fork Road (T-414) intersection with T-408.
This is a Chapter 105 Water Obstruction and Encroachment permit application and 401 Water Quality Certification request.
