PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The Final Report demonstrated attainment of a Site Specific standard for chlorides, a residential Statewide Health standard for all other constituents sampled for in soils except arsenic which met a non-residential Statewide Health Standard. The Final Report was approved by the Department on January 27, 2015.

49-00001: Mt. Carmel Cogen, Inc. (P. O. Box 409, Marion Heights, PA 17832) on January 29, 2015, for their culm fired cogen facility in Mt. Carmel Township, Northumberland County. The minor operating permit modification included a one year extension of the initial compliance date of 40 CFR 63 Subpart UUUUU (National Emission Standards for Hazardous Air Pollutants: Coal- and Oil-Fired Electric Utility Steam Generating Units) and for the incorporation of the applicable provisions of 40 CFR 63 Subpart DDDDD (National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters). Minor modification of Title V operating permit No. 49-00001 is issued under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code § 127.462.

(400 Hunt Valley Road, New Kensington, PA 15068) on January 29, 2015, the Department administratively amended the State Only Operating Permit for the operation of a logo printing facility located in Upper Burrell and Washington Township, Westmoreland County. The amendment is for a typographical error in the Miscellaneous Section of the Operating Permit. All sources, control devices, and conditions remain the same as in the previous issued operating permit.
04-00235: FirstEnergy, LLC—Bruce Mansfield Generating Station (128 Ferry Hill Road, Shippingport, PA 15077) In accordance with 25 Pa. Code §§ 127.424, 127.425 and 127.521, the Department of Environmental Protection (DEP) is providing notice that on January 28, 2015, it issued a modified Title V Operating Permit (TVOP-04-00235) for the Bruce Mansfield facility located in Shippingport, Beaver County. The modification made changes to Conditions B.#013(b), B.#014(b), B.#017(e), B.#025(b) and B.#028(c) and (d). Changes removed language that may have been interpreted to extend a future permit shield to as yet unidentified activities that may be authorized under the minor permit modification provisions of 25 Pa Code § 127.462, the Administrative Amendment provisions of 25 Pa. Code § 127.450, the De Minimis Emission Increase provisions of 25 Pa. Code § 127.449, the Operational Flexibility provisions of 25 Pa. Code § 127.3 and the Permit Shield provisions of 25 Pa. Code § 127.516. The modification also added additional monitoring requirements related to opacity. This action was taken as a result of an Order issued by EPA on July 30, 2014 in response to the September 10, 2012, October 22, 2012, and May 15, 2013 Requests for Objection to the Issuance of a Title V Operating Permit at Petition Numbers III-2012-06, III-2012-07, and III-2013-02.
32-00055: NRG Homer City Services, LLC (1750 Power Plant Road, Homer City PA 15748) In accordance with 25 Pa. Code Chapter 127, the Department of Environmental Protection (DEP) is providing notice that it has modified the Title V Operating Permit (TVOP-32-00055) previously issued on November 16, 2012 to authorize the continued operation of the Homer City Station located in Black Lick/Center Township, Indiana County.
The modification made changes to Conditions B.#013(b), B.#014(b), B.#017(e), B.#025(b) and B.#028(c) and (d). Plan Approvals included PA-32-00055F authorizing the installation of a replacement auxiliary boiler, PA-32-00055G authorizing the installation of activated carbon injection systems on Units 1 and 2, and Plan Approval PA-32-00055H authorizing the installation of flue gas desulfurization systems on Units 1 and 2. Project to add temporary portable crusher and screen to be powered by a Caterpillar diesel engine rated at 300 bhp and a Cummins diesel engine rated at 110 bhp respectively and controlled by water sprays. Emissions from the proposed engines will not exceed 0.1 ton NOx and 0.1 ton SOx for the project. The total emissions from a single source will not exceed 0.6 tpy; and that the total emissions from this project will not exceed 3.0 tpy.
