ACTIONS ON COAL AND NONCOAL MINING ACTIVITY APPLICATIONS


Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). The final action on each application also constitutes action on the NPDES permit application and, if noted, the request for a Section 401 Water Quality Certification. Mining activity permits issued in response to applications will also address the application permitting requirements of the following statutes: the Air Quality Pollution Act (35 P. S. §§ 4001—4014); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1002).

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 To perform the following water obstruction and encroachment activities within the floodplain of the Delaware River (WWF-MF) associated the Project 3 Capacity Enchantment Project (CEP) Installation of Runway 9R replacement localizer:

 1) To place approximately 5,500 cubic yards of fill within the floodway of the stream to facilitate the construction of an embankment to support the proposed localizer array.

 The project site is located approximately 450 feet Southeast of Taxiway SA on the Philadelphia International Airport in Tinicum Township, Delaware County (Woodbury NJ-PA USGS Quadrangle, Longitude 75° 13` 48" Latitude 39° 52` 11").

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

 To: 1) relocate and maintain 600 feet of Mill Creek; 2) install and maintain six double-throated cross rock vanes, three cross rock vanes, eight J-hook vanes and a riffle grade control structure all in Mill Creek (WWF, MF) and 3) excavate and maintain a 0.73 acre wetland along the floodway of Mill Creek (WWF, MF) all for the purpose of improving fish habitat and stabilizing the stream. The project site runs parallel to Camp Betty Washington Road and is located at the southeast corner of the intersection of Camp Betty Washington Road and Chestnut Hill Road (York, PA Quadrangle, Latitude: 39°56`40", Longitude: 76°39`39") in York Township, York County. The permit was issued January 22, 2015.

 On October 27, 2014, the Department of Environmental Protection (Department) received an administratively complete NPDES Permit application and on September 29, 2014 the Department received a Water Obstruction and Encroachment Permit applications for the West Pocono-North Pocono 230kV Transmission Line, Buck Township, Luzerne County, and Thornhurst Township, Clifton Township & Covington Township, Lackawanna County.

 The public hearing will be conducted on Thursday, April 23, 2015 at the Thornhurst Township Volunteer Fire Company, 125 River Road, Thornhurst, PA 18424, at 6:00 pm by the Waterways & Wetlands Program, Permitting Section, 2 Public Square, Wilkes-Barre, PA 18701-1915, (570) 826-2511.

 The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to West Pocono-North Pocono 230kV Transmission Line Hearing, Department of Environmental Protection, Waterways & Wetlands Program, 2 Public Square, Wilkes-Barre, PA 18701-1915. The Department will accept notices up to the day of the hearing. The Department requests that individuals limit their testimony to 5 minutes so that all individuals have the opportunity to testify. The Department can only review comments made with regard to the NPDES Permit Application No. PAI023514002 and Water Obstruction and Encroachment Permit Application Nos. E35-456 and E40-761 documentation and plans. Written copies of oral testimony are requested. Relinquishing time to others will not be allowed. Individuals attending the hearing will have the opportunity to testify if they so desire; however, individuals who preregister to testify will be given priority on the agenda.
