FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984.  To construct and maintain a stream restoration project along 300 feet of Schoeneck Creek (WWF, MF) for the purpose of reducing the risk of sinkholes. The cross section consists of a geosynthetic clay liner, 12 inches of soil and aggregate mix, existing streambed material choked with riprap, and rock armoring along each bank. The project also includes the repair of two sinkhole areas within the floodway of Schoeneck Creek (WWF, MF) previously authorized under Emergency Permit No. EP4815401.

 The project is located on the south side of the Buzzi Unicem USA Quarry, southeast of the intersection of State Route 191 and Friedenstahl Avenue (Nazareth, PA Quadrangle Latitude: 40°44`44.02"; Longitude: -75°17` 02.18"). Subbasin: 1F.

 The project consists of constructing approximately 1.6 mile of 16" steel natural gas gathering line located in Springville Township, Susquehanna County, which connects Cabot's Bishop Well Pad to the Williams' Pijanowski Pipeline. The project will result in 185 lineal feet of temporary stream impacts, 8,004 square feet (0.18 acre) of temporary wetland impacts, and 7,153 square feet (0.16 acre) of permanent wetland impacts all for the purpose of providing safe reliable conveyance of Marcellus Shale natural gas to market.

CLEAN-UP AND REDEVLOPMENT OF A SITE UNDER THE HAZARDOUS SITES CLEAN-UP ACT OF
OCTOBER 18, 1988

Proposed Consent Order and Agreement

Greenville-Reynolds Industrial Development Site

Greenville, Mercer County

 Under section 1113 of the Pennsylvania Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101—6020.1305) (HSCA), notice is hereby provided that the Pennsylvania Department of Environmental Protection (Department) has agreed to a Consent Order and Agreement (Agreement) with Marcegaglia USA (Marcegaglia) and Greenville Reynolds Development Corporation (GRDC), concerning the areas impacted by the release of hazardous substances from the Former Damascus Tube Facility (Property and Offsite Ditches) which is a subset of the larger Greenville-Reynolds Industrial Development HSCA Site (Site) in Greenville, Mercer County. The Property and Offsite Ditches are areas where hazardous substances, wastes, and other materials from the Former Damascus Tube Facility have been released or threaten to be released.

 In the past, wastes and other materials containing hazardous substances were dumped, spilled, or otherwise disposed at the Site including the Property and Offsite Ditches, and these hazardous substances contaminated the soils, sediments and groundwater beneath the Site. The Department and others have investigated the Site and to date have found that sediment, groundwater, and soils at the Site including the Property and Offsite Ditches are contaminated with ''hazardous substances'' as defined in Section 103 of HSCA, 35 P. S. § 6020.103, including, among others: lead, polychlorinated biphenyls (PCBs), zinc, nickel, manganese, and trichloroethylene (TCE). The presence of these hazardous substances at the Site constitutes a ''release'' and a ''threat of release'' of a hazardous substance, as defined in Section 103 of HSCA, 35 P. S. § 6020.103.

 The Agreement concerns Marcegaglia's settlement for the Site, the cleanup of the Property and Offsite Ditches by GRDC, and Marcegaglia respectively, and the redevelopment of the Property within the Site by GRDC for public benefit. Specifically, Marcegaglia will transfer the Property to GRDC at a discounted price and pay $50,158.87 to the Hazardous Sites Cleanup fund as settlement for the Site based on costs incurred by the Department on the Property and Offsite Ditches. Marcegaglia will also conduct a response action to address contamination in the Offsite Ditches. GRDC will complete the remediation at the Property and redevelop the Property for industrial use. The specific terms of this settlement are set forth in the Agreement among the Department, Marcegaglia, and GRDC.

 The Department will receive and consider comments relating to the Agreement for sixty (60) days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations which indicate that the Agreement is inappropriate, improper, or not in the public interest. After the public comment period, the Department's settlement with Marcegaglia and GRDC shall be effective upon the date that the Department notifies Marcegaglia and GRDC, in writing, that this Agreement is final and effective in its present form and that the Department has filed a response to significant written comments to the Agreement or that no such comments were received.

 The Agreement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, Pennsylvania. Comments may be submitted, in writing, to Mr. Charles Tordella, Acting Environmental Group Manager.  The Department of Environmental Protection (Department) approved the Lawrence County Municipal Waste Plan Revision on January 22, 2016.

 Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
