THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

The Plan modifications include reversal of the direction of flow within the LPSS along Long Ridge Road to convey the wastewater northwesterly to a junction with the proposed Rt. 6 LPSS. The LPSS main on White Mills Road has also been extended and rerouted through a private easement, with the main now crossing near the White Mills Fire Hall to Route 6. The new sewage pump station that was to be located at intersection of Rt. 6 & Rt. 652 has been eliminated. Wastewater from White Mills will instead flow further west to the existing Rt. 6 Pump Station near the existing shopping mall. That pump station will be expanded to a Peak Flow of 0.576 MGD, along with a new 8" dia. sewage force main which will convey the wastewater to CWRA's WWTP through existing rights of way along Rt. 6 and Old Willow Ave. Proposed wastewater flow from the White Mills area will remain the same at 0.120 MGD. The sewage facilities will be owned and operated by CWRA.

The project is known as the E-7 Basin Flow Diversion. The project will divert 0.25 mgd of existing sewage flows in basin E-7 from the East Conococheague Interceptor via a new pump station to the West Conococheague Interceptor near manhole 1359, resulting in the abandonment of the East Conococheague Interceptor from manhole 1348 to manhole 1359. The approved project will require a Water Quality Management (Part II) permit for the construction and operation of the proposed sewage facilities. The permit application must be submitted in the name of the municipality. The Department's review of the revision amendment has not identified any significant impacts resulting from this proposal. The DEP Code Numbers for this plan are A3-28001-182-3 and the APS Id is 941930.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The HAPs emissions from the facility are less than 10 TPY and the facility is therefore an Area Source for MACT.

1. To remove the existing twin Markley Street bridges and replace and maintain in their place a single span concrete bulb tee girder bridge, approximately 113.5 feet of clear span with approximately 8.2 feet underclearance.
2. To replace and maintain three existing storm drain outlets that discharge through the existing bridge abutments or wingwalls as follows: the existing 18-inch storm drain in the southwest quadrant, 15-inch storm drain in the southeast quadrant, and an 18-inch storm drain in the northwest quadrant with an 18-inch, a 36-inch, and a 48-inch storm drain, respectively.
3. To place and maintain one new 18-inch at the storm drain outlet constructed in the northeast quadrant of the proposed bridge as per the attached plans.
4. To place approximately 147 linear feet of rock scour protection along the bridge abutments, at the storm drain outlets and along the northern stream bank to curtail scour.
5. To conduct grading work within the floodway to accommodate the widening of Main Street between Astor and Barbados Streets to provide for two travel lanes in the westbound direction.
6. To conduct grading work within the floodway where Marshall and Main Streets intersect the railway to accommodate proposed upgrade to the railway routes by installing new gates, signals, and crossing surfaces.
7. The existing sanitary sewer mains along Markley Street in the floodway (owned by Norristown Municipal Waste Authority) will also be replaced between Main and Elm Streets.
8. To rehabilitate and maintain the existing Elm Street bridge over Stoney Creek by repointing of the mortar joints, repairs to areas of missing stones, placement of scour protection, and the replacement of the two existing sewer lines that protrude through the arches above the 100-year flood elevation.
9. To place cofferdams in the stream that will temporarily dewater portions of the stream channel during construction. Cofferdams will be used at the Markley Street bridge to remove and replace the bridge abutments, install the rock aprons, and to remove the existing pier 2 feet below final grade. Cofferdams will also be used at the Elm Street bridge to alternate the dewatering of the Arch barrels to allow placement of the rock scour protection along the bridge abutment and within the stream channel.
The project will permanently impact approximately 299 linear feet (2,500 sq. ft.) and temporarily impact 35 linear feet (5,437 sq. ft.). The project consists of the installation and maintenance of approximately 10,230 feet long, 16-inch pipeline and appurtenant structures. The proposed project impacts in Butler County include a total of 300 linear feet of temporary impacts to South Branch Slippery Rock Creek and UNTs' to South Branch Slippery Rock Creek, a total of 32.69 linear feet of permanent impacts to South Branch Slippery Rock Creek and UNTs' to South Branch Slippery Rock Creek. 0.34 acre of temporary impacts to Palustrine Forested and Palustrine Emergent wetland(s) and 0.15 acre of permanent impacts to Palustrine Forested and Palustrine Emergent wetland(s). E40-769, Transcontinental Gas Pipe Line Company, LLC, 2800 Post Oak Blvd, Level 6, Houston, TX 77056, Atlantic Sunrise Pipeline Project, in Dallas Township, Fairmount Township, Ross Township, Lake Township, Lehman Township and Harvey's Lake Borough, Luzerne County, ACOE Baltimore District. The proposed project starts approximately 0.30 mile south of State Route 0118 and Luzerne/Wyoming County Line (Center Moreland, PA Quadrangle N: 41° 23` 40.82"; W: 75° 57` 58.26") and ends approximately 0.10 mile east of Plattsburg Road on the Luzerne/Columbia County Line (Red Rock, PA Quadrangle N: 41° 17` 02.69"; W: 76° 18` 47.97").
To construct, operate and maintain approximately 22.2 miles of 30-inch diameter pipeline and appurtenant structures associated with the Luzerne County portion of the Atlantic Sunrise Pipeline Project Central Penn Line North. The proposed project impacts in Luzerne County include a total of 4,643 linear feet of temporary stream impacts, a total of 401 linear feet of permanent stream impacts, 9.29 acres of temporary floodway impacts, 0.69 acre of permanent floodway impacts, 0.10 acre of temporary lacustrine impacts, 0.003 acre of permanent lacustrine impacts, 9.84 acres of temporary impacts to Palustrine Emergent (PEM), Palustrine Forested (PFO) and Palustrine Scrub-Shrub (PSS) wetlands, and 1.89 acre of permanent impacts to PEM, PFO and PSS wetlands. Specific impacts are shown in Appendix 1—Project Impacts.
The permittee is required to compensate for the proposed project impacts in Luzerne County by providing 8.7 acres of successful compensatory wetland mitigation through a combination of wetland creation and wetland enhancement located at the Briar Creek Mitigation Site along 997 Fowlersville Road (Mifflinville, PA Quadrangle N: 41° 3` 20.44"; W: -76° 20` 4.68") in North Centre Township, Columbia County. The proposed impacts for compensatory wetland mitigation at Briar Creek Mitigation Site include a total of 5,413 linear feet of temporary stream impact to an UNT to West Branch Briar Creek (TSF, MF) and 16.96 acres of PEM wetland.
The proposed project impacts in this permit application are associated with a proposed transmission pipeline project extending approximately 198.7 miles in Pennsylvania between Lenox Township, Susquehanna County, PA and Drumore Township, Lancaster County, PA.
