FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The project will also have temporary impacts associated with Erosion and Sedimentation Pollution Control (E&S) Best Management Practices (BMPs) during construction. The project purpose is to improve transportation safety and roadway standards. The project is located between mile markers 202 and 206 along the Pennsylvania Turnpike in Upper Mifflin and Hopewell Townships, Cumberland County. The applicant is required to provide compensation for 1,391 linear feet of stream impacts and has proposed mitigation through stream enhancements previously conducted at Big Spring Creek (HQ-CWF) in West Pennsboro Township and North Newton Township, Cumberland County originally authorized under Permit No. E21-422. Compensation for 1.34 acre of wetland impact will be deducted from the wetland mitigation site created as part of PA Turnpike Commission Permit No. E21-389 in Middlesex Township, Cumberland County. The permit was issued on May 26, 2016.

SR 0219, Section A14, Bridge to Box Culvert Replacement Project, Bell Township, Clearfield County. USACOE Baltimore District (McGees Mills, PA Quadrangle Latitude: 41° 53` 05.6"; Longitude: 78° 45` 23.7").
The applicant is seeking authorization to (1) remove the existing single span bridge that carries SR 0219, Section A14, Bridge across Whiskey Run (2) realign 80-feet of unnamed tributary channel, and (3) construct, operate and maintain a box culvert to carry SR 0219, Section A14, across Whiskey Run. Chapter 93 Rules and Regulations designate Whiskey Run and the unnamed tributary as Cold Water Fishery-Migratory Fish. The channel change of the unnamed tributary Run shall be limited to maximum 65-linear feet that shall result in successful establishment of a stable realigned channel and overbank areas. The box culvert to carry SR 0219 across Little Whiskey Run shall be constructed to minimally have a span of 30-feet and rise of -feet with invert depression of 1-foot. As proposed, SR 0219, Section A14, Bridge to Box Culvert Replacement Project will incur maximum 85-feet of temporary stream impact and 165-feet of permanent stream impact. The project is located along the western right-of-way of SR 0219 approximately 0.64-mile east of SR 0036 and SR 0219 intersection in Bell Township, Clearfield County.

EA1109-006. Pennsylvania Department of Environmental Protection, Bureau of Abandoned Mine Reclamation, Cambria Office, 286 Industrial Park Rd., Ebensburg, PA 15931. Cresson Acid Mine Drainage (AMD) Treatment Plant in Cresson Township, Cambria County, ACOE Baltimore District.
The applicant proposes to alter existing water courses in order to construct and operate the proposed Cresson AMD Treatment Plant. The following water courses that drain to an unnamed tributary (CWF) locally known as Trap Run of the Clearfield Creek (WWF) will be filled and relocated: approximately 233 linear feet of an existing stormwater ditch which collects surface and roadway runoff from Cresson Shaft Road (T.R. 441) that drains into approximately 355 linear feet of a first unnamed tributary (CWF), in addition approximately 218 linear feet of a second unnamed tributary (CWF) drains into the first unnamed tributary. This cumulative 806 linear feet (0.065 acre) of relocated water courses will be replaced with the construction of 323 linear feet of piping draining into 360 linear feet of relocated water course draining into the unnamed tributary (CWF) locally known as Trap Run of the Clearfield Creek (WWF). Relocating the watercourses is being proposed for the purpose of constructing and operating the Cresson AMD Treatment Plant having a maximum treatment capacity of approximately 6.3 million gallons per day (MGD) of treated water mine water discharging into locally named Trap Run, which is an unnamed tributary (CWF) to Clearfield Creek. The plant will be located adjacent to the northeast border of the Sankertown Borough boundary in Cresson Township along Cresson Shaft Road (T.R. 441). Once the plant is operating at an average design capacity of 4.4 MGD, the following historic heavily polluting AMD discharges will be eliminated: Argyle Stone Bridge discharge, Gallitzin Shaft discharge and the Cresson Mine discharge. Therefore, the 806 linear feet (0.065 acre) of relocated water courses will support the elimination of the three discharges and with the additional 4.4 MGD average discharge of treated mine water, approximately 15 miles of Clearfield Creek (WWF) and six miles of Sugar Run (CWF) will be restored. In all, a total of 21 miles that are currently impaired by acid mine drainage will be restored with the cumulative 806 linear feet (0.065 acre) of relocated water courses.
