Request for Delegation of Authority to Implement the Federal Plan Requirements for Sewage Sludge Incineration Units; Public Hearing

 The Department of Environmental Protection (Department) is requesting delegation of authority from the United States Environmental Protection Agency (EPA) to implement the Federal Sewage Sludge Incineration (SSI) Plan. Sections 111(b) and 129(a) of the Clean Air Act (CAA) (42 U.S.C.A. §§ 7411(b) and 7429(a)) address emissions from new units through the new source performance standards (NSPS), and sections 111(d) and 129(b) of the CAA address emissions from existing units through the emission guidelines (EG). The NSPS are Federal regulations directly enforceable upon SSI units and, under section 129(f)(1) of the CAA, become effective 6 months after promulgation. The EPA promulgated EGs to reduce emissions from existing SSIs at 71 FR 15372 (March 21, 2011).

 ''Federal Plan Requirements for Sewage Sludge Incineration Units Constructed on or Before October 14, 2010'' was promulgated at 81 FR 26040 (April 29, 2016). This final action implements the EPA's EGs adopted on March 21, 2011, in states that do not have an approved state plan implementing the EGs in place by the effective date of this Federal plan.

 Copies of the Delegation Request may be examined on the Department's web site at http://www.dep.pa.gov/Business/Air/BAQ/Pages/default.aspx under the heading ''Proposals Open for Comment.''

 The Department is seeking comments on the request for delegation of the Federal SSI Plan and will hold a public hearing on August 31, 2016, from 10 a.m. until 12 p.m. in the Rachel Carson State Office Building, 12th Floor Conference Room, 400 Market Street, Harrisburg, PA 17105-2301.

 Persons wishing to present testimony should contact the Department no less than 24 hours in advance of the public hearing to reserve a time. Speakers will be limited to 10 minutes and should bring a written copy of their comments.

 The Department must receive all comments by Friday, September 2, 2016. Electronic comments should be submitted using the Department's eComment site at www.ahs.dep.pa.gov/eComment.
