Uniform Construction Code
Regulation No. 12-102 (#3141)On February 29, 2016, the Independent Regulatory Review Commission (Commission) received this regulation from the Department of Labor and Industry (Department). This rulemaking amends 34 Pa. Code §§ 401.1, 403.21 and 405.2. On March 3, 2016, the Department simultaneously tolled and resubmitted this final-omitted regulation to correct two omissions in Subparagraph 403.21(a)(10)(ii). Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.
This regulation updates the standards for accessible and usable building to the 2015 version of the International Building Code, the International Existing Building Code and the standards for the operation of ski lifts to the latest standard of the American National Standards Institute.
We have determined this regulation is consistent with the statutory authority of the Department (35 P.S. §§ 7210.302(a)(1) and (2) and 7210.304(a)(3)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
By Order of the Commission:
This regulation is approved.
GEORGE D. BEDWICK,
Chairperson
