FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Mining Activity NPDES Permit Notice of Settlement
Notice of Settlement of NPDES Permit Appeal pursuant to 25 Pa. Code § 92a.88 New Stanton District Office: 131 Broadview Road, New Stanton, PA 15672, 724.925.5500
The above matter involved the appeal of the National Pollutant Discharge Elimination System Permit No. PA0202975 (''NPDES Permit''), which was issued to Patriot Mining Company (''Patriot'') on February 19, 2014, authorizing its treated discharges at the Mt. Morris Mine in Perry and Dunkard Townships, Greene County. The NPDES Permit authorized treated post-mining discharges and the discharge of treated wastewater from mine drainage treatment facilities Outfalls TP110 to Dooley Run which drains to Dunkard Creek within the Monongahela River Watershed.
The Department's final action to resolve this NPDES Permit appeal was a settlement as reflected by a December 24, 2014 Consent Order and Agreement entered into by the Department and Patriot. In its appeal, Patriot challenged, inter alia, water quality based effluent limitations for iron, manganese, aluminum and osmotic pressure. The major provisions of the settlement includes a compliance schedule in the permit but requires Patriot to accept all of the originally established water quality based effluent limitations for iron, manganese and aluminum and osmotic pressure on and after August 1, 2015. Patriot has agreed not to challenge a final Amended NPDES Permit containing these effluent limitations. The draft Amended Permit is still subject to comment from the public prior to final issuance. The Department incorporated the compliance schedule to complete the installation and operation of a passive treatment system consisting of three wetland cells, three horizontal flow limestone beds and a polishing pond for the continued treatment of additional mine drainage seeps. Until such time as this system is completed, on or before May 1, 2015, and for three months thereafter, on or before August 1, 2015, the company shall be authorized to comply with interim effluent limitations for iron and manganese, with no discharge limitations for aluminum or osmotic pressure while it installs and starts operations of the new passive treatment system. Thereafter the company will be required to comply with the final water quality based effluent limitations contained in the draft NPDES Permit for all four challenged parameters.

Request for Comments on the Proposed Revision to the Total Maximum Daily Load (TMDL) Developed for Parts of the Crooked Creek Watershed, Armstrong and Indiana Counties The Department of Environmental Protection will accept comments as of February 14, 2015 for the proposed revision to the TMDL developed in 2009 for the portion of the Crooked Creek watershed affected by siltation. This TMDL was established in accordance with the requirements of Section 303(d) of the Clean Water Act. The 2012 Pennsylvania Integrated Water Quality Monitoring and Assessment Report included aquatic life use impaired stream segments in this watershed caused by siltation from abandoned mine lands and agricultural activities.
There are currently no state or federal in-stream numerical water quality criteria for sediment; therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria for sediment by comparing reference and impaired watersheds loading of annual siltation.
This proposed TMDL sets allowable loadings within the specifically impaired stream segments of the portion of the Crooked Creek watershed. The loading was allocated among the land uses of abandoned coal mines, cropland, hay/pasture land, associated transitional/disturbed land, and stream bank present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University. The following table shows the estimated current loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.
